THE VERY FIRST MISTAKE EVERY NEW LAND OWNER MAKES THAT CAN CAUSE THEM TO LOSE THAT LAND LEGALLY. When you buy a land you should ask for any of these 3 documents. - A survey plan - A deed of assignment or receipt, or - A global CofO A survey is the easiest and minimum legal document that shows you own a property, it has far more importance than the omo-nile receipt you are given. When you buy a land and it has a survey already, that’s good, it shows that the land has been duly registered at the surveyor's general office under the seller's name. So if the same person with his or her name on the survey plan is the same person selling that land to you then your mind should be at rest- to an extent. Now the mistake I have seen a lot of people do is buy a land, get a copy of the survey from the seller and then do nothing. And when you ask them if they have a document for their land they proudly show you a survey plan with the name of the previous owner. You are now confused. You would now be asking Mr Ben Uzo who is the Mrs Ronke Oshodi that is on the survey plan he his holding and he would tell you, my brother, that is the lovely woman that sold the land to him, she is very nice. Yes she might be nice but you are exposing your self to a lot of heart ache when you don’t redo that survey of that land in your own name. You and your children that might inherit that property one day is at a huge risk. Let me repeat myself: Redo that survey of that land to your own name Or to the name of the person you want to inherit that land, maybe your wife's name or child's name. When you leave that survey plan in the name of its previous owner, do you know legally, under the law, its Mrs Ronke Oshodi that still owns that Land and not Mr Ben Uzo who has built a beautiful structure on that land. So if Mrs Ronke, leaves this world and her children see a survey plan that shows that their dear mama has a property somewhere and they investigate and see that you have built a fine house on dear mama's land and all you have is a receipt that mama's agent gave you and a survey plan still in dear mama's name, then your case is closed. In my line of work I have seen cases similar to this more often and in most cases, if the new owner of the land doesn’t have a strong evidence to prove that he or she bought the land fair and square from the previous owner, they eventually lose that land. I don’t wish this on anyone, not after spending that much to acquire a land and even build on it, to now lose that due to lack of information, that is why I am informing you now, please and please get a survey plan in your own name or if that land has a global survey, take that and draft out your own portion of land from the whole lot and duly register it in your own name. And one more thing, when I say duly register it. You won't be unfortunate to fall into the hand of scrupulous surveyors, that would pass on a preliminary survey to you as a registered survey. The difference can't be seen with the naked eyes. If you need a genuine survey done on your property then contact me. My name is Engr Saheed and I have been working with Lagos State Government on Land, Property and Construction related issues for more than five years. I have helped more than 100 clients get genuine documents like: Survey plan, Architectural, Structural, Mechanical and Electrical drawings, Land Use Planning Assessment Report (LUPAR), EIA (Environmental Impact Assessment), Letter of Supervision from a COREN register engineer, Letter of Indemnity from a COREN registered Engineer, Soil Test Report, Building Material Estimation, and Building Plan Approval. I have also worked as a builder for some of my clients to help them build their structure in the most cost effective and timely manner. And because I also work with the Lagos State Government, my clients also enjoy a level of preferential treatment when Government Agencies comes knocking on their construction site. Lagos State is known to be so notorious when it comes to buying of property or land. This is because of so many fraudulent touts surrounding the business of owning a land/property, so much so, that you won’t even know what has hit you once they are done. Most lands in Lagos are owned/inherited by indigenous families passed down to them by their The real problem comes when there are so many members of the family that are divided in terms of claiming ownership of the lands and how the land is truly allotted to them. Before you know it, a property that is meant to be shared by a family of 5 is now being claimed by an uncle or aunty. Or in worst case, you bought a land from the wrong family or from someone who has no right to sell it. This is when they either ask you to pay more or deploy touts to threaten you into leaving the property. Do not fall for their sweet mouth and coercion of this Omo-nile. There are documents that you can request from them or whoever wants to sell a land to you. These documents can be verified at various government office to know the genuineness of the land or its owner. 