A staff of the Economic and Financial Crimes Commission, EFCC, has told a court that a written statement allegedly volunteered by the spokesperson of the Peoples Democratic Party, PDP, Olisa Metuh, was destroyed by Mr. Metuh partly because it made references to former President Goodluck Jonathan.

Junaid Said told the court that Mr. Metuh admitted in the statement that he received N400 million arms money and used the sum for political activities and his personal needs, and made references to Mr. Jonathan.

The EFCC on Friday amended its charge of “destruction of evidence” against Mr. Metuh, the Peoples Democratic Party National Publicity Secretary.

The charge was amended at the resumption of the proceeding by the commission’s counsel, Sylvanus Tahir, at an FCT High Court presided over by Justice Ishaq Bello.

Mr. Tahir said the third-count of “Mischief” contravened Section 326 punishable under Section 327 of the Penal Code.
Testifying in the case, an EFCC witness, Junaid Said, told the court that Mr. Metuh tore the commission’s document.

Mr. Said, a Special Task Force Team member of EFCC, led in evidence by Mr. Tahir, said that the team received a petition in January 2016.
He said that the petition was from the office of the National Security Adviser (NSA), Sambo Dasuki, which alleged that he transferred N400 million to Destra Investment Limited, a company owned by Metuh.

The EFCC witness said investigations revealed that the transfer was done without any contract approval.

He said the team visited the resident of Mr. Metuh at Prince and Princess Estate, Abuja, on Jan. 5 and invited him to the commission.
Mr. Said told the court that Mr. Metuh honoured the invitation and was interrogated by Ibrahim Musa, Michael Wetkas, Bello Umar, David Nkpe, Bello Adama and Eucharia Ibrahim.
The EFCC witness said the defendant volunteered a statement to the commission.

“My Lord, when he concluded writing his statement which was on four sheets of the EFCC statement form, I collected the statement and read over it, I then handed the statement over to my superiors Musa and Wetkas.
“When I was handing over the statement, the defendant said he was surprised that he had written that much and that he felt he had given too much information.

“Because of the comment, I was worried I gave him the statement sheets one after the other for endorsement,’’ the witness said.
He said Mr. Metuh endorsed the first and second sheet, but tore the third sheet.

The witness told the court that the third sheet was where Mr. Metuh disclosed that he received the money for PDP political activities, settle his personal needs and made reference to former President Goodluck Jonathan.
“My lord, he suddenly tore the statement sheet into pieces, in great shock and surprise I stood up I asked him why he did what he did?

“He said he did that because he was no longer willing to give the information on that statement sheet.

“I then requested the pieces of the statement, he declined and attempted to put them in his pocket, I then cautioned him and told him to respect himself, he insisted that he was going to dispose the torn sheet.

“I persuaded him to handover the tore sheet and brought one plain paper before him, he poured the pieces on the plain sheet, my other colleagues were there looking at us in surprise as well.
“He furthered tore them into pieces, saying only in the movies would this be recovered.

“I poured the pieces in the commission’s transparent polythene bag for exhibit and made entry of the incident into the EFCC’s incident duty station diary as well as EFCC’s pocket notebook.

“Later, in the day he requested to make additional statement, which he made, wrote his name and signed but declined to make any other statement on the torn paper.’’

The EFCC’s incident duty station diary, EFCC’s pocket notebook and the tore pieces were tendered and admitted as exhibits.
Mr. Said admitted under cross examination by Onyechi Ikpeazu, Mr. Metuh’s counsel, that the issue of the torn sheet was not written in his statement.

Mr. Ikpeazu demanded for the witness statement, but the prosecuting counsel gave him a photocopy of the statement.

Mr. Tahir said the defendant should have served him with notice to produce the document.
Justice Bello said the matter could no longer proceed without the original copy of the witness statement.

“Documents must meet the status as required by the law, there must be a certified copy of your documents.

“It is a healthy practice to produce the documents in your custody, especially in a criminal trial,’’ the judge told EFCC before adjourning the case till March 16 for continuation.

An old friend called  from the United States last week. He is a naturalized Nigerian American who had not been in Nigeria since he left about twenty years ago. He had been following the revelations concerning the arms deal and withdrawals of millions of dollars from the Central Bank of Nigeria, CBN, allegedly purely for the PDP campaign.

He went on to inform me, as if I don’t know, that even Nixon’s Watergate scandal, which many still regard as the most shameful event involving an American President was a mere child’s play compared to this. Still thundering, he asked, “You mean the President of Nigeria can actually ask somebody to go to the Central Bank and take money out for distribution to his party members and nobody asked questions until now? No wonder your country is underdeveloped. And, is it true that this Jonathan guy has a Ph.D?”

