Islam for Muslims / Re: The Truth About Sharia Law by Jairzinho(m): 2:33pm On Feb 07, 2010
Lagosboy:

Codification and specificity.

I state here categorically 95% of the muslim scholars agree on the penal code and it is very specific :

A thief - cut his hand
Public Adulterer - Stoning
Public Drinking - 70 lashes
Public fornication - 100 lashes
Slander - 80 lashes
Lagosbobo, long time. . . this is actually part of my grouse with 'Sharia' law. How can you determine what constitutes a thief?

Is it an armed robber,a pick pocket or Alhaji governor  stealing his state blind? Law is much more complex than this.

I live in an ARAB MUSLIM country governed by Sharia & people are sent to jail for stealing. . . not amputated !

Nigerians with our OVERZEALOUSNESS.even Islamic Republic of Pakistan does not  amputate pick pockets.

We need to think all these things through. . . .just like you read the Qu'ran IN  CONTEXT,all these archaic punishments should be READ IN CONTEXT as well.

Togo’s withdrawal[/center]

The Executive Committee of the Confederation of African Football met on 30 January 2010 and examined the withdrawal of Togo national team from the Orange Africa Cup of Nations 2010.

The Executive Committee and its president renewed their sincere condolences to the families of victims involved in this tragic terrorist attack which happened January 8, 2010. The attack was condemned by CAF and also a total support was given to the Togolese team.

At that time, CAF said they have understood perfectly the decision of players not to participate in the competition.

Meanwhile, following a decision taken by players to participate in the competition, the Togolese government decided to call back their national team.

The decision taken by the political authorities is infringing CAF and CAN regulations. Therefore, a decision has been taken to suspend the Togo national team for the next two editions of Africa Cup of Nations, with a fine of $50,000.00  handed to the Togolese national football association, in conformity with article 78 of Africa Cup of Nations Angola 2010.

muhsin:

Ahah, don't play that on me, Jairzinho. wink

One don't have to tell you everything about him/her to know who is he/her; action speaks lots more than words, as one saying goes.

For a typical example: Shiites extol Sayyadi Ali and Nana Fadima (radiyAllahu anhum), and in the course put them above every other created human being. More-over, don't forget their taqiyya--deceit and lies--which hide their real selves and genuine ideology.

Go read about them; and if possible interact with one of them. You'll come back and tell me.
i live with them my friend. . . & I have found out many assumption are just that assumptions. . .add that to the fact that we all have things we do not completely understand/agree with our faith. So i say focus on the fundamentals.

We have something similar in christianity. Non-catholics(like me) have been brought up believing catholics worship Mary (mother of Jesus) and regard her more than Jesus Himself. In addition they have some traditions which aren't directly written in the Bible.

So if you ask a typical non-catholic,he'll tell you catholics aren't 'Christians'. I later found this to be false, because. . . people are born into certain beliefs and as they grow older they adopt some & leave some,so putting a blanket on everyone is wrong and presumptuous.

Shias are muslims only differ with Sunni on some aspects of theology/history of Islam ,but the fundamentals are the same.

I think Etuhu is lacking confidence, making tackles isn't the only thing. . . he needs to move with the ball & show some confidence,he's playing like he doesn't want to make a mistake. And for his height ,he needs to make his presence felt for corner kicks etc.

We conceeded 3 against Egypt with 3 defensive midfielders,so much for his 'tackles'.

Yakubu should retire from Int'l football after this tournament. Nsofor+Martins+Odems the superstar should start next game.

Sam Milla:

I want to say something. This is called politics.
Lagos state gave 1 million dollars. Despite that it was a goodwill gesture, it was out of other.
No state jumps over its federal government on such issues.
Lagos should have consulted the federal government to know their plans before throwing money around.

Japan is thousands of times richer than us.
The donated 5 million dollars. before individual wings come in.

There are also countries that donated nothing. Its not fair though but sometimes we have to check how the affected country respond to such issues as well before doing anything.

All in All, Lagos state shouldnt have donated that money before federal government.
They now make federal government look wicked and careless.
Nigeria is in leadership crisis. Everyone including Fashola should be aware of that.

I guess he jumped and donated that money to make himself look very good to ordinary people of Nigeria.
He succeeded but in some World Govt, he could have been suspended from duty.
Just that Nigeria is not working.

With all due respect, this is somewhat illogical, and is the main problem with nigeria.

The federal govt of Nigeria is currently filled with rent seekers and bootlickers ,who are so far removed from the problems in states, talkless of local govts & wards, that it would be irresponsible for any forward looking leader to look up to these indisciplined bunch.

The main reason we don't have light & security in the states is becos of the FG,they insist that any power generated by the states should first be given to the national grid & the it would be 'redistributed',policing should be controlled from Abuja, same thing with resource control and other things.

