Filmmaker call out former Rivers state chapter of PMAN, Lexy Mueka over refusal to pay for service Rivers State base filmmaker, Ben Songz has taken to social media to call out the Former chairman of Performing Musicians Employers Association of Nigeria, (PMAN) Rivers state chapter, Lexy Mueka (a.k.a Lexy M) over his refusal to pay for the service rendered to him. Read below: Good morning my name is Ben aka Ben songz I’m a filmmaker/artist based in pH, the pictures you see here is me on a set and the artist here is the former P man chairman of PH Mr Lexy M, here the story begins, since last year Mr Lexy M has been on my case telling me we have to work together and as usual he won’t turn up at the end of the day,every time he sees me he’ll always tell me he wants us to work together so,last month I was coming back from a shoot and I so I’m close to my street and he flagged me down which I stopped and we spoke he said he had this project he wanted to work on, I said OK no problem we could do that, so we have a couple of meetings about the viral video,he told me he had a guy that has a camera and I told him OK I don’t know the camera you have but I have a guy that has a camera 4K G7 he said he had a black magic that shoots 2k so I told him I’d like to work with the cameras I am used too, hey said OK that I should get to the price of the camera and get back to him, which I did. I asked Mr. Lexy M how much was his budget for equipment you told me you had 30,000 So I said OK that we could work something out And later he sent a picture of the camera his friend had, it turned out to be the same Lumix G7, I told him OK it was same camera, he said we are going to shoot with 3 cameras 2 G7 and one black magic,So we had an agreement. So from the 30,000 naira he gave me, I got three spotlights 1G7 Camera, and a Gimbal, I told him I was going to Gets an 18 to 105 MM lens which I couldn’t get cos it wasn’t available at that point in time, and he complained then I got an 18 mm lens this was on the first of March 2019 it was on a Friday we did the shoot, I didn’t tell him how much I charge for shooting a video, I told him appreciate me at the end of the day since he said he didn’t have much for the video, The location was in town, that day I told him we should start the shoot by 10:am he said no we should start by 2:pm I said okay, the light person said she’ll be available by 3:pm that I’d like to wait and get the light he said okay, I kept him posted in everything, even in traffic, so I got there and we started, We shot till 2 AM in the morning and it was very late and we all know town isn’t a safe place, I really needed to get myself and my team and equipment out of there. I Couldn’t get his footages to him on Saturday because the guy got the camera from needed that camera on Saturday for shoot, mr. Lexy M called demanding For his footage is on Saturday I told him I could not get it to him. Camera was out for a job, And then he sent me a message talking about being professional that’s illegal is people don’t behave like that though when you’re done with the shoot should How unprofessional I am that I didn’t come on time I didn’t bring the less I said I was going to bring so I told him I was with this footage on Sundays, he should come pick it up, he said he won’t come on Sunday he will on Monday which he did when he came we talked a whole lot he was saying I was Unprofessional we had some more scenes to shoot That I didn’t come on time so I said OK no problem should fix another date to complete the scenes he said all you had to say and I listened, Then I told him OK the boys I worked with at least I should have something for them as Just to appreciate them then he said he will get back to me but since then when I call him he’ll tell me he’s busy he’ll get back to me, Tuesday no word from him, on Wednesday I sent him a message on WhatsApp he told me he was on his way to Lagos, Ask him what about the team and I have said nothing about it that’s where all the pictures on what’s app comes in then the block of course, he blocked me on what’s app till now nothing from him so I sent him a message telling him I’d make a post on Facebook about this, I went ahead to talk to his friend one of the big names in PH who came for the shoot too, he said I should give him 10 minutes to talk to mr Lexy m he did and got back to me, Then he said that Mr. Lexy M said I sent him some messages that’s very very insulting that I should apologize if I did I didn’t send an apology message because I knew I said my mind which is the right thing that Lexy M said he was going to be back to PH Last week that he will call me and I should come with my boys so we set and talk then he’ll pay them, I dunno when my workers started working for him, i