Feeling thoroughly embarrassed, I meekly answered, “Yes, he has a doctorate in Zoology.” Permit me if the expletive he uttered in response to that declaration is unprintable. I felt ashamed of my Fellow Countrymen, especially all those who made the Goodluck Jonathan presidency possible from 2011 to 2015. Only a totally conscienceless and unpatriotic Nigerian can fail to admit that this disaster will for ever haunt this generation of Nigerians. Posterity will always ask if we ourselves were not crazy to have elected such an individual as our President; they will definitely judge all those who worked for his re-election as insane – even if with benefit of hindsight.

As my caller was ranting on, and calling Nigerians a bunch of unflattering names, I eventually got in a word. “My friend, this disaster was foretold, as early as 2009; followed up in 2010 and repeated in 2011 and 2015.” However, before getting into my “I told you so sermon”, let us pause and identify those who produced the catastrophe called Jonathan Presidency, because if history is ever to do justice to this generation of adult Nigerians, it must single out the major culprits of this monumental calamity.

Step forward Chief Olusegun Obasanjo, GCFR, ex-President of Nigeria, and dictator of the Peoples Democratic Party, PDP, from 1999-2011. Baba, always full of words, but lacking the wisdom to distinguish between what needs to be said or left unsaid, was the architect of Jonathan’s emergence as Vice-President in 2007. The Americans have always regarded the VP position as a “heart beat from the presidency”; not the “spare tyre” which an uncouth Nigerian called it. And, when Yar’Adua’s heart stopped beating in 2010, Jonathan stepped up to the Presidency. A man whose lean credentials could not have fetched him Head of Department in a decent university, who had never been in charge of anything, never unilaterally achieved any objective, became the President of the largest black country on earth. Never had the job and the new helmsman been more mismatched in recent history. It was akin to sending an ant to go lift a truckload of sugar. It takes what it can for itself.

Wisdom would have dictated that the nation would stomach the obviously unprepared fellow for a year and then through a free and fair election choose someone with a great deal of experience and all the leadership qualities Jonathan lacked or had not developed. But, OBJ, then Chairman of the Board of Trustee of the PDP, would not allow commonsense to prevail. Operating with self-assumed superior sagacity, he hardly allowed Yar’Adua’s body to be laid to rest when he started yelling. “Jonathan, you must run for the Presidency; don’t tell me you won’t run.” Well, Jonathan ran; Obasanjo supported him and he won the election in 2011. As the reports on Jonathan, Obasanjo’s 2011 candidate for President, trickle in, objective observers of “Ebora Owu” must ask: “Where is the commonsense in recommending and pushing a disaster on the people?” Wisdom is obviously lacking in the selection; patriotism is suspect. And, let nobody deny Baba Iyabo’s (and where is Iyabo?) role in the whole of a mess in which we find ourselves.

Among those now gloating over the revelations of grand larceny under GEJ are those “progressives” who once belonged to a political party called Action Congress of Nigeria, ACN. They certainly don’t want to be reminded about their own ignominious role in Jonathan’s victory in 2011. But, the history of this era and this unfortunate episode will be incomplete and falsified if their contribution to our present predicament is left out. Theirs was a purely mercenary one as will be briefly described. The party in 2011, as most people with short memory would recall, had its own Presidential candidate, one unfortunate stalking horse called Mallam Nuhu Ribadu. Ribadu’s was once a highly regarded corruption fighter as the Chairman of the Economic and Financial Crimes Commission, EFCC, who had been badly rough-handled by the PDP government – mainly because most of his victims were PDP governors. So, ACN adopted him as their flag-bearer – despite raised eyebrows by people who thought a swindle was in progress.

The way the merchants of ACN dropped Ribadu, a few days to the 2011 elections can best be described in the words of O. Henry, 1862-1910, “It was beautiful and simple as all truly great swindles are.” (VBQ p 239). The party had canvassed for votes for election into various offices and had largely “captured” the South West – until the Presidential Election. Suddenly, supporters started receiving multiple text messages; party workers went from door to door; and, a few days to the election the party faithful were ordered to cast their votes for Jonathan. Poor Ribadu was seating in Yola expecting an avalanche of votes from Lagos, Ogun, Oyo, Osun, Ondo and Ekiti; Edo also. The man must have thought something was wrong with his eyes and his TV set as the results came in from those ACN strongholds. I was recuperating in a hospital in Abuja when it happened and as AIT brought the results, I had to ask a nurse if I was going mad. Jonathan cleared all ACN states except Osun. Later, we learnt from the OWNER of the party that they sold the votes and Nigeria for N17 billion when Ribadu was considered a loser. So, the South West votes in 2011 also helped GEJ to become President. ACN, please step forward to receive your traitors’ medal…

POWER TO TWO PEOPLE

Forget the conscienceless others. I would like to know how Okonjo-Iweala and Reuben Abati feel now about being associated with GEJ. Were they aware all these things were going on or were they ignorant? I pity them. GEJ covered them with “gold”; now he is splashing them with guilt. The money will end at the grave site; the dishonour for ever.

