Acting President, Yemi Osinbajo on Thursday offered nine months grace period to tax payers to regularise their tax status or face criminal prosecution for tax offences. Osinbajo made the in Abuja at the inauguration of the Voluntary Assets and Income Declaration Scheme (VAIDs). He said the scheme was specially targeted at taxpayers who had not declared their taxable incomes and assets, as well as those who don’t pay at all, and those who had been underpaying or under remitting. Osinbajo said the scheme would cover all federal and state taxes such as companies’ income tax, personal income tax, petroleum profit tax, capital gains tax, stamp duties and tertiary education tax. http://gistsbase.co “The scheme will be operated from July 1, 2017 to March 31, 2018. “It will be supported by an executive order, which I will sign into law today to offer a once in a life time opportunity to those in default to regularise their tax affairs. “In exchange for full and honest declaration, tax evaders will receive immunity from prosecution, forgiveness of penalty and interest that is due on unpaid taxes. “They will also get the full assurance that all information provided will remain confidential. “In addition, participants in the scheme will not be selected for audit investigation for the period. “We understand that some tax payers may have problems raising cash and for that reason, we have built in a system that will allow those owing to pay over a period of time.’’ According to the acting president, this is subject to conditions. He said that the government would immediately commence a nationwide sensitisation of Nigerians on the scheme and tax in general to ensure compliance. “To this end, we have agreed that every Thursday starting from today, and for the next one year will be declared Tax Thursday. “We expect the Federal Inland Revenue Service (FIRS) and every state government to organise sensitisation events that would raise awareness of the tax system to ensure massive enrolment of new tax payers.We must enroll at least 4 million tax payers and increase the level of payment among the 14 million already registered tax payers. “We expect that all state governors will personally lead this initiative and support the work of the 7,500 community tax liaison officers that would be employed shortly.’’ The acting president said that a high level team working with the Federal Ministry of Finance was set up 15 months ago to research on tax evasion and illicit financial flows. He said the report of the team, which was tagged “Light House Project” searched various data bases such as banks, Corporate Affairs Commission, vehicle registration numbers and immigration to fish out tax evaders. On the international front, Osinbajo said; “Nigeria is now a party to the automatic exchange of information which comes into effect in January, 2018’’. “This means that Nigeria will automatically have all the information to successfully pursue tax evaders across the world. “Specifically, we will have information on beneficial owners of assets held abroad, including those in tax havens,” he said. Meanwhile, the Minister of Finance, Mrs Kemi Adeosun, said that with the scheme, Nigeria hoped to increase tax to Gross Domestic Product (GDP) of the country from six per cent to 30 per cent. “If we pass this test, the future of Nigeria is assured,” she said. In his remarks, Sen. John Enoh of Cross River Central, who represented the President of the Senate, assured of legislative backing to the scheme. He said the senate would pass whatever legislation needed to improve tax compliance in the country. Similarly, the Chairman of Nigeria Governors Forum, Mr Abudulaziz Yari pledged the state governments’ support and commitment toward the new initiative. Yari, who is also the Governor of Samara, said that state governments would be the biggest beneficiary of revenues derived from the scheme as they would give the FIRS necessary support. A recent report of the Joint Tax Board showed that only 14 million people out of the estimated 69.9 million Nigerians, who are economically active, are paying taxes. Accordingly, 96 per cent of the 14 million have their taxes deducted at source; this shows that they are government workers. Also, only 214 Nigerians pay taxes of about N20 million annually and about 900 Nigerians pay N10 million as tax every year.

