The Federal High Court in Lagos yesterday sentenced a former Nigerian Maritime Administration and Safety Agency (NIMASA) Director-General Temisan Raymond Omatseye to fiveyears imprisonment over N1.5 billion contract scam.Justice Rita Ofili-Ajumogobia convicted him on a 27-count charge bordering on bid rigging and contract splitting.It is the first major high profile conviction since President Muhammadu Buhari began his anti-corruption crusade.Justice Ofili-Ajumogobia found Omatseye guilty of 24 out of the 27 counts preferred against him. She, however, discharged and acquitted him of threeof the 27 counts bordering on bid rigging.Ajumogobia found Omatseye guilty of the offence of awarding contracts above stipulated threshold and accordingly convicted him on counts 1 to 20,24,25,26 and 27. She discharged and acquitted him on counts 21, 22 and 23 of the charge.The judge held: “In the instant charge, the defendant testified in his evidence in chief that he was released on administrative bail and asked to come back the following day and in his statement, he responded that his threshold for supply was N2.5 million.“Furthermore, his statement was corroborated by Pw2 (prosecution witness two) and Pw3. Pw2 stated in his testimony that in line with the Public Procurement Act, the Chief Executive Officer had a threshold of N2.5 million for goods and N5 million for works.“From the foregoing, I find that the exhibit PD 16A-Y are all above the threshold and approved limit of the DG; that means, they are all above N2.5 million.“The testimony of Pw2 and Pw3 that the approved threshold of the defendant on goods and services was N2.5million does not only corroboratethe statement of the defendant, but totally lends credence to the threshold limit applicable on the defendant as DG of NIMASA.“I find that the threshold as contained in exhibit PD 16 Z is applicable to the defendant, setting hislimit as N2.5 million for procurement of goods, and N5 million for procurement of services.“A calm perusal of exhibit PD 16 series reveals that they are repetitive awards of contract for the supply of goods approved by the defendant in his position as DG of NIMASA. It is clear that all the contract sums are above the threshold as set out in exhibit PD 16 Z, thereby violating the provisions of section 161 (a) of the Public Procurement Act 2007.“Accordingly, based on the foregoing before this court, I am satisfied that the prosecution has proved its case against the defendant beyond reasonable doubt, in the face of the offence contained in counts 1-20,24,25,26,and 27. I accordingly find him guilty as charged on these counts.“The second issue is whether the prosecution has proved the offence of bid rigging? It is trite law that the prosecution must prove all the essential ingredients of the offence before it can be said to have been proved beyound reasonable doubt.“It is my view that the prosecution has not established the offence of bid rigging against the defendant to secure a conviction on that ground, and I so hold.“The accused is hereby sentenced to five years imprisonment on counts 1 to 20,24,25,26 and 27of the charge.He is discharged and acquitted of counts 21, 22, and 23 of the charge. The terms of imprisonment are to run concurrently.”Omatseye was arraigned on January 21, 2013 by the EFCC before Justice Ofili-Ajumogobia on an amended 27 counts of engaging in contract splitting and bid rigging to the tune of over N1.5bn while in office as the DG of NIMASA.The offence, the anti-graft agency said, contravenedSection 58(4) of the Public Procurement Act 2007.Omatseye was also accused on breaching the provisions of Section 14(a) of the Money Laundering (Prohibition) Act 2004.Upon his re-arraignment on January 21, 2013, he pleaded not guilty, following which the court orderedthe prosecution to open its case.EFCC, through its lawyer, Chief Godwin Obla (SAN), called three witnesses, including an EFCCinvestigator, Ibrahim Ahmed; a former Acting Director of Procurement with NIMASA, MohammedShehu; and an officer of the Bureau of Public Procurement, Aminu Aliyu.Omatseye, through his lawyer, Mr. Olusina Sofola (SAN), filed a no-case submission, contending that the charge filed against him by the EFCC was defective.But the judge, last February 2, ordered him to defend the charge.Justice Ofili-Ajumogobia said she was satisfied thatthe EFCC proved the allegations in 24 out of the27 counts against Omatseye beyond reasonable doubt. |

Gambian President Yahya Jammeh threatened to kill any opposition politicians and activists in a speech given on Wednesday as part of his nationwide tour. “Let me warn you, those evil vermin called opposition: If you want to destabilize this country, I will bury you nine feet deep and no Westerner can say anything,” he said. According to Freedom Newspaper, the speech marked the first time Mr. Jammeh publicly addressed a crowd since unrest began in April. It has since been revealed that two UDP party members died after being tortured by the Gambian National Intelligence Agency. The Gambian leader dismissed such reports as lies perpetuated by the Western media in order to destabilize the country. “They say there are massive demonstrations in the Gambia. What great liars are the Western press; you are all liars,” he said to the crowd. “You are used as