Today, Saturday, February 20, the people of Benue South will return to the poll to elect their senator.
The contest is straight between a former Senate President, David Mark, of the Peoples Democratic Party, and David Onjeh, a former students’ leader, and candidate of the All Progressives Congress.
The election is a rerun. The Appeal Court had nullified the March 28, 2015 election of which Mr. Mark was declared winner.

Mr. Mark is 68 years old, while Mr. Onjeh is 41.
Benue South Senatorial District has nine local government areas, dominated mainly by the Idoma ethnic nationality.

The district also has significant populations of Igede, Agila, Alala, Apa and Agatu. Messrs Mark and Onjeh are native Idomas.

According to reports from the LGAs, INEC officials are now moving to polling units with materials for the conduct of the election. A would-be suicide bomber who refused to detonate her explosives in northeast Nigeria was identified as she tried to flee because of her distinctive hairstyle, a military officer said on Friday.

The officer, who was at the camp for displaced people in Dikwa, Borno state, when two other women blew themselves up on Tuesday, killing 58, said the third was spotted as she tried to leave.

“The Kanuri women are known for plaiting their hair but we realised over time from the bodies of female suicide bombers that they all had ponytails,” he told AFP on condition of anonymity.

“Based on that we came to the conclusion, after a thorough investigation and the testimonies from female bombers arrested alive, that before going on suicide bombing they are made to wear a ponytail because in Kanuri traditions when a woman dies before she is buried her hair is loosened and made in to a ponytail.

“Because they (Boko Haram) assume these women would never return when sent on the suicide mission, they are given that ritual before they go out.

“So, when we saw her fleeing the camp with a ponytail, we just knew she was one of the bombers, so we arrested her and she confessed.”
Many women wear a long hijab covering their head in the Muslim-majority north but the officer, who was involved in the arrest, said hers had slipped in the panicked aftermath.

The carnage at the camp, which houses more than 50,000 people who have fled nearly seven years of violence in the region, was the latest in a string of attacks against civilian targets.

Boko Haram, which is composed mainly of the ethnic Kanuri group indigenous to the region, has increasingly used suicide bombers, including young children, in its campaign to create a hardline Islamic state in northeast Nigeria.

Satomi Ahmed, of the Borno state emergency management agency, told AFP the failed bomber decided against detonating her explosives after realising her parents were staying there.

Ahmed, who viewed her interrogation video, said she told investigators she was kidnapped by Boko Haram when they took over her village of Boboshe, near Dikwa.

“She was turned into a sex slave. She and four other girls were picked and detailed to carry out attacks on the camp (in Dikwa). Apparently they (Boko Haram) were tired of her,” he added.

“She already knew that her parents were apparently in the camp. They left Boboshe towards the camp in Dikwa. Three of them were sent as the first batch of bombers to the camp.

“When they arrived at the camp, she quickly moved away from the other two because she knew they were carrying explosives. When they exploded, she tried to flee the camp.”

Ahmed said the girl did not reveal when she was kidnapped but told them Boko Haram did not send out recently seized women and girls to be human bombs, indicating she had been held for some time.
Boko Haram’s continued attacks in the region come despite the government’s insistence it has “technically” defeated the Islamic State group affiliate.

Ahmed said fighters attacked Shuwarin village, about 25 kilometres (16 miles) outside the Borno state capital, Maiduguri, at about 10:30 pm (2130 GMT) on Wednesday.
“They killed four people and burnt 21 homes. Residents fled into the bush,” he added.

“We got the story this morning and when we arrived we found they had already buried one body and were preparing for the burial of three others.
“But we took the bodies to the hospital here (in Maiduguri).”

The Nigerian Army meanwhile said it had cleared and released 275 detainees, including 50 children, two from Niger and two from Cameroon, suspected of involvement in “terrorism or insurgency”.

Residents of Wahab Close in EJigbo in Lagos State, western Nigeria, were stunned by the drama that played out in their area after a pastor who sneaked into a man’s house to make love with the man’s wife was caught in the act.

The pastor, who had already pulled off his pair of trousers and soutane, ran out wearing only his underwear when the man, known as Vitalis Okere, barged into his home.

