Politics › Re: Governor Adeleke Addresses Osun People, Says Claim Of Over-voting Unfounded by IgOga(m): 9:29am On Jan 28, 2023
Brendaniel:
After finding out the method used for the judgement on the election tribunal that gave victory to Oyetola over Adeleke, I would say it is a recipe for disaster, the method applied was cancelling all the votes of a polling unit because of over voting in that particular polling unit.

The questions I ask are:

1. As it happened that there were over voting in various polling units in the Osun election, what if each opposition connives to perpetrate over voting in polling units in each opposition strong holds?

2. What then is the use for BVAS in over voting if after the BVAS is able to identify the number of over votes only to end up cancelling all votes(valid) and over votes(invalid) ? That is like throwing away a baby with the bath water.

3. If there is an election tribunal like this and a rerun takes place, what if the same over voting keeps occurring over and over, would they keep repeating the election tribunal process and back to rerun again?

In my opinion, the law is just an error or a purposeful scheme to rig an election using what I call reverse voting
Just simply tamper with your opposition strong holds and invalidate their votes, So we might be having a case where a carefully selected and protected minority will determine winners of an election instead of the majority carrying the votes.

Implications:

1. It will make elections become very dirty because politicians will be all about scheming to invalidate votes in opposition strong holds.

2. It will make the voters lose confidence in the electoral process, because a voter will not be sure if his vote will be invalidated or not by someone else scheming with a politician in his/her polling unit.

3. It will make voters wear out easily and may cause voter apathy when you have reruns after stressful elections, thereby reducing voters turn-up in reruns.

4. It may not reflect the true will of the people and also reduce the total number of voter participation, just like the Osun election tribunal, the total number of votes cast for both PDP and APC after the cancellation doesn't reflect the true will of the people to declare Oyetola the winner.

5. Elections will cost more because of Tribunal, reruns and time wasting.

6. It could lead to anarchy and total chaos, like in some volatile states in the north where they riot over political results, just imagine after election and INEC says they have cancelled over 20,000 polling units across the north which were all stronghold of a particular candidate, because of over voting of less than 2000 voters, imagine what will happen in the aftermath of such news.

Solution:

In situations of over voting, Why not just deduct the invalid votes(over votes) and count the rest, the BVAS already identifies the number of over votes(invalid votes), doing so, INEC will avoid a lot of election tribunals, scheming by politicians, reduce cost of doing reruns, make more accurate results, increase voters confidence, reduce time wasting, reflect the true will of the people and avoid anarchy.
What a silly solution shocked wetin you wan deduct? How will you know who was doing the overvoting? Is it PDP or APC or LP?.....Anyways the electoral act 2022 is clear ..."the presiding officer shall cancel the result of the polling unit" that's your solution

Unfounded in your bedroom abi grin grin grin

Baba you don loose...no way back inec, pdp and apc all agreed there was overvoting. The law is clear it's cancellation not rerun......you nor rig with sense na why
Politics › Re: How Did Osun Tribunal Know That It Was PDP That Overvoted And Not APC? by IgOga(m): 3:25pm On Jan 27, 2023
Workch:
Since the names of voters are not captured on ballot papers to be able to cross check with the BVAS register on whom they voted for. How did they know which party overvoted.

For example:
APC can still overvote without winning. It's common sense

Total accredited voters 3000
APC 150
PDP 200

Toral vote cast 350.

On what ground the tribunal you say that the overvoting must have came from PDP and APC wasn't involved?

Is this not why we should start printing allowing people to write the names on their voters card on their ballot paper before voting?

How did they know how many figures PDP added and APC did?

Adeleke legal team should be smart abeg
grin grin typical nairaland illiterate analysis.....700+ PUs....the law doesn't care whether it's apc or pdp or labour....if it is overvoting the law says cancel it.....in 2018 the law says conduct rerun.....but no more rerun

The implication is that BVAS is not as reliable as INEC made us to believe and election riggers will not be allowed to enjoy the result of their criminal adventures.

Over voting for pdp only?
You can prove that?
Ovevoting affected both parties in Ife, Ilesha, Ede amongst others....but PDP were too greedy with their own overvoting.....Adelele will not win even if Atiku becomes president. The electoral act 2022 is what sacked him not Tinubu
Politics › Re: Why Tribunal Sacked Osun State Governor Ademola Adeleke by IgOga(m): 3:12pm On Jan 27, 2023
Faiththatworks:
Although I feel very sad about the outcome of the Tribunal, but there are certain facts that must be established.
Gov Oyetola's argument has always been hinged on overvoting in some local government especially in All the Ede Local government councils.
According to a report I read from an election observer group, voting continued until around 7 to 8pm in some local governments in Osun State.
The inec law is irrefutable about all voting stopping by exactly 4pm,any vote cast after 4pm is deemed illegal, infact it says only accredited voters are allowed to vote, and accreditation of voters stops way before the voting ends.
My humble submission to Gov Adeleke is to go back and find a way to tally the figures he had by 4pm on election day in all the local government in Osun. The Bvas should have the figures if what inec tells us is true.
I'm not a lawyer but I daresay no court in Nigeria will allow the final figures put forward by Gov Adeleke to stand.
He should preferably argue that the over voting should be deducted and not the whole cancellation of polling booths as these would amount to disenfranchisement of a lot of voters,or push for a rerun in those cancelled polling booths.
Either way this case looks really hopeless for Gov Adeleke, this is a clear message to politicans who want to rig in next month Elections, bvas will stop you if you dare try to inflate your figures.
God bless Nigeria.
The electoral act 2022 states that the presiding officer shall cancel the polling unit.....That is what the Tribunal has done and APC wins.....Overvoting also happened in PUs APC won bit not as significant as those PDP won...
Thank God for BVAS.....no more overvoting angry

Adeleke scored 403k and oyetola 375k. How did the tribunal arrive at the results they announced.
You are late to the discussion. It is the new electoral law in place. If it was the old electoral law inec would be told to rerun elections in the over 700 PUs. However the new law says those PUs will be cancelled which is what the Tribunal followed.

Inec admitted overvoting i.e. bvas data is less than total votes counted for those PUs....Na inec dey do dancing governor o......APC go show Lasun shege...cos na Lasun leave APC go LP go PDP grin grin grin

Since the BVAS data submitted by Apc has been admitted by the tribunal, what does that imply? What about the one issued to pdp by same INEC?
If PDP loose at tribunal they will appeal it.....if APC still loose with their own document admitted then it is over for Oyetola grin
