Errm, I wish so but unfortunately it isn't. Honestly, I checked both judgement critically. The first came after DSS withdrew its case from magistrate court after securing justice Ademola order to detain Kanu for three months while investigation was ongoing. The magistrate had no choice but to discharge the case based on DSS request but the High Court already gave order to detain him.

The second came after the High Court judge vacated his order to detain Kanu for three months without charging him to court. What the DSS did was to charge Kanu to court and detain him. If they had detained Kanu without charging him, then we can say the DSS flouted the court order.
