COMPASS: The Election Petition Tribunal sitting in Akure, the OndoState capital yesterday admitted the voters register used in the October 20, 2012 governorship election as exhibits. The admittance of the voters register commenced the hearing proper of the petition filed by theAction Congress of Nigeria (ACN) against the victory of Dr. Olusegun Mimiko as the governor of the state. The opposition ACN had sought totender the register in order to disprove the result announced bythe Independent National ElectoralCommission (INEC). The opposition was trying to prove before the Tribunal that the result announced by the electoral umpire was a variance with the voters register. The documents, brought in 18 “Ghana Must Go” bags were admitted by the tribunal followingthe granting of the application moved by the party to bring in the report of the inspection of the materials of the INEC used forthe election. Lead counsel to the ACN, Chief Akin Olujimi, SAN, had moved the application of the party to bring in the report of the inspection of the materials of INEC ordered by the tribunal. He said since the court had allowed the petitioner to carry out the inspection of the materials, it was under obligation to allow the report to be part of the documents to be relied upon for the execution of the petition. Olujimi asked the tribunal, led by Justice Andovar Kaka’an, to grantthe application. However, Counsel to Governor Olusegun Mimiko, Chief Wole Olanipekun, SAN, asked the tribunal to dismiss the application as it did not show by way of affidavit extreme circumstances that could make the tribunal grant the application. According to him, one of the people listed in the deposition, Adesina Fatai was not one of those listed to give additional evidence. Olanipekun argued that what the ACN wanted to tender as additional evidence were documents that were in the possession of the petitioner before the tribunal granted the order for inspection of the INEC materials used for the election. In his argument, counsel to Labour Party (LP), Yusuf Ali, SAN, urged the court to dismiss the application as it was bereft of any substance. He submitted that it was the proper time for the court to scrutinize the written deposition of the proposed witnesses to enable the tribunal know whetherthey were within its order. He also argued that such action would enable the tribunal to determine if those that were proposed as additional witnesses actually participated in the inspection exercise at INEC. Ali also urged the tribunal to dismiss the application because the affidavit in support of the application lied against itself His words “Where an affidavit tellsa lie against itself, it must be rejected. Some of the people thatswore to affidavit that they participated in the inspection did not participate as their names could not be found on the attendance list”. In his reply on point of law, Olujimisaid the application was filed within the pre-trial period; therefore all authorities cited by the respondents were irrelevant. He argued that the order of the court did not ask those that participated in the inspection to sign an attendance register, adding that the order did not also ask the people to analyse the INEC’s documents at the stateheadquarters of the commission. Teaser4: when u wana request for bedspace u will login to the portal,with ur jamb registration no,and ur birth year as ur password...u gona change it later. First u will pay all the required fees in to oau bank account.after then u will come to skul(resumption) u can pay on campus if u wish.cos those banks may not confirm ur payments in time,if ur payments have not been confirmed u cant do anything on the portal,not even bedspace clearance...that's why I said it is slow nd stresssful,it depends on the bank sha...infact,u 're doin a fantastik job here sir.Thanks |
