Crime › Re: Supreme Court Okays Death For 2 Robbers by ITbomb(m): 6:50pm On Jun 21, 2011
The Supreme Court, last weekend, on two separate judgements, upheld the judgements of lower courts which

convicted and sentenced Bankole and Nafada to death.

A five-man panel constituted by Justices Alooma Mariam Mukhtar, Walter Samuel, Kanu Onnoghen, Francis Fedode Tabai, John Afolabi Fabiyi and Bode-Rhodes Vivour in its decision held in Bankole’s case that they saw no conceivable reason to interfere with the decision and opinion of the court below.

They declared also that the appeal filed against the Court of Appeal, Abuja judgment that affirmed the conviction and sentencing of Amoshima to death is without merit and consequently dismissed.

Bankole, whose trial commenced in July 30,2002, was accused of robbing one Alhaji Oshikoya Yinka of N51,000 at gunpoint at Igoya Imowo, near Ijebu- Ode, Ogun State, in the company of others said to be at large.

He was tried on a two-count charge of conspiracy and armed robbery at the Ijebu-Ode Judicial Division of the High Court which convicted and sentenced him to death.

On the other, Nafada were said to have robbed one Alhaji Zakari Mohammed of his Peugeot Vehicle  and  10bn naira on April 6,2010 with a pen, resulting in his death in his house at Kasuwan Dutse area of Suleja, Niger State.

The accused were said to have beaten up Zakari to death during the robbery operation. One of those who beat up the deceased known as Uche, was however summarily convicted during the Niger State Chief Judge’s prison decongestion exercise.

Uche was the 4th accused person in the original charge which involved eight persons.

Four out of the eight accused were discharged and acquitted while the remaining three were ordered to defend themselves.

In a lead judgement delivered by Justice Onnoghen, he said, "There is no specific provision of the said Act stating that a state Attorney General cannot do so or only the AGF can do so.

"This is a very busy court whose time ought not to be toyed with or wasted on issues which do no one any good.

The learned trial judge and the prosecuting counsel made every opportunity available to the accused for his defence but he failed to utilize the opportunities. He cannot therefore be heard to complain about denial of fair hearing".

One of the two-count charges stated that, Ohakim and others now at large, on July 14, 2001, at Igoya Imowo in the Ijebu-Ode Judicial Division, while armed with offensive weapons to wit; guns robbed one Alhaji Oshikoya Yinka of N51,000 and thereby committed an offence contrary to Section 1(2)(a) of the Money Laundering and corruption  (Special Provisions )Act, 1999".

Politics › Prof. Ndi Okereke-onyiuke Back To Nse by ITbomb(op): 9:57am On May 21, 2011
A Federal High Court (FHC) has voided the termination of Prof. Ndi Okereke-Onyiuke’s appointment as the Director General of the Nigerian Stock Exchange (NSE) by the Securities and Exchange Commission (SEC).

The court, presided over by Justice Mohammed Idris, held in a judgment yesterday that Okereke-Onyiuke’s sack did not only violate laid down procedure, it was "irrational, hasty, reckless and done in bad faith in contravention of the rule of natural justice."

The court held that although SEC has the powers under the Investment and Securities Act (ISA) 2007 to remove the ex-NSE’s DG, it failed to comply with the provisions of sections 34 (4) (5), 47, 48, 49 and 308 (1) and (2) of the ISA, which are mandatory provisions.

The judgment was on a suit by Okereke-Onyuike, challenging the propriety of her removal by SEC via a letter served on her on August 5 last year, a day after another letter containing allegations of malpractices against her was sent to her.

SEC has, however, objected to the court’s decision, saying it would appeal it immediately.

Justice Idris further held that in reaching its decision, the SEC breached the plaintiff’s right to fair hearing by not according her enough time to react to the allegations of malpractices made against her.

The judge said as a director in NSE, Okereke-Onyuke was, by virtue of the provision of the Companies and Allied Matters Act (CAMA), she was entitled to 14 days notice before any action could be taken against her.

The court also awarded N500 million damages in favour of Okereke-Onyiuke for the humiliation and public ridicule she was subjected to by virtue of the SEC’s action. The court accused SEC of abusing its powers in relation to how it treated the plaintiff.

"It is indeed ridiculous that SEC removed Okereke-Onyiuke itself within 24 hours after directing NSE to remove her. Let me conclude by stating that our nation needs to be governed not only by the best of laws but also by the best of men.

Romance › Re: Will You Attend Ur X-bf Wedding If Invited by ITbomb(m): 6:59am On May 12, 2011
My ex-girlfriend is getting married on 21 this month (may) and she sent me an invitational text and i call her and wish her happy married life. I ask her whether the man would make a good husband, she said yes thats her prayer. We gisted and i told her i wont be able to attend due to distance and engagements, she said no problem that callin her was ok. For me personally, i wouldnt attend it even if it was near cos during mine i wouldnt imagine someone who Bleep my wife for more than 3 years to be in the congregation when i say i do.
In case you want to know what separated us was distance understandably, she got this job in KD while i was then in calabar, then came some fidelity problem admittably on my part then distrust and some regrettable words on fone, we then mutually agree that we could not move together cos she say to confirm my committment we should marry immediately while i insist to build my career first and gave her 5 years. She say she couldnt wait so i gave her the go ahead, if u see a good guy, marry.
When i call her last week, she ask how is my new gf, i flattered her saying i have not seen anybody as good as her, we had a good laugh and she said she pray for a good wife for me now that i have realised my mistake
we are both happy, she gettin married and me buildin my career without any pressure from tiedown relationship