Japan & other responsible countries that operate federal system ,have people with clear foresight and genuine concern for people runniing their government. So rather than the states asking the FG for direction, the FG would have taken initiative immediately and everyone would tow the line.

The clintonbush initiative by Obama is a clear illustration of this. So please when doing a critical analysis of Federal system of govt, always take into coignisance the aberrant nature of Nigeria's example.

@Jairzinho: « #4 on: January 16, 2010, 12:34 PM » As for Hellfire, it is already in existence. Quran supports its existence. Hadith supports its existence. Read Surah Najm, as Allah says of Muhammad (AS), the Messenger saw what he saw, and there is no doubt about what he saw. So even though I was not there before and now back, but Muhammad, my leader who I follow, went to heavens, saw Paradise and Hell among other things. Should I now deny what he saw, and accept your admonishment, above which will be tantamous to disbelief! Should I disbelief after I have beliefed knowing the hypocrasy of such an action, inwardly or outwardly, conscious and sure that there is a horrible reward awaiting disbelievers in Hell? I am standing firm on truth. Even when it is something that is against me.
The existence of hell/heaven is given based on almost all faiths. My point is summarised by Lagosboy above. . . .you olabowale CANNOT ,I repeat CANNOT determine who goes to hellfire ,or who doesn't,so stick to propagating your faith & leave punishment/repercussions for unbelief to God Almighty.

Umar ibn Khattab (RA) very senior to Imam AbdulWahhab was questioned, debated, etc by those who were in his generation (RA, ra). So AbdulWahhab was not the answer to all the questions or issues of Islam. If I disagree with him, I will not necessarily go to hellfire, unlike if I do with my beloved Messenger, leader of mankind (AS). Tis is the reason that those who demeaned him shall go directly to hellfire, barring none!

Alhaji, isn't this rather presumptuous, sir ?? Hellfire ?? Na you build am?

Politics / Re: Donald Duke Blames Jonathan For Weakness! by Jairzinho(m): 1:35pm On Jan 13, 2010
debosky:

please accept my apology
wink

debosky:

He addressed the nation on new year’s - less than 12 days ago. Why should he make another address now?
That’s good, what was the gist of this address as I wasn’t aware of this before now.

debosky:

The AG is the man legally empowered to speak on the legal implications of Yar’adua’s absence - Goodluck is not a lawyer so what are you expecting? As for the special assistant (I assume you mean Adeniyi) he is the press officer attached to the president and hence is his mouthpiece - again, is Jonathan now supposed to become the press officer to show he is the VP?
I'm wasn’t referring to Adeniyi , this is where 'the spirit' of a law comes in. . . tho' hinged ultimately on judicial interpretation, the law never meant there to be a vacuum, possibly the assumption was we would have sincere people at the helm.

debosky:

Unfortunately it’s not that simple - presidents can be absent from the country for any number of reasons - that does not AUTOMATICALLY put the VP ‘in charge’ - the constitution is clear on it. Without powers being formally transferred, he can only act on the president’s instructions. As far as we know, those instructions are still what he is acting on.

That’s precisely the point I'm making. If you get  3  lawyers in here , you may  get 3 different  interpretations of the law. So for Jonathan & his PDP ilk to take the convenient road shows lack of genuine sincererity.

I ask again, if we were to be attacked by another country in the present circumstances, what would happen?? Who will give the military the go –ahead?
To further buttress my point of a conspiracy; did you hear what the NASS did when they 'discussed' the issue?

debosky:

I am not deficient - have any of those states declared Islam as the ‘state religion’? What they have implemented is the legal system of Shari’a - only applicable to Muslims and NOT a case of adopting a state religion.
In any case, even IF those states violated the constitution, does that make it right for Goodluck to do the same? Both actions were overturned by the courts in due time.

But at the time there was a rational legal interpretation, and you can never know what would have happened if those rulings were appealed.
The official religion in Zamfara  and other northern states  is islam, forget all the sound bites. Everything is censored according to Sharia & you have Islamic police –Hisbah, enforcing Islamic law.

Criminal prosecution falls within the purview of States, now when someone’s hand is CUT OFF for stealing a cow, which breaks every law of the constitution on humane treatment of convicts? Is the individual who’s arm is cut off NOT a Nigerian?

Does his religion overturn his rights as enshrined in the constitution we have all being touting ?

Take it from me, the official religion is Islam in those states.

No one is asking anyone to BREAK the law ,like I said before, on almost all issues, there’s usually more than one point of view on the law, so the interpretations  you’re alluding to, while it may serve the current interests of the oligarchy, may not necessarily be the correct one.