A 28-year-old jobless woman, Temitope Abiodun, who allegedly bathed her neighbour with faeces, was, yesterday, in Lagos released on N100,000 bail. The accused, a resident of Agege, a Lagos suburb, is standing trial on charges of assault, breach of peace, and resisting Police arrest. She, however, entered a ‘not-guilty’ plea. An Ikeja magistrate’s court, which gave the ruling, also asked the accused to produce two sureties as part of the bail conditions. The magistrate, Mr. J. A. Adigun, said the sureties must be gainfully employed and also show evidence of two years’ tax payment to the Lagos State Government. According to the Police prosecutor, Sergeant Godwin Awaze, the accused committed the offences on June 12 at their tenement building. He said the accused assaulted her co-tenant, Mrs Mercy Ifijah, by bathing her with faeces, noting that “the accused had a misunderstanding with one of her neighbours and in the process, she bathed the neighbour with faeces.” Awaze said the accused also conducted herself in a manner likely to cause a breach of the peace by stripping herself in the public to escape arrest. He added: “The accused resisted Sergeant Gabriel Ejiofor, a Police officer, while trying to arrest her; she removed her clothes and became naked to avoid being arrested.” The prosecutor said the accused, who was a member of a dreaded secret cult called Awawa, had been terrorising residents of the area. “She always brings her gang to threaten residents and also beat up the complainant,” he said. The offences contravened Sections 42, 166, 119 and 173 of the Criminal Law of Lagos State, 2015(Revised). Section 44 prescribes three years imprisonment for membership of an unlawful society, while Section 119 provides three years jail term for resisting arrest. Just when Nigerians thought no lawyer will step out to defend notorious billionaire kidnapper, Chukwudumeme Onwuamadike a.k.a. Evans, Voice Olukoya Ogungbeje has proven an exception. Ogungbeje, who heads Lawflex Chambers and is the Chairman of Voice Vanguard, grabbed the headlines on Wednesday when he filed a fundamental rights suit on behalf of Evans, dragging the Inspector General of Police, and three others before a Federal High Court in Lagos over Evans alleged illegal detention. joined as respondents are the Nigeria Police Force, Commissioner of Police Lagos State, and the Special Anti-Robbery Squad, Lagos State Police Command. In his fundamental rights, the confessed kidnapper is seeking a court order directing the respondents to immediately charge him to court if there is any case against him. He is in the alternative, seeking an order, compelling the respondents to immediately release him unconditionally in the absence of any offence warranting a charged. In the suit marked, FHC/L/CS/1012/2017, Evans is contending that his continued detention by the respondents since June 10, without a charge, or release on bail is an infringement on his fundamental rights. He argued that the respondents ought to have charged him to court in accordance with the provisions of Sections 35 and 36 of the Constitution. It was further argued that the alleged offence committed by the applicant (Evans) are correspondingly intertwined with the constitutional safeguards as provided under Sections 35 and 36 of the Constitution. In a 27-paragraph affidavit in support of the motion deposed to by Evan’s father, Stephen Onwuamadike, it was averred that the applicant has been subjected to media trial without any court’s order by the respondents. Onwuamadike further averred that the media trial and news orchestrated by the respondents have continued to generate reactions in both print and electronic media without his son being afforded fair hearing before a court of law. The deponent also averred that since his son’s arrest, all his family members have been denied access to him while media practitioners have been granted unfettered access to him The new suit has not been assigned to any judge and no date has been fixed for the hearing. Controversial cases: Nyako and Ikoyi funds Evans lawyer, who identified himself on Facebook as Voice Olukoya Ogungbeje had been involved in controversial cases in recent times. In April, he filed a suit asking the Federal High Court to stay proceedings on the forfeiture of $43,449,947 (about N13bn), N23,218,000 and £27,800 (about N10.6m) found in a flat in Ikoyi, Lagos. He also sought an order directing the Economic and Financial Crimes Commission to furnish the court with a report of its preliminary or final investigation on the source of the money, its owner, and how the currencies got into the building. Ogungbeje, in a motion on notice asked the court not to order a permanent forfeiture of the money since there are claims and counter claims as to its ownership by the Rivers State government and the National Intelligence Agency and since the Federal Government had set up the Osinbajo panel to find the truth about the ownership of the money. “This honourable court has the inherent jurisdiction under Section 6 (6)(b) of the Constitution to order and direct thorough investigation on the sources of the monies, their owners, the owners of the Osborne Towers where the monies were found and how they got into the building. The case did not get anywhere as the money was later permanently forfeited to the Federal Government. Ogungbeje also once filed a suit in Lagos in 2014 asking for the reinstatement of Murtala Nyako as governor of Adamawa state. This was after Nyako was impeached by the state assembly in July of the same year and the speaker of the state assembly had taken over. Again, the case hit the rocks. Ogungbeje claimed the Assembly’s alleged failure to serve Nyako personally with the impeachment notice violated his fundamental right to fair hearing as enshrined under Section 36 of the 1999 Constitution. After the court heard arguments from parties and judgment date fixed, Fintiri, through his lawyer, Chief Wole Olanipekun (SAN) urged the judge not to deliver the verdict. The former Nigerian Bar Association (NBA) president prayed the court to set aside all the proceedings conducted in the suit so far because his clients were not served with the suit in accordance with the law. According to him, the court should strike out the entire action since the due process of law was not followed. Cuso International has supported Nigerias development priorities since 1961, working in the education, health and HIV/AIDS, and secure livelihoods sectors, supporting youth employability and entrepreneurship, and is the executing agency for the YOULEAD project, supported by the Government of Canada. Cuso International is currently exploring opportunities to implement a health program in Cross River State, with the potential to scale-up this work to Lagos State over the next 5 years. The main goal of the health program is to increase the quality and gender responsiveness of health services for women, children and youth by Ministries, Departments and Agencies (MDAs) and civil society organization (CSO) partners.
