A group, Advocacy for Societal Rights Advancement and Development Initiative, has instituted a fresh suit before the Federal High Court in Abuja seeking to stop the Chief Justice of Nigeria, Justice Mahmud Mohammed, from swearing the President-elect, Muhammadu Buhari, on Friday. The suit filed on Tuesday is also seeking an order nullifying the certificate of return issued to Buhari by the Independent National Electoral Commission. The plaintiff hinged the suit on the allegation that Buhari did not qualify to contest the presidential election on the grounds that he gave false information about his academic qualification to INEC. Between January and February 2015 there were about 10 cases instituted by various plaintiffs challenging Buhari’s eligibility to stand for the poll on the grounds of his academic qualification controversy. But after he won, the cases were withdrawn. In the fresh suit filed by its lawyer, Mr. Philip Ekpo, the group alleged that Buhari did not meet the qualification enshrined in the 1999 Constitution and the Electoral Act to stand for the March 28, 2015 presidential election. Buhari, INEC, the CJN are the 1st to the 3rd respondents in the suit respectively. The plaintiff is seeking an order of interim injunction restraining the CJN “or any person acting in his capacity” from swearing in Buhari as President of the Federal Republic of Nigeria on May 29, 2015 or any other date thereof pending the determination of the motion on notice. The plaintiff seeks among other orders, “A declaration that the 3rd defendant be stopped from swearing in the 1st defendant as President of the Federal Republic of Nigeria, as the issue of perjury involving the 1st defendant has not been resolved. “An order restraining the 3rd defendant or any person appointed for such purpose from swearing in the 1st defendant as President of the Federal Republic of Nigeria on May 29, 2015 or any future dates whatsoever for giving false information to the 2nd respondent on oath. “An order annulling the Certificate of Return given to the 1st defendant by the 2nd defendant.” The grounds canvassed by the plaintiff read, “The 1st respondent (Buhari) gave false information in the affidavit he presented to the 2nd respondent (INEC) and on the strength of which he contested and purportedly won the presidential election which was conducted by the 2nd respondent on March 28, 2015. “The 1st respondent deposed to an affidavit dated November 24, 2014 that his West African School Leaving Certificate is in the custody of the Secretary to the Military Board. “The Nigerian Army on January 20, 2015, said that in the personal file of the 1st respondent with the Nigerian Army, they do not have the original copy of his West African School Leaving Certificate nor does the Nigerian Army have the Certified True Copy of his WASC results neither do they have a photocopy of the said result. “The 1st respondent has not met the qualifications enshrined in the 1999 Constitution of the Federal Republic of Nigeria and the Electoral Act, Cap E6, Laws of the Federation of Nigeria, 2010 (as amended) to have contested the position of President of Nigeria at the 2015 general elections. “That the authority conferred by Section 140 of the 1999 Constitution (as amended) on the 3rd respondent to administer oath of office to any person who will occupy the office of the President of Nigeria cannot be exercised in respect of the 1st respondent who has not fulfilled the requirements of the same constitution and the Electoral Act as it relates to his eligibility to occupy the office of President of Nigeria.” The case has not been assigned to any judge http://www.punchng.com/news/group-asks-court-to-stop-buharis-inauguration/ |

Isn't it time for Nigeria to start thinking of diversification of its sources of revenue?. Is it not time that rather the federal government paying states allocations - states should pay taxes to the federal government?. Mayweather earned about USD 200 M last week against pacquiao. thus would translate t roughly about 40b naira. even if it were to be taxed he would still make about 28 B Naira. this could pay the salaries owed to osun state workers and IMO state. i a big shame. Nigeria governors should start thinking of generating revenue n pay taxes and STOP DEPENDING ON FEDERAL ALLOCATIONS. LET STATES PAY TAXES TO THE FG. THAT'S the only way Nigeria can grow |
micktoxin:what information do you have that is classified? you mean apple would come to Nigeria to set up a plant? do you know in China a fake apple headquarters was busted? have you seen the Chinese range Rover sport? there are serious intellectual property issues apple faces around the world so that should be the major reason. urs part of the rule of law. if pirates run around with ke products and the police does nothing then ts a serious issue. for tour information electricity is on the concurrent lists and states in Nigeria can generate theirs however there's a proviso that they must aso feed the National grid. this are some of the issues the national assembly needs to look at. generate your electricity ad keep it not share it. those are the key issues. electricity generation is too too complex for buhari to understand and if he's not careful bad eggs in hid government would use it to scam him like they did to obasanjo. if he works on security the rule if law ad stability of government policies every other thing would follow. foreign investors aren't small people. these guys are richer than a lot if Africa governments! do you now how much fine Microsoft paid the EU in 2004? avout a billion euros! meanwhile Nigeria is borrowing to pa salaries! so forget it. these guys hae the cash to generate electricity in Nigeria to do their business and still make huge profits. |
micktoxin:Electricity did not stop them. There is no rule of law in Nigeria. do you know how the law works for businesses n China? A court in Lagos asked dstv to stop its price hike. it has refused to do so. now which sensible business would come to a country where people don't obey court orders? so if you are a foreign investor ad you come in and you have an issue with another business you take them to court say for intellectual property rights issues, you are not sure the other business would obey the judgement. that's a key issue. buhari needs to work on that and ensure no one flouts courts orders. its the job of the executive that is the police to enforce court orders. the court has done its job already. so u think apple with it intellectual property wealth would come to Nigeria where pirates run amok without any restraint? do you know t intellectual property issues apple is currently facing in China? Forget about electricity. buhari would get scammed like obasanjo if he focuses on that |
micktoxin:Wrong. Electricity isn't the biggest reason investors aren't coming. investors could generate electricity insofar they could make big profits. why hasn't MTN left Nigeria? what do you think they use to power their base stations? Investors aren't coming because the country is insecure security, there is also an absence of the rule of law and instability in government policies. provide 24 hour electricity today but let boko haram run gamut around the country and tell me which foreign investor would stay |
amakaobiemeka:hope u didnt try withdrawing from another person's atm cos this is a very stupid question |