mouthpieces to destabilize Africa, but in the Gambia you will fail, as you have failed for twenty-one years to destabilize this country with your lies and evil intentions.” Mr. Jammeh remarked that Gambians have the right to oppose his rule through electoral means, but he threatened to kill any individual that tries to take violent action against him. “You have a right to join any political party. You can vote for anyone you want. But no one has the right to join a group of hate mongers that hate themselves and hate Africa and are slaves to the West.” The leader portrayed the upcoming December election as a choice between progress and Western-supported backwardness, adding that some Gambian opposition members are being sponsored by the West as part of a plot to overthrow his government and prevent the Gambia from developing. “These are people being sponsored by the West to destabilize progressive African countries…. Let me make it very clear: there is no single Western country that wants to see an African country develop,” he said. Mr. Jammeh has ruled the Gambia since coming to power in 1994 and will be seeking a fifth term in office this December. |

State Chairmen of All Progressives Congress in the South-East has vowed that the party would take over power in the region in 2019.The chairmen said after a meeting in Abakaliki, the Ebonyi capital, that they would work hard to ensure APC’s total victory in the zone in the next general elections, theNews Agency of Nigeriareports.Imo State Chairman of the party, Dr. Hilary Eke, said the chairmen were touring states in the zone to strengthen the party machinery ahead of future elections.“We are going round the south-east states to ensure that the APC is intact, and I want to assure you in case many of you don’t know thatin 2019, APC will take over all the states in this zone. Culture is closely intertwined with tourism – the former, in fact, often drives the latter. The destination uppermost in the minds of most tourists we know is –Culture. This means that both share friends and – enemies. Of the principal enemies, seeing that we find ourselves within the precincts of governance, I intend to engage your attention in this brief address to just one: Insecurity. That inability of any vacationist to let go completely, relax, submit oneself completely to the offerings of a new environment – the sounds, sights, smells, textures and taste. Of Culture itself, in and or out of the touristic intent, there is no ambiguity in the mind of its enemies. They make no bones about their detestation – call them Taliban, Daesh or ISIS, al Shabbab or Boko Haram. Their hatred is pathological and impassioned to a degree that goes beyond the pale,beyond insanity and sadly beyond cure. The duty of governance towards such retrogressive outbreaks remains unambiguous.After Boko Haram, what next? In fact, at this moment, Boko Haram has no ‘after’ since it is by no means ended, no matter what technical expressions such as “militarily degraded’ means. But let us assume indeed that we are already in the past of Boko Ha-ram.It is now clear that the succession is already decided, the ‘vacated’ space is already conceded, and that the new territorial aspirants are already securely positioned. The entire nation appears to be theirs without a struggle, and the continuity of an established Nigerian necropolis north to south and east to west is being consolidated.Some necropoles are actually architecturally fascinating. They attract visitors from distant places, but those are works of veneration, artistry and dedication. They are visual feasts, among whose structures the visitors actually picnic, leave flowers and symbolic gifts to hovering ancestors. Latin America is full of them. The Nigerian widening necropoles leave only the taste of bile in the mouth, the corrosion of hate, stench and rage.When I read a short while ago, the Presidential assurance to this nation that the current homicidal escalation between the cattle prowlers and farming communities would soon be over, I felt mortified. He had the solution, he said. Cattle ranches were being set up, and in another 18 months, rustlings, destruction of livelihood and killings from herdsmen would be ‘a thing of the past’. Eighteen months, he assured the nation. I believe his Minister of Agriculture echoed that later, but with a less dispiriting time schema. Neither, however, could be considered a message of solace and reassurancefor the ordinary Nigerian farmer and the lengthening cast of victims, much less to an intending tourist to theForest Retreat of Tinana in the Rivers, the Ikogosi Springs or the moslem architectural heritage of the ancient city of Kano. In any case, the external tourists have less hazardous options.Recently however, I returned from a trip outside the country aboutto find that my home ground had been invaded,and a brand-new “Appian way” sliced through my sanctuary… In over two decades of living in that ecological preserve, no such intrusion had ever occurred. I have no idea whether they were Fulanior Futa Jalon herdsmen but, they were cattle herders, and they had cuta crude swathe through my private grounds.However there is also internal tourism, to be considered a premium asset – both economically and in spirit of nation building and personal edification. This