1. Survey Plan This is by far the most import document required to investigate the genuineness of a land or its owner. With a copy of this you can go to the Land Bureau office in Lagos State and do a geographical search on the land. This piece of document saves you from buying Government reserved lands also known as Committed Lands. These are lands that government has designed for future development, road expansion, or reserved as wetland. If you fail to investigate that land using the survey and you end up buying a government committed land, you will either lose the land and the building whenever government feels ready to recover such property or you are asked to pay a huge some of money for Ratification. Ratification in this sense means you are going to pay the Government the full current price of the land and taxes included. This fee is non-negotiable. 2. Deed of Assignment or Conveyance This is the second most important document you need to trace the history of how the property or land has reached the present owner. It relates all the information in respect of the true owners of the land before it was passed on or bought by Mr A and how MR A sold it to Mr B and How Mr B intend to sell it to you. With this document, you can trace mostly the original families who owns a land and in case there is any dispute as to the ownership of the land you can know how it has been transferred and if you are dealing with the real and current owner of the property. You can do a thorough search in court or at the Lagos State Secretariat in Alausa to know the real and current owner. All you need is just the family name of the person or Omo-nile that want to sell a land to you, and with that, a search can be conducted. You can also ask for a copy of the deed of assignment and use that to aid your search at the relevant office. 3. Certificate of Occupancy, Government Allocation, Governors Consent Any land with any of these 3 documents are considered to be genuine, because these documents are government issued. The only problem is to confirm if they are not fakes, and this can very easily be investigated because the record is there in Alausa. Any property that has either a Global C/O, Private Certificate of Occupancy, Government Allocation or Governors Consent is considered a good buy that would give you peace of mind. 4. Government Gazette This is a document that records and states the areas the government has willingly given to a particular family or community to sell and that the government will not acquire it for what so ever reason except it duly notifies them. The major characteristics of a gazette provides two (2) things. 1. The area where the portion of land is situated e.g Ikotun 2. The coordinates of the total area allotted to them e.g a beacon numbers that denotes where the Land given to the family starts and stops. This is known as an Excision. This means that from a large portion of land let’s say 50 plots, the government has excised 20 to the family and has taken 30 plots for its own use. Those 20 plots will now be documented in a book known as a Gazette. Now the danger of government gazette lands is that you as a buyer can’t know where the land starts and stops right from the gazette. You will need an experienced surveyor that can come to that gazetted area, map out the coordinates and tell you precisely whether your property falls inside the gazette or not. There have been instances where people purchased a lands that was actually outside the gazetted excision and still believe they are inside the gazetted excision coordinates. Do your due diligence and never play with a government owned land. It always ends in tears or bankruptcy. Never trust an Omonile, verify! Need Assistance? Hence, the need for Agencies to regulate, monitor and enforce proper construction and safety of all. There mandate is to process and issue Planning Permit for new construction and Renovation Permit for existing structure requiring renovation or reconstruction. They can visit your construction site to request for your approval building plan (aka Planning Permit) and close such site when they fail to provide it. They have offices in all the LGA called district offices in Lagos State and you can visit their website to see where their office is located in the district you want to build. They issue Authorization to Commence Construction letter to individuals who, after getting their Planning Permit, write to the Agency a letter of intention to commence construction. This Agency then conducts stage certification by monitoring construction works and issuing reports of each stage of construction. This allows them to present the owner/developer of any construction works that is built to standard, according to their approved building plan, with a Certificate of Completion and Fitness For Habitation. Once you have your Planning Permit, process to LASBCA district office within your site location for more information on how to write and submit a letter of intention to commence construction and how to get a Green Sticker (A symbol of government monitoring of your site). 3. For this reason, officers of the commission can visit your construction site especially when it is two floors (one storey) and above. They would insist your workers have safety kits and the environment is safe for workers. And can proceed to seal up any construction without a safety certificate or a safety board. You can contact their office at Block 18 B, 2nd & 3rd floor, The Secretariat, Alausa, Ikeja, for more information on how to get a safety certificate and safety board for your construction site. 5. Local Government Officers Every Local Government Area (LGA) in Lagos have a physical planning and urban development branch that is in charge with building and road development within the LGA. Officers of the Local Government where your building is being erected can visit your site to request for your development permit and stacking permit. The development permit is a levy the local government charges for construction within the area and its paid once. Also, the stacking permit is request if and when you have your construction materials outside your property and on the street. This fee is also a one-time payment. 