A MATTER OF PRINCIPLE by Muhammadu Buhari RARELY in modern times can so few have tried to take so much from so many. If Nigeria had lost its arbitration dispute with Process & Industrial Development in a London court on 23 October, it would have cost our people close to USD15 billion. We won, and all decent people can sleep easier as a result. Justice Robin Knowles said Nigeria had been the victim of a monstrous fraud. But it was a close-run thing. As the judge said: “I end the case acutely conscious of how readily the outcome could have been different, and of the enormous resources ultimately required from Nigeria as the successful party to make good its challenge.” But ordinary Nigerians never took the decisions that ended up before Justice Knowles. Had Nigeria lost, it would have required schools not to be built, nurses not to be trained and roads not to repaired, on an epic scale, to pay a handful of contractors, lawyers and their allies - for a project that never broke ground. How did it get to this point? How did Nigeria prevail? Was this a one-off, or par for a shabby and distasteful course? What are the lessons for the future? The ‘P&ID Affair’ was already firmly set by the time I came into office in 2015. A company registered in the British Virgin Islands that no one had heard of, with hardly any staff or assets, had won a contract to build a gas processing plant in Cross Rivers. The company was owned by Irish intermediaries who knew Nigeria well and had done business in everything from healthcare to fixing tanks. The previous government could not supply the gas. The plant was never built. Construction was not started. P&ID did not even buy the land for the facility. But the contract, incredibly, was clear: P&ID could sue Nigeria, and claim all the profits it might have made over 20 years as if everything had been completed. Nigeria was in court in London, trying to talk down liability and costs. Back at home, fixers were looking to work out a quiet settlement. This is often the way. A lot of contracts end up in dispute. P&ID won a settlement in 2017 of USD6 billion, with compound interest. People, including out of work ex-British Cabinet Minister Priti Patel, were queuing up to insist we paid, or risk Nigeria becoming an untrustworthy trade pariah. It was clear that far from the whole story had been told. I tasked Abba Kyari, my chief- of-staff and Attorney General of the Federation, Abubakar Malami, with finding a way, even at that late stage and despite so much conflicting advice, to get us a fair hearing. Working with a number of different agencies and senior officials of government, we began to find a huge amount of evidence, not all of which Justice Knowles was to accept. But he agreed that P&ID had paid bribes. He agreed that one of P&ID’s founders had committed perjury. And he agreed that P&ID had somehow found in its possession a steady supply of Nigeria’s privileged internal legal documents, outlining our plans, strategies and problems. My own view is that this whole, sorry affair shows how important it is to follow the legal process in resolving a dispute. It shows that given time and opportunity for each side to present their case, the temple of justice can satisfactorily resolve all disputes without resort to extra-judicial measures. It was definitely worth the struggle: this was an attempted heist of historic proportions, an attempt to steal from the treasury a third of Nigeria’s foreign reserves. But even at this moment, we should note what the English judge cautioned. The arbitration process in London “was a shell that got nowhere near the truth.” We need better contracts, in the public and private sector. And we need greater transparency: the reality is that, had P&ID not conjured up quite such an outlandish ransom, they may have found themselves in the same place as the myriad other invisible contractors who all too often quietly take Nigeria for many millions in out of court settlements. Sterner sanctions are indicated for Nigerian public officials who have been proven to connive with foreign criminals to defraud our country. Nigeria has won this battle with corruption, but the war is far from over. As Justice Knowles concluded: “This case has also, sadly, brought together a combination of examples of what some individuals will do for money. Driven by greed and prepared to use corruption; giving no thought to what their enrichment would mean in terms of harm for others. Others that in the present case include the people of Nigeria, already let down in so many ways over the history of this matter by a number of individuals in politics and administration whose duty it was to serve them and protect them.” Well said. President Ramaphosa’s remarks at the Closing Ceremony of the New Global Financing Pact Summit in France (FULL TRANSCRIPT) Thank you very much, President Macron, Let me start off by saying, President Lula, don’t worry. When we have the BRICS meeting, the issue of currency is top of the agenda, so we are going to discuss it. President Macron, I just want to start off on a very positive note in terms of what I think is evolving here, I think there is consensus that is clearly embraced by everyone that we need to address climate and poverty because they go together, there’s a Nexus and as it were we need to burn the candle on both sides, so that’s important, so that’s agreed, and we all recognize and accept that we need Capital at scale to address the key challenges that many countries in the world face particularly the developing economic countries, and we also would agreed that there needs to be more cooperation and coordination between your development Banks, multilateral development Banks and the private sector, there need to be coordination so that there is no fragmentation which you kept talking about, but I think what is important to many of us is that there should be solid consensus on the reform of the financial architecture of the world, because without that reform the dreams and the objectives that we have to address our challenges will not be realized, and that those reforms need to touch on a whole range of issues, Mr Moore Ibrahim yesterday even spoke about something that we may think is Insignificant, that the boards of directors of your multilateral institutions are not made up of independent directors they are largely internal people or shareholders, so