was an exercise I indulged in in the early sixties as by-product of other engagements, such as research. A lot however was simply under curiosity. I can claim modestly claim to be among the top twenty-five percent internally traveled Nigerians, acquainted with the smells, textures and tastes of their geographical habitation. I wish the late Segun Olusola were around to testify to the suddenbouts of tourist explorations we made in his VolkswagenBeetle in the pre-war sixties.But now, would the young adventurous set out to visit the mystery caves of Anambra and its alleged curative pools from mere interest? They would think twice about it. It is not merely arbitrary violence that reigns across the nation but total, undis-puted impunity. Impunity evolves and becomes integrated in conduct when crime occurs and no legal, logical and moral response is offered. I have yet to hear this government articulate a firm policy of non-tolerance for the serial massacres havebecome the nation’s identification stamp. I have not heard an order given that any cattle herder caught with sophisticated firearms be instantly disarmed, arrested, placed on trial, and his cattle confiscated. The nation is treated to an eighteen-month optimistic plan which, to make matters worse, smacks of abject appeasement and encouragement of violence on innocents. Let me repeat, and of course I only ask to be corrected if wrong: I have yet to encounter a terse, rigorous, soldierly and uncompromising language from this leadership, one that threatens a response to this unconscionable blood-letting that would make even Boko Haram repudiate its founding clerics.It is now close to a year since I attempted to utilise the Open Forum platform of the Centre for Culture and International Understanding, Oshogbo, to launch a national debate on the topic –SACRED COWS OR SACRED RIGHTS?. The signs were already clear andthe rampage of impunity was already manifesting a cultic intensity of alarming proportions. For reasons which are too distasteful to go into here, the forum didnot take place. We were already agreed that General Buhari be invited to give a keynote address, based on his long experience in such matters as former head of state, and as a cattle rearer himself who might be be able to penetrate the mentality of this ‘post-Boko Haram’ pestilence’. That challenge remains open, but should now involve this gathering, which surely includes tourist and educational agencies. They should join hands with human rights organisations, the Ministry of Agriculture, Farming and local Vigilante associations etc.It is a gauntlet thrown down to be picked up, and urgently, by any of the affected or troubled sectors of society, or indeed any capable and interested party at this conference. The CBCIU is prepared to collaborate.For every crime, there isa punishment, for every violation, there must be restitution. The nomads of the world cannot placethemselves above the lawof settled humanity.Let me narrate a personal experience – just one amongmany – that was brought home to me, right against my doorstep. Before that specific happening, I had observed a change of quality in forest encounters with cattle herdsmen over the years. These changes had become sufficiently alarming for me to arrange meetingswith a few governors and, later, with the late National Security Adviser General Azazi. At the time, we thought that they were Boko Haram, infiltrating into theSouth under guise of cattle herding. That was then, andof course that surmise has never been firmly proven or disproved.Recently however, I returned from a trip outside the country about to find that my home ground had been invaded, and a brand-new “Appian way” sliced through my sanctuary. That ‘motorable’ path was made by the hoofed invaders. Both the improvised entry and exit are now blocked, but interested journalists are invited to visit. In over two decades of living in that ecological preserve, no such intrusion had ever occurred. I have no idea whether they were Fulani or Futa Jalon herdsmen but, they were cattle herders, and they had cut a crude swathe through my private grounds. I made enquiries and sent alerts around, including through the Baale of our neighborhood village. There has been no repeat, and hopefully it will remain the first and last of such invasion. What it portends however is for all thinking citizens to reflect upon, and take concerted measures against.Herdsmen, let us appreciate, are perhaps humanity’s earliest known tourists. They must be taught however that there is a culture of settlement, and learn to seek accommodation with settled hosts wherever encountered. The leadership of any society cannot stan