6. Lagos State Environmental Protection Agency (LASEPA) The mission of Lagos State Environmental Protection Agency (LASEPA) is to safeguard environmental quality that is consistent with the social and economic needs of the State, so as to protect health, welfare, property and quality of life. So when you build on drainage path or on canal set back, expect a visit from officers of this agency. When your construction would affect the environment adversely or endanger lives and property, you can expect to be shut down by this agency. CONCLUSION Basically these are the different agencies that anyone who wish to build in Lagos State have to expect on their construction site and its best to comply with the policy of these agency to avoid seal up and demolition. Please share and let others equip themselves with adequate information so as not to get ripped off by imposters and dubious persons. Saheed S 08127626922 |
My friend Yomi would always tell me, he is going to buy a house. In his own words he would say, "Saheed land fit finish before I make am, so na house I go buy, na to just pack in straight". But personally I would like to build my house from scratch. I don’t know if its because am a civil engineer and I love the thrill and challenges that comes with building things. From buying the land, designing the structure and starting the building. Am sure I would change things in the design as the construction goes, that one is certain. But when I see a lot of uncompleted build around I feel scared of starting a building from scratch; - what if I don’t get to finish cause of hike in price of materials - what if something happens that diverts my funds and the building isn't completed - What if money finishes before I get to even roof it These are valid points you know. Yet I still see people start a storey building and finish within 6months. And, then I wonder how do this people do it. It must be ritual, right. Cus who has that kind of money to start and finish a storey building in less than 6month. Yes Now! Lol, We presume a lot in this country. There is only one secret that could have made this smart people to be able to building such a beautiful structure within 6month, and that’s is PLANNING. If you did an estimate of what it would cost you in terms of materials and labour to erect a one storey building from foundation to roofing and you add a factor of safety of maybe 0.25% to that amount. I promise you, you would start and roof that building under 3months. For example, let us say it would cost you 6million to erect a storey building (nah example o) and with a factor of safety of 0.25% you have a total of 7.5million, either borrowed as loan or saved up in your bank. Once you start that building, believe me people would say you did ritual. Cus the pace at which the construction would move, it would astonish many. People are used to buying in phrases, you do foundation you rest for 3month, you come back after 3month and start block work for the ground floor, you reach the lintel, you rest again for 4 months, then you come back to push it to roof level. Nah.. I don’t wish to build like that. And I know you don’t want that too. Planning your building ahead goes along way to guarantee that you would finish on time. By the way, the factor of safety was for unintended cost not planned for, like sudden hike in cement price or small change you use to buy Trophy for boys etc. So let me ask you, would you buy an already finished and furnished building or building from scratch? We can have a small chat on this here, leave your comment and I would personally engage you. Well, which ever one you choose, I wish you the very best. Till I reach out again, Cheers, Saheed S. 08127626922 |
There are two types of survey you can get; 1. A provisional survey - This has no record at the surveyor general’s office 2. A record (red) copy survey - This has a recorded copy with the surveyor general’s office It’s best you know the different and importance of both. And more importantly, so they don’t collect the price of a record copy survey and give you a provisional survey. Every recorded survey has a lodgement slip. You can request this from your surveyor to confirm it was actually recorded. This is one way to confirm a genuinely recorded survey. Another way is to walk into the surveyor general’s office in Alausa to confirm. The price of a survey plan ranges from locations to locations but you are guaranteed a N50k discount from the official rate in your location. Ask 3 surveyors for their price of doing a survey for you, take the average of those prices and subtract N50k, that is what we would charge you for a genuine record copy survey plan. I didn’t know! Will cost you when it comes to developing a property in Lagos. Lagos is not one of those states you just buy a land and begin to build. If you try it in Lagos without knowing these few things, it can lead to premium tears. Now let us start with the land itself you want to build on, you