I’m happy some people have gone to court on this , but my point is he needs to act on what is right & not what is expedient.
Politics / Re: Donald Duke Blames Jonathan For Weakness! by Jairzinho(m): 9:45am On Jan 13, 2010
Beaf:

Maybe you gave reason for that? Why go on to talk as if Jonathan is the owner of the constitution.
Although my comments you’re responding to was initially directed at someone(debosky) else and my initial reaction was to tell you ‘mind your damn business’. . .however I will take the high road and address your points below but note civility in arguments is paramount for intelligent people. Never be tempted to descend to the brit-bat, tit for tat insults, common on NL, we can disagree on BIG issues, but not descend to such inglorious depths, ok?
Beaf:

I wonder why you aren't battling the faulty constitution handed to us by sit tight military strongmen who wanted to be life presidents (Abacha and IBB). In any military setting, the head of state is almighty, that is what they handed to us, because of the way they left the scene. Blame yourself for being shortsighted enough to accept such a flawed document as your definition of law.
Nobody’s battling anything. The letter of the constitution is very clear,BUT THE SPIRIT of the law (get a lawyer to interprete this for you) is what is in question here. No matter how imperfect the constitution is, the framers never intended for the country to be left directionless,as we are at the moment.
So my point is this stalemate is only a conspiratory political solution. Don’t blame the game. . . blame the players. AND POINT OF CORRECTION,THE 1999 CONSTITTION WAS DRAFTED under the auspices of GEN ABDULSALAMI ABUBAKAR(not IBB & Abacha).
Beaf:

Blame yourself for being shortsighted enough to accept such a flawed document as your definition of law.
Mr Beaf, please stop all these ‘you’re short-sighted’ nonsense, don’t get personal.
I can respond, but I’ll hold back for now. , I assume you’re matured enough to take correction.
Beaf:

How many times does the simple answer "he has no executive power" need to be given to you?
IT’S HIS OFFICE WE’RE TALKING ABOUT MY FRIEND. . . .not him. . .seperate the 2. The VP has no executive power when the president is in situ, but once he’s incapacitated in any for. . . VP is default.

Beaf:

This is at best self contradictory. We all know the position of the Nigerian Bar Association (NBA), we all know who they have taken to court and why. Your Dugbe market view of the law is no match for that of the umbrella law association in Nigeria.
Last warning . . . . .respond to facts . . . don’t personal. Pick holes in my point of view don’t insult me.

Beaf:

That Bumble said that did not stop the fact at the time, that "the law supposes that your wife acts under your direction". The law is the basis by which criminals are sent to jail; your argument is illogical. As Debosky says, Jonathan is a mere spare tire according to the laws of Nigeria, or are you saying Jonathan should stage a coup?
Largely incoherent. . . . care to clarify?
I didn’t ask debo to go to Wiki to explain ‘the law is an A.S.S. ASK A LAWYER !!!
Politics / Re: Donald Duke Blames Jonathan For Weakness! by Jairzinho(m): 7:43am On Jan 13, 2010
debosky:

He is not in charge - ANYONE can chair a meeting. If you see the pictures, he doesn't even sit where the president would sit, the chair is left VACANT to show that the PRESIDENT is absent.

There is hierarchy in govt, so   ANYONE   cannot chair meetings, understand your statutes my friend. Even in a family meeting , ANYONE cannot lead a meeting.

debosky:

How should he lead? Please be explicit on this and don't make vague statements - lead how?

By taking decisive action where he needs to & stop giving excuses. Who are the ministers reporting to at the moment?? Who is setting direction for government? He should address the nation  & stop all this timid actions.
Now the special assistant to the president even talks to the press on behalf of govt. The AG is saying the president can run the country from Saudi?? All these  is a manifestation of lack of direction/leadership.
The fact that they can’t even say the VP is in charge is deeply troubling . Once the president is absent, the default is the VP. . . . . no long thing !

debosky:

According to the lawyers (and I am not one) the Oaths Act allows the CJN to swear in any judicial officer in the land, including his replacement. If anyone feels this is wrong, let them go dispute in the courts

You are obviously deficient in your understanding of the law.
The Nigerian Constitution Section 10 states ‘ The Government of the Federation or of a State shall not adopt any religion as State Religion.’ Don’t we have Islamic states in Nigeria?

You people just say things you do not know – THE LAW IS AN A.S.S, ask your lawyer friends to explain what that means.
A governor (plateau) was impeached by 6 house of assembly members looking at the same constitution, Ladoja was impeached from a hotel room, all these were enforced by police.

OBJ declared state of emergency in a state, removed the governor & appointed an administrator, before notifying the NASS ,is that constitutional??. Is the ‘Oath Act’ part of the Nigerian 1999 constitution? Up until recently the police were using a public order act passed by the military to prevent public gathering.

So what am I saying OPEN YOUR EYES AND MIND & stop letting PDP deceive you. People hide behind the constitution when it suits them & bring up one stale statute when it doesn’t.

From the civil service statutes, Yar’adua’s 6 weeks absence should trigger a medical enquiry immediately, but has that been done.
So accept what you have here is a convenient political stalemate engineered by the ‘northern cabal’ & stop quoting law !