AgentMS:excuse me. can you compare a lokoja that was barely capital for a year or a calabar that was actually the capital of southern Nigeria with a Lagos that was capital of a united oil rich Nigeria for 77 years? this is why history should be made compulsory in all schools. it would help folks like you. this is from wikipedia- The British annexed Lagos as a colony in 1861. The remainder of the Benin Empire - i.e, modern-day Nigeria - were seized by the British in 1887, and when the British established the Colony and Protectorate of Nigeria in 1914, Lagos was declared its capital. Lagos maintained its status as capital when Nigeria obtained its independence from Britain in 1960. Lagos was therefore the capital city of Nigeria from 1914 until 1991, when it was replaced as Federal Capital Territory by planned city of Abuja, built specifically for such purpose. |
Very true. Its a shame desmond elliot is even running for a state house of assembly. Imoke was 30 years old in 1990 and he was in the senate. HOW old was tinubu when he was in the senate? taking Nigerian youths for fools. The voting power of Nigerian youths can deliver a vibrant 40 year old president. Shame on nigerian youths really. it all boils down to a lack of ambition. many of them cant even pass waec neco or jamb to save their lives. all they know is women drinks partying and nonsense while tinubu rubbishes himself |
ACCORDING TO PUNCH President Goodluck Jonathan of the Peoples Democratic Party has won last Saturday’s presidential election in Rivers State with a total vote of 1,487,075. Maj. Gen. Mitsurugi:You must be very ignorant. so most kids who study law abroad did so cos they couldn't pass jamb? do you know what it takes to get accepted to read law at Kings College London or the London school of economics?. You need a minimum of 3 As at GCE A-Levels. Yes Madonna is a backwater school. where they had to queue to get into the law school? do they even study there at all? you know no thing about careers and career counselling so you cant understand why parent pay millions of naira to send their wards to top schools in england. have you seen a jobless oxford law grad? (for ur info its called BCL at oxford) ,or one who went to cambridge? even in england schools have class and there are rankings. Swansea is down the rankings in the in uk. u go to top schools not some backwater school and then u com here to blab. do you know what it takes to get into Harvard law school or Yale or Princeton? |
Mitsurugi:The LLB is the foundation of good lawyer not the LLM. a lot of top lawyers gani, babalola do not have LLMs. So how does a LLB from a backwater school like madonna hold water to a LLB from Kings College London? You know nothing bout all this so stop blabbing. an average person living in the states could afford a house and a car if he works a normal 9-5 office job without a university degree. so wats the fuss? open ur mind and think out of the box not my friend said or i know a woman bla bla bla bla. thrash |
Mitsurugi:well mayb nigerian customary law is where a returnee wud be lost. wats bar part 1 for?thats thrash. why do u think most sans send their kids to england? cos they know the big advantage their kids get when they come back. where did the law of trusts originate? the woman u talk about is average. if that's wat u call rich then u have no understanding of wealth. go to ikoyi and see young solicitors closing multimillion dollar deals. nonsense |
Mitsurugi:did gani study law in nigeria? where did afebabalola read law? babalakin? so a house in surulere now qualifies one to be called rich? u need check the dictionary meaning of rich. common law originatedin england the whole world leant from them. u can neva compare one who read law in england to one that studied in nigeria. english law is the original. what is run in nigeria is a photo copy and a very bad one at that |

You talked about opening my mind and thinking outside the box, yet you are held with a colonial cube looking down on what your country produces. Like we don't know most of the rich kids that ran to study abroad did so because they couldnt pass JAMB. Oops, you just ranted about my making references to people I know so I'll hold it there!