saw him on Sunday but till today i’ve not heard a word from Lexy M, I called him this morning and he said that I reported him to his friend that I should call his friend and not him, lol I guess he Thought it was a bluff when I told him I’d make this post. As it is now I don’t care about the money I don’t care about the video only care about the pH entertainment. This is why we are where we are, if you are my friend and you don’t want me to grow then you shouldn’t come close to me, it’s business not friendship, it’s time we start treating business as business if you don’t have money come out straight, don’t come and tell me how professional you are. Sex before marriage has its advantages too. Few months ago in my area a man decided to wed his fiancee of 3 years, sex never happened all this while.. 6 days to the wedding the fiancee opened up she had "Vaginal atresia" vagina canal was completely sealed. After much argument between them he decided to cancel the wedding but the shame and money spent already running to millions just down the drain? She actually told him she was a virgin and chose to be disvirgined after the wedding. Knowing fully well it was a medical condition issue. To cut it all short two days to the wedding he went on exile. Phone switched off, no one could get through to him. Just after he had text his mum the whole story. Both parents were at each others throat; "You made my son spend so much when you know your daughter is this". Man skipped his wedding. Crazy thing was the guest and all were present only both parents were absent. Probably they didn't know how to break the news out. Man showed up only two weeks after the wedding. With the excuse he needed time to think. A surgical operation could have been carried out before then but the betrayal of the lies got to him more and the fact that the bride's parents knew all along made it worse. Makes it more painful he spent out a large chunk of his life savings on the wedding stuffs. In conclusion he decided he didn't want to have anything to do with the lady ever again. Out of curiosity I asked where he exiled to. Apparently he lodged into an hotel and paid 2 month upfront while playing games a d watching movies, he needed that not to go mental. There are other reasons to this. I actually see how most guys go as far as impregnating before wedding. Like they want to see the pregnancy result before forging on. PRESS STATEMENT BY THE CHRISTIAN LAWYERS FELLOWSHIP OF NIGERIA ON THE SUSPENSION OF THE CHIEF JUSTICE OF NIGERIA BY THE PRESIDENT OF THE FEDERAL REPUBLIC OF NIGERIA The Christian Lawyers Fellowship of Nigeria (CLASFON) observes with dismay the purported suspension of Hon. Justice Walter Onnoghen, GCON, the Chief Justice of Nigeria and the swearing in of Hon. Justice Ibrahim Tanko Muhammad, the most senior Justice of the Supreme Court of Nigeria, as another Chief Justice of Nigeria in an acting capacity, by His Excellency, Muhammadu Buhari, GCFR, President of the Federal Republic of Nigeria, on Friday, 25 January, 2019. It is our considered view that by this decision, the executive arm of government under the supervision of the President has precipitated a needless constitutional crisis having regard to the provisions of the Constitution of the Federal Republic of Nigeria 1999 and the principles of separation of powers and checks and balances entrenched in the said Constitution. The President in his speech disclosed that he was obeying the directives of the Code of Conduct Tribunal contained in an ex parte order made on 23 January, 2019 but which was served on him "a short while ago" presumably on 25 January, 2019 before taking the steps referred to above. The Constitution of the Federal Republic of Nigeria1999 does not make express provision for the suspension of the Chief Justice of Nigeria but this does not foreclose the exercise of disciplinary measures including suspension of the said judicial officer pending resolution of grave moral or criminal allegations against the holder of the important constitutional office. The point we are making is that taking the radical step of suspension of the Chief Justice of Nigeria without recourse to the National Judicial Council (NJC) is a naked usurpation of the functions of that constitutional organ and a brazen violation of the Constitution of the Federal Republic of Nigeria which the President has sworn to protect and defend. The Constitution, subject to its provisions on removal of certain judicial officers, has vested the NJC with power to exercise disciplinary control over all judicial officers. We must state categorically that the order of the Code of Conduct Tribunal upon which the President acted to remove the Chief Justice of Nigeria and to immediately swear in Hon. Justice