need to be absolutely sure it is free from any present or future problem. Present problem is when you buy a land already sold to someone else or the seller was a fake and didn’t have the authority to sell that land. Future problem is when you buy government land and you didn’t know. Both cases would make you cry but the tears taste different. So before you start developing any land; 1. Ensure you bought from the right and genuine source, not some distance uncle in a family that is not entitled to the land. 2. For the sake of your sanity, make sure you are not buying a government land, one day, they would remember that land. 3. Ensure you settle the omonile covering that area or you would have to put armed soldier on your site. Give to Caesar what belong to him. 4. Get all your building plan approved before commencing construction and ensure you do not build contrary to what was approved. 5. When you have your approved building plan, ensure you visit the LASBCA district office in that area before commencing construction. 6. When you have sorted all 5 government agency in charge of construction, then you must ensure you build right and use professionals on your site. Do all these and be rest assured that you have complied with almost all government laws regarding construction. The moment you buy a land, you probably would start thinking of the cost of putting up the structure you already had in mind. Ain’t that true. Maybe not in all cases. But most people have an idea what type of structure they want to build before buying a land. But once you have bought, the next thing is to build, that is if you haven’t bought a land with problem. (Except you are keeping the land o sell in the future, which is a risky practice for lands in Lagos) It’s best practice to know what it would cost you in terms of material even before you start to build. You need to know the quantity of materials required to put a building up to at least, roofing. This process is one core function of a Quantity Surveyor. They can help you calculate; - How many bags of cement you would use for your entire construction works. - How many concrete blocks you would use till you get to the roof level. Even blocks for fence too. - What quantity of sand and granite is required for your building - What size of reinforcement and how many you would need to complete your project etc. When you know the quantity of the materials you need to get you from one point to another in your construction phase, it’s easy to plan your building project and finish on time. It’s very easy and cheap to get such details. All that is required is your architectural and structural drawing, and you would get a detailed report of your construction materials sent to your mail. We offer this service that is why we know much about it. So, if you would like to engage us on this, please visit our website www.indepthbuildingservices.com.ng/material-estimation.html P.S: Do need a genuine Survey plan, Architectural, Structural, Mechanical or Electrical drawing? Like most developing states, Lagos state has it rules and laws guiding the development/renovation/reconstruction/remodelling of any structure in the state. But unlike most developing state, there are several government agencies fully ready to cause you headache if you don’t follow the rules or laws in place. When you buy a land in Lagos, the government expects you have your survey plan and your land receipt or deed of assignment/conveyance. Then it is expected that you have your architectural drawing, and structural drawing for buildings above a bungalow structure. Now when you have these four documents; a survey plan, land receipt or deed, architectural and structural drawing. The government laws states that you should apply and obtain a building plan approval and authorization before you commence construction. When you don’t do this and you begin construction, according to Lagos State Urban and Regional Law, you have contravened. And this is where you begin to get visitation from both genuine government staffs and imposters. So when an imposter gets to your site first and you decide to settle out of court, you think you are cleared until the genuine government agency staff shows up and you start claiming you have “settle them”. Another way you can get frustrated is when you decide to cut corners with these government agency staff and try to build without proper documentation. You can get unlucky when these persons are transferred away from the district or another monitoring team from that agency decide to visit your site. That is when you start snitching on officers who were once your accomplice. Now, let’s learn about the government agency that can frustrate you when you don’t have your proper documentation before, during and after construction. 1. LASPPPA: The Lagos State Physical Planning Permit Authority is in charge of processing and approving your building/renovation plan. 2. LASBCA: The Lagos State Building Control Agency is in charge of enforcing the Lagos state building laws and ensuring building are built according to the approval and with necessary authorization and stage certification. 3. LSMTL: Lagos State Material Testing Laboratory is in charge of testing every building materials including the water you use in your construction. And they also perform test on existing buildings or building under construction to test for the strength of the structural elements. 