that in itself for us it’s an important reform. We also need to look at the distribution of the special drawing rights, I find it a bit difficult to be told that this is set in the rules and it will forever be like that and that it’s either you get zero or you get 34 billion, In our view this is not a zero-sum game, it’s a game where we all need to be dealt with, with equity, in an equitable Manner and there is a need for reform in that regard as well, and the other important thing for this to happen, it will help us not to participate as unequal cousins in these institutions, it will help us to participate fully and so that we don’t have a sense that we are beggars, that we are being dealt with out of generosity, I think it’s important in the new era that the world is in now that there should be a good measure of equality among Sovereign Nations, you know, recently seven African countries decided to go and put a call for peace to Ukraine and to Russia and we raised a number of issues, Zambia was represented, Comoros was represented, Republic of Congo was represented, Senegal was represented, Uganda as well as South Africa, so we were all represented and Egypt as well, so we were all at one that even as we were going to address an issue of the war which has had a negative impact on the African continent, which is the rise in prices for food, rise in prices for fertilizers, we were clear that we are not going there as beggars, we are not going to ask for a favor to both Ukraine and Russia, we were going there to say open up the Black Sea Channel so that the seeds , the grains and the fertilizers should go into the World Market, so we were not on a begging mission, even as we are in great need as a continent and all that, that we should go to demonstrate that Africa is, should never be seen as a continent that needs generosity, we want to be treated as equals, even in the multilateral institutions, we want to be treated as equals and if our Equity is at a low air but there must be ways in which that can be addressed, to us this is very important, our sovereignty is one of the things that we hold on dearly to, and we demonstrated that very clearly to both President Zielinski and to President Putin when it came to this issue even as there were suggestions that yes we can donate this we can donate that, we said we want you to release these grains and fertilizers to the World Market so that the world can trade in these Commodities and other issues we can handle in a different way. I wanted to make that point so that it should be understood where Africa has evolved up to, we want to be key players on the world stage; we want to be key players even in the financial markets and in the MDBs, now these are the positive things. I do, Mr President Macron, want us to address another issue, which to us is a bit of a negative, You will have heard President Sisi talking about the 100 billion that was promised in Paris, President Sassou Nguesso yesterday also spoke about it at the dinner. Now there is that issue that a number of the commitments that have been made have not been fully lived up to, but before I get into details, let me immediately say that we recognize the many initiatives that have been put on the table and a number of countries here have done so, Germany has gone out of its way to put a number of initiatives in place, and the U.S has also done a number of things, but there have been times when we felt like we were beggars, I played a key role as chair of the African Union during the Covid period, and we felt like we were Beggars when it came to vaccine availability, when we felt we needed access to vaccines, and the northern hemisphere countries had bought all the vaccines in the world and they were hogging them and they didn’t want to release them at the time when we needed them the most, and we felt like we were begging, and at times it felt like they were just the droppings from the table that yes, we will give you that and that, and let me tell you something, that’s generated a lot of resentment; we resented that, and it got worse when we said we wanted to manufacture our own vaccines, and when we went to the WTO, there was a lot of resistance, enormous resistance, and we kept saying, What is more important? life or profits by your big pharmaceutical companies, and that too, I must tell you, has now generated and deepened that disappointment and resentment on our part because we felt like living in the northern hemisphere is much more important than living in the global south, and these are issues that need to be addressed, and I’m glad that we are all seated here like this because we’ve got to get to the heart of these matters and address them. Now, I come to promises that have been made and Chancellor Schultz was saying, Schultz were saying we’ve got to walk the talk, yes we want to see the talk being walked, President Sassou Nguesso yesterday said at the dinner, a hundred billion dollars was promised per year, and he was saying; I’ve never seen that, and many of us will testify that, that hundred billion dollars has never really been made available, and this should stand out as something that needs to be addressed, because sometimes we sit at conferences like this and say yes we’ll make this available this available and we believe you, we believe you, but now the tire must hit the tower, we must now see action flowing from that, now I want to then talk about something very practical, President Sassou Nguesso raised it yesterday; he said he would be happy if, flowing from this Summit, we did something very practical on the infrastructure side, Having said, that, 600 million people in Africa do not have electricity, and yet we’ve got all the resources to generate electricity, particularly the mighty Congo River, and that there have been plans to build a number of power stations that, by my calculation, will generate up to 70,000 megawatts. and he said, and I want to speak in support of this proposal, that’s to prove that this summits are not summits where we just talk, flowing from the Paris Corp., as well as others, let us now put money on the table and collectively say we are going to address this Mega project, a mega project which will in the end generate electricity for up to 12 15 African countries all at once, and this is a project that I think the multilateral development Banks