TheIndigenous People of Biafra (IPOB) led by Mr. Nnamdi Kanu has expressed happiness over the remoured case filed against it and its leadership at International Criminal Court (ICC) in The Hague, Netherlands on alleged killing of over 50 Hausa/Fulani herdsmen in Abia State.The group said although it had not received any suit from ICC or has Nnamdi Kanu’s lawyer, Mr. Ifeanyi Ejiofor received any notification of ICC suit against Kanu, it notedit was a good omen if the rumour becomes a reality.A civil rights activist, Mr Albert Ella, through his lawyer, Edward Omaga of Graylaw Solicitors had reportedly filed a complaint at ICC against IPOB, accusing members and the leader of committing grave crimes against humanity. He also alleged that 55 persons whose bodies were reportedly exhumed by Department of State Security (DSS) were murdered by IPOB with the use of chemicals and other dangerous instruments against the Rome Statute.In a statement by the spokespersons of IPOB,Dr. Clifford Iroanya and Mr. Emma Mmezu said: “We are praying fervently that this news is actually true and not just a fiction. We, IPOB, wholeheartedly welcome this attempt to justify the continued illegal detention of our leader, Mazi Nnamdi Kanu by purportedly charging him to ICC.“We have instructed our lawyers in Amsterdamto convey our willingness to stand trial as wellas seek the ICC to prioritise the allegation.”Meanwhile, former president general of OhanezeNdigbo, Dr. Dozie Ikedife, yesterday in Nnewi, Anambra State said he would not like to engage anyone further in newspaper bantering. The activist had in recent time been involved inmedia war with some people and groups in hisattempts at putting the records straight about him.Dr. Ikedife said he deduced that his attackers might have been misinformed, misguided and frustrated as most of the things they said in the publications were based on imagery “and I have sympathy for them. But I advise them togo and look for their age mates.”However, a source, an elderly man in the industrial community, who would not like to bementioned for fear of being attacked said thosewho were attacking Ikedife in the media did notknow the personality involved. The source acknowledged Ikedife as one of the long standing patriots for self determination, a Nigerian and African patriot who has been fighting for the well-being of the population forwell over 50 years long before most of those people were born.“They don’t know that. I think those people who are attacking him are acting a script written by agents of confusion. It is not fair to Dr Ikedife I know. He is as clean as whistle, a man who does not believe in irregularities and he is very much against bastardisation of customs and tradition. E. by Wilson UwujarenApr 25, 2016 George Uboh, the serial fraudster who sensationally accused the Economic and Financial Crimes Commission of diverting proceeds of recovered assets was today convicted and sentenced to three years imprisonment by Justice S. E. Aladetoyinbo of the Federal Capital Territory High Court Abuja, for his role in converting the property of the defunct Police Equipment Foundation to his own use. Uboh was arraigned by the EFCC on a three-count charge bordered on Criminal Breach of Trust involving the sale of PEF vehicles. He allegedly abused his position as former Head of Security and Communication Department, Police Equipment Foundation, PEF, to convert the properties of the foundation to his personal use. The charge reads: “That you, George Uboh, sometime in 2007 in Abuja, the judicial division of the high court of the Federal Capital Territory, being a servant in the employment of the Police Equipment Foundation, and in such capacity entrusted with certain property, to wit: six units of operational vehicles, did commit criminal breach of trust by selling one Toyota Hilux pick-up van through one Egbon Blessing, and thereby committed an offence punishable under Section 314 of the penal code “That you, George Uboh, sometime in 2007 in Abuja, the judicial division of the high court of the Federal Capital Territory, being a servant in the employment of the Police Equipment Foundation, and in such capacity entrusted with certain property, to wit: six units of operational vehicles, did commit criminal breach of trust by selling one Toyota Hilux pick-up vans to Muha Motors, and thereby committed an offence punishable under Section 314 of the penal code. “That you, George Uboh, sometime in 2007 in Abuja, the judicial division of the high court of the Federal Capital Territory, being a servant in the employment of the Police Equipment Foundation, and in such capacity entrusted with certain property, to wit: six units of operational vehicles, did commit criminal breach of trust by selling two units of Toyota Hilux pick-up vans, and therefore committed an offence punishable under Section 314 of the penal code.” He had pleaded not guilty, thus setting the stage for full trial during which the prosecution called several witnesses to prove its case. Uboh claimed that the former National Coordinator, PEF, Kenny Martins, gave him some PEF vehicles to offset the debt owned him by the Foundation. However, during cross-examination, he admitted that he did not have any evidence of transfer of ownership of the vehicles from PEF. “I know the vehicles belong to PEF. But it was to offset the debt owed me. The Hilux pickup vans are four and not five,” Uboh said. With his conviction, today, Uboh who runs a company called Panic Alert Security System (PASS), completes a double as a certified fraudster having previously been convicted of wire fraud in the United States. He was prosecuted after US law enforcement agents carried out a major raid on a credit card and bank fraud ring led by Uboh in Georgia in 1992. He came out of jail on January 16, 2001. Fifteen years after, he is back in jail. However, Justice Aladetoyinbo gave Uboh an option of N 4 million fine. |