4. LSC: Lagos State Safety Commission function is to ensure that all safety procedures are adhered to at all time on a construction site 5. LG Officers: Local Government Officers issue development and stacking permit to constructions going on in there local government area. Now let’s summarise; - You are suppose to visit LASPPPA to obtain an approval for your building plan. When you don’t, staff of LASPPPA and LASBCA would pounce on you. - When you don’t have the test report for your construction materials and also a safety certificate and board on your site, LSMTL and LSC respectively, will come knocking. - When you put material on the street or even put a digger to the ground, local government officers will come, and most times they keep coming. So, don’t be caught red handed, because bad officers and even imposter are ready to suck you dry. Get all necessary documentation before construction no matter how long it takes or bear the consequences. There are thousands of people selling lands in Lagos, from real estate companies, estate agents, omonile, individuals etc. Buying any land or property in Lagos requires due diligence and before you make payment, here are the documents you should ask for. Now, before I list these documents, remember that all these documents will be in the former owner or owners name and when you get it and its not the person or a confirmed representative you are discussing with. Then you need to take to your heels. Run. These documents that should be a prove of ownership of that land or property will mean nothing if they where illegally obtained or fakes. For example, if Mr John Nwosu is selling you a land or property that he claims its his and the document doesn’t have his name or at least his surname on it (in a case it was inherited or he bought it in his wife or child’s name), that should be your first tell sign. If an estate agent or omonile is trying to sell you a land on behalf of the owner/owners, then you would need to confirm the documents are genuine. Now what document can you request to prove that a property or land is genuinely owned by the individual or group of individuals that claims to own it? 1. Survey Plan: Most lands sold in Lagos has this particular document and it carries the name of the owner and more importantly the coordinates of the Land. You can check for the validity of this document at the surveyor generals office or snap and send to your surveyor friend. 2. Deed of Assignment or Conveyance: This document can help you trace the history of how a property or land has reached the present owner. It relates all the information in respect of the true owners of the land before it was passed on or bought by Mr A and how MR A sold it to Mr B and How Mr B intend to sell it to you. The Department of Lands Bureau can help you to confirm this. 3. Certificate of Occupancy: This is government issued document and although it can also be forged by scamming individuals, its actually the most authentic way to prove that a seller is the true owner of that property. When a seller has an authentic C of O, you should rest easy. These 3 documents can easily be trace at their respective issuing offices for their authenticity. So, what should you do when a seller gives you all three documents and they all pan out to be genuine? You got yourself a sweet scam-proof land/property. Pay up. P.S: Do need a genuine Survey plan, Architectural, Structural, Mechanical or Electrical drawing? Or You need a reputable Structural Engineer to handle the construction of your project? Selling of land or property is one of the most lucrative businesses in Lagos and unfortunately you will find a lot of people ready to scam you of your hard earned money and then even frustrate you into settling out of court. Learn from experience of other and don’t fall victim. These crooks will sweet talk you into buying anything but once you have armed yourself with this few tips, then you can be rest assured that any land or property that you want to buy in Lagos is guaranteed. First, know the source of the land. Most lands popularly comes with a survey document. And this document comes with the name of the registered owner of that portion of land. When you request this from your potential buyer, all you need to do is to either go to the surveyor general’s office to confirm or send to a known surveyor to check; - If the survey plan is genuinely registered with the government and; - If the property is free from government acquisition Run from government acquired land, you can’t win in most case except through ratification or government gazette. Secondly, Some land sellers will present you with a Certificate of Occupancy commonly know as C of O. This document would contain the name of the owner of the land and when you see this in most cases, it should suggest that such land is genuine and land is free from any form of government acquisition. But most scamming land sellers create fake C of O to trick buyers into coughing out their hard earned money without much resistance. You can always confirm this document by taking the number on the document to the Lands Bureau office in Alausa. So, before you buy any land in Lagos, request for the survey and investigate. And if you are provided with a C of O do the same. Please note, these two documents doesn’t solve the issue of land owners selling to one or more persons using the same documents.