here working together, the call that you’ve made President Macron, can actually fund, and as We rise from this, we should be able to say, The Inga Dam is now going to be developed into the Inga Power Station, the one that President Sassou Nguesso mentioned and the next one as well. If we can do that, then we as Africans will now be convinced that these summits are really meaningful, and we will now go home and say, you know what? It’s worthwhile going to these Summits, coming to Europe, and listening to all the promises because they are willing to act on them. This is what President Macron, I believe, will have as one of the most important outcomes: the reform of the financial architecture as well as a practical infrastructure project that is going to add a lot of value. President Sisi and I have been talking about a railway from Cape Town to Cairo for years, we will leave that for the next summit, but the one on generating electricity and building power stations on the Inga Dam is the most important and immediate issue that I believe needs to be addressed now. According to a court filing by David Lochridge, the director of marine operations at OceanGate, he was terminated in January 2018 after presenting a scathing quality control report on the vessel to OceanGate’s senior management, including founder and CEO Stockton Rush, who is on board the missing vessel. The report detailed “numerous issues that posed serious safety concerns,” according to the filing. These included Lochridge’s worry that “visible flaws” in the carbon fiber supplied to OceanGate raised the risk of small flaws expanding into larger tears during “pressure cycling.” These are the huge pressure changes that the submersible would experience as it made its way and from the deep ocean floor. He noted that a previously tested scale model of the hull had “prevalent flaws.” Carbon fiber composites can be stronger and lighter than steel, making a submersible naturally buoyant. But they can also be prone to sudden failure under stress. The hull that Lochridge was writing about was made by Spencer Composites, the only company to have previously made a carbon fiber hull for a manned submersible. Following the quality control report and subsequent termination of David Lochridge, concerns regarding the acoustic monitoring system and the carbon fiber hull of OceanGate’s submersible, named the Titan, come to light. Lochridge expressed worry that the system might not detect flaws until the vessel was descending, providing only milliseconds of warning before a catastrophic implosion could occur. Additionally, Lochridge strongly recommended involving a classification agency like the American Bureau of Shipping to inspect and certify the Titan. During a meeting the day after Lochridge filed his report, he was informed that the manufacturer of the Titan’s forward viewport would only certify it to a depth of 1,300 meters, falling short of the intended depth of 4,000 meters required for the Titanic expedition. OceanGate refused to cover the cost of building a viewport that would meet the intended depth requirement. The filing also alleged the use of hazardous flammable materials within the submersible. At the end of the meeting, Lochridge was terminated after stating that he would not authorize any manned tests of the Titan without a hull scan. Lochridge filed a lawsuit against OceanGate in response, claiming retaliation for being a whistleblower. The lawsuit was eventually settled in November 2018. Unfortunately, all five passengers aboard the submersible is dead. Today, on 31/05/2023, we pause to reflect on a dark chapter in American history, the Tulsa Massacre. Exactly 102 years ago, the Greenwood District of Tulsa, Oklahoma, witnessed one of the most devastating acts of racial violence in the country's past. The events of May 31 to June 1, 1921, forever changed the lives of the Black community and serve as a reminder of the ongoing struggle for racial justice. Background: In the early 20th century, Greenwood was a thriving African American community, often referred to as Black Wall Street. Its vibrant economy, prosperous businesses, and flourishing cultural institutions created a sense of pride and resilience. However, deep-seated racial tensions plagued the region and set the stage for the tragedy that would unfold. The Tragedy Unleashed: It all began with a false accusation against Dick Rowland, a young Black man, accused of assaulting a white woman in an elevator. Despite no evidence to support the claim, it became a catalyst for violence. A white mob, fueled by racial animosity and resentment, unleashed a night of terror on Greenwood. Rampant looting, arson, and the indiscriminate murder of Black residents ensued, leaving a community in ruins. The Devastating Toll: The exact death toll and extent of the destruction remain unclear to this day. Estimates suggest that hundreds of Black lives were lost, and thousands were left homeless. Homes, businesses, churches, and schools were reduced to ashes. The aftermath of the Tulsa Massacre left scars that ran deep, affecting generations to come. Decades of Silence: The Tulsa Massacre was systematically buried in silence for many years. The event was rarely discussed, suppressed in history books, and passed down through oral accounts within the Black community. The silence further perpetuated the erasure of this tragedy, denying survivors and their descendants the opportunity for healing, justice, and recognition. Google didn't have any link to it until 2016. Reckoning with the Past: It was not until the late 20th century that efforts to uncover the truth gained momentum. Survivors, descendants, historians, and activists worked tirelessly to bring the Tulsa Massacre to light. Their dedication led to the creation of the Oklahoma Commission to Study the Tulsa Race Riot in 1997, which culminated in the release of an official report in 2001, acknowledging the events and calling for reparations and reconciliation. Remembering and Honoring: Today, we remember the lives lost, the businesses destroyed, and the resilience of the Greenwood community. We honor the survivors and their descendants, who have carried the weight of this tragedy for generations. Their courage in sharing their stories has played a crucial role in the collective acknowledgment and understanding of this dark chapter in American history.