Ibrahim Tanko Muhammad is completely alien to our criminal jurisprudence and we condemn this action in strong terms. This is against the backdrop of the ongoing proceedings before the Code of Conduct Tribunal which had just the previous day 22 January, 2019 been further adjourned to 28 January, 2019 for hearing of the Motion on Notice. It is apparent from the President's speech that the decision to suspend the Hon Justice Walter Onnoghen as Chief Justice of Nigeria was hinged on his refusal to "remove himself" for the time being on account of allegations of corruption. According to President Buhari, “One expected that with his moral authority so wounded, by these serious charges of corruption, more by his own written admission, Mr. Justice Walter Onnoghen would have acted swiftly to spare our Judicial Arm further disrepute by removing himself from superintending over it while it lasted”. It must be remarked that these allegations of corruption referred to by the President have not been brought before any court of competent jurisdiction. The President demonstrated a complete misunderstanding of the decision-making process of the Supreme Court of Nigeria and arrogated to the Chief Justice of Nigeria powers which he does not possess by suggesting he can influence the decision of the apex court one way or the other contrary to his judicial oath as contained in the Seventh Schedule to the Constitution. The President also clearly demonstrated disdain for due process, respect for the elementary principles of natural justice and the rule of law by constituting himself as the accuser or prosecutor, witness and judge at the same time in respect of the allegations against Hon. Justice Walter Onnoghen. These are roles the 1999 Nigerian Constitution, like the constitutions of all civilised nations, have assigned to different persons to ensure justice is not only done, but manifestly seen to have been done. If the allegations that huge sums of money and properties that cannot be justified are found in Justice Walter Onnoghen’s possession are thoroughly investigated by the appropriate authority and it is found that the CJN has a case to answer, it would then have been dealt with accordingly following due process. We cannot understand the rush especially in view of the subsisting order of the Court of Appeal restraining the CCT from further action pending the determination of the appeal. The action shows lack of respect for a the order of competent because the President cannot pick and choose which court orders he deems fit to obey. That will be arbitrariness of the highest order in a constitutional democracy. Our position as an organisation is that a judicial officer or public office holder who is found guilty of corruption has betrayed the confidence of the public and violated the law of the land. Such an officer is not fit to remain in office for a day beyond the time of proof of his guilt. In fact, such a judicial officer deserves to be punished according to the law of the land and must forfeit his ill-gotten wealth. However, the constitutional stipulation of presumption of innocence must be observed in all cases. Due process cannot be subverted otherwise judicial independence will be compromised and then a descent to anarchy will be irreversible. It is also our considered view that if a corruption trial is handled properly, the Defendant will have no choice but to himself to the dictates of the law as no one is above the law. The unusual speed with which the President acted when he summarily suspended Justice Walter Onnoghen as Chief Justice of Nigeria and swore in Justice Ibrahim Tanko Muhammad in view of the general elections just a few weeks ahead makes us to believe that the removal was politically motivated given the crucial role of the office of Chief Justice of Nigeria in the adjudication of electoral disputes. This development portends a clear danger to our democracy and care must be taken to shield the judiciary from political partisanship in such an open and glaring manner. Assuming as the President wants Nigerians to think and believe, the suspension of the Chief Justice of Nigeria is due to the lack of co-operation by the Apex Court with President Buhari in his perceived fight against corruption, does this then mean the Justices of the Supreme Court must decide cases based on the whims and caprices of the President rather than on the basis of facts before them? If indeed the decision of the Supreme Court is compromised as claimed by President Buhari, do you hold the Chief Justice of Nigeria alone responsible for such decisions? The President’s posture with all due respect to his office is a present danger to the entire Judiciary and the institution of justice in Nigeria. We state categorically that the exalted office of the President has been diminished by the President’s accusation against judgments of the Supreme Court of Nigeria which in the President’s judgment “serially set free, persons accused of corruption, often on mere technicalities, after quite a number of them have been convicted by the trial and appellate courts”. This blanket labelling of Supreme Court Justices who are by tradition precluded from joining issues with the President is most unfortunate and is a direct attack on judicial independence. We condemn unequivocally constitutional infractions and disregard for the due process of law evident in the suspension of Hon. Justice Walter Onnoghen as Chief Justice of Nigeria without the recourse to the NJC. We counsel against turning Nigeria to country of all possibilities where the rule of law and constitutionalism lie prostrate. We call on the President to abide by the Constitution of the Federal Republic of Nigeria 1999 and allow the National Judicial Council to perform its role regarding the consideration of the allegations of breaches of the Code of Conduct against Hon. Justice Walter Onnoghen. We condemn the media trial of Hon. Justice Walter Onnoghen, the Chief Justice of Nigeria and call on the executive arm to forward all allegations of improprieties against the Chief Justice of Nigeria to the National Judicial Council for its immediate action or to a court of competent jurisdiction. We call on the Nigerian Bar Association to take immediate steps to mobilise members of the Bar to protect the independence of the Judiciary and in defence of the Constitution and our nascent democracy. We call on the NJC as the face of the Judicial Arm of the Government in Nigeria to follow past precedents on Judicial Policy to take a decisive decision regarding the unilateral actions of the President in order to defend the independence of the Judiciary from further assault and desecration by the Executive. Pending the decision of the NJC, we demand a reversal of the steps taken on 25 January, 2019 by the President and a return to the status quo in the overall interest of the Federal Republic of Nigeria and fidelity to the principles of separation of powers, rule of law and constitutionalism entrenched in the Constitution of the Federal Republic of Nigeria, 1999. Operatives of the Economic and Financial Crimes Commission, EFCC, have arrested six suspected Internet fraudsters in separate raids carried out at various times across a number of locations in Abuja, the Federal Capital Territory. The suspects: Chemezie Valentine Ezeife, Onwochei Chibuzor John, Onwochei Joel, Marvin Nwankwo, Prince Ojenike, and Jude Olatekobowale, were arrested following a tip-off. Ezeife was arrested on January 16, 2019 at the Life Camp residential area in Abuja, following intelligence reports of shady activities traced to him. Among items recovered from him were a Mercedes Benz C300, Toyota Camry and Lexus Jeep, Seagate hard drive, four laptop computers, an ECOWAS international passport, various wrist watches, two iPhones and blackberry phones, and a Samsung phone. Several suspicious emails were also traced to his account. Investigation into the activities of another syndicate traced to the Nova Estate in Apo, led to the arrest of Joel and John (both brothers). John the younger of the brothers confessed that he got involved in Internet fraud as a student of the Delta State University. He successfully defrauded one Miss Lynese from Zambia, using Facebook, in the guise that he was one Carlos Gomes, a British citizen. Among items found in his possession were an iPhone 6 and iPhone 7, and he confessed to having a landed property in Benin, Edo State, all of which he acquired for N1 million he made from Internet fraud. Two laptop computers, a white Range Rover Sport, white Mercedes Benz E350, and a grey Toyota Camry. His brother Joel confessed that he got into yahoo yahoo through his brother, and asked him to teach him how to go about love scam. “Thereafter, I tried to create an email account, but I was unsuccessful”, he said, adding that his younger brother bought him a wrist watch worth N6, 000, which he is willing to forfeit to the government, “if given the opportunity”. The residence of a seventh suspect, Owootomo Tomilola Sunday, 22, was also raided at the Gwarimpa axis following tip-off of his shady activities, and is suspected to be into “Yahoo Plus”, also called “Wire Wire”. He is involved with hackers who compromise e-mail of multinationals and other prominent companies. Among items recovered from Owootomo who is currently at large, are two Bugatti cars, a Mercedes Benz GLK, Mercedes Benz car, Porshe, $49,000 and duplex worth N300 million. They will be charged to Court as soon as investigations are concluded.