The action caused commotion in the street as the residents expressed shock over what happened.

P.M.NEWS gathered that the pastor, identified simply as Victor, had allegedly been sneaking into Okere’s apartment and was allegedly sleeping with his wife identified as Chidinma for several months.

While the alleged illicit affair was going on, Okere, who is a security guard and spends much of his time at work, did not know until their 11-year old daughter informed him about what has been going on behind his back whenever he went to work.

P.M.NEWS gathered that Okere works as a guard in a company and he leaves home in the afternoon and returns the following morning.
While he is away at work, Victor takes over.

The pastor would sneak into Okere’s home to meet Chidinma when their five children had gone to school.

P.M.NEWS gathered that whenever the children return from school late in the evening, they would stay outside while Victor and their mom, Chidinma would lock themselves inside their room pretending that they were praying.
The eldest daughter who did not like what was happening informed their dad.

On the day the nemesis caught up with the adulterous pair, Okere dressed up and told his wife Chidinma that he was going to work and would return the following morning.
Victor as usual came with the hope that Okere had gone to work and would not be around.

While the pastor and Chidinma locked themselves inside, and the children were outside, Okere came back in the evening and knocked at the door and asked Chidinma to open the door for him.

While it was taking them much longer time to pen the door, Okere forced the door open and Victor rushed out in his pant, leaving behind his pair of jeans trousers and soutane in the room.

When Okere confronted his wife about what she was doing with the pastor behind closed doors, she said they were just praying together.

Okere then took the clothes and went to the police station and reported what happened.
The clothes were kept as exhibit at the station and Chidinma was asked to produce Victor who is now on the run.

When our reporter visited the house where the incident happened, the eldest daughter who revealed the whole thing to their dad said her mom travelled to their village in Imo State on Wednesday over the matter.

Damian Dodo, a Senior Advocate of Nigeria, was interrogated for eight hours by agents of the Economic and Financial Crimes Commission (EFCC) on Thursday, according to a statement by EFCC spokesman Wilson Uwujaren. The EFCC reports that it has stepped up investigations into the notorious Halliburton scam and that Mr. Dodo’s questioning is connected to this probe.

Sources close to the investigation disclosed that Mr. Dodo was being questioned for his role in the alleged $26 million bribery of a former minister and five other Nigerian lawyers.

The former minister involved is said to be former Minister of Justice and Attorney-General of the Federation Muhammed Adoke.

The EFCC alleges that Mr. Dodo received $4.5 million through his legal firm, DD Dodo and Co., from multinational companies connected to the Halliburton bribery scandal using the false cover of legal services.

It is also alleged that Mr. Dodo withdrew more than $2 million in cash “in flagrant violation of extant money laundering regulations,” according to the EFCC.

The Nigeria army has warned members of the public to be wary of people dressed as “mad men”, especially in the north-east, saying they could be suicide bombers waiting to detonate their explosive devices.

Rabe Abubakar, a brigadier-general and and acting director of defence information, issued the warning on Saturday, following Friday’s bomb blast at Gombi market, Adamawa state, that resulted in the death of 10 people.

“It has come to the notice of the Defence Headquarters (DHQ) that Boko Haram members, in their desperation to cause colossal havoc, have now devised a new method where they dress like mad persons to gain unsuspecting access to public areas to detonate bombs,” Abubakar said in a statement.

“The 2 male suicide bombers, dressed like mad women and carried out suicide bomb attack in Gombi, Adamawa state, is instructive in this direction. Five people lost their lives and several others were wounded in the heinous attack by these ungodly people.

“The Defence Headquarters therefore urges our fellow good citizens across the country to be wary of mad persons approaching markets, public places or crowded areas so as to nip this ugly trend in the bud.

“Nigerians are also enjoined to be security-conscious at all times and should endeavour to report any suspicious person or object to security agencies for prompt action.”

Honestly, I just can't begin to reason why Metuh was busy throwing stones at the person of PMB when he knows fully well that he has skeletons in his cupboards.

Please and please, I will also like to enjoin the EFCC and other relevant bodies to please investigate Metuh whether he actually pay his workers their salary, because I won't be surprise if he is owing his workers 6-8 months salary without the hope of paying.

I mean, judging from the way he's been shooting his mouth, and flaring his arrogance, he seem the type because he has the over inflated ego that usually scream "nothing dey happen".

The Economic and Financial Crimes Commission, EFCC, on Tuesday, January 26, 2016 presented another witness in the ongoing trial of the spokesman of the People’s Democratic Party, PDP, Olisa Metuh, and his company Destra Investment Limited, before Justice O.E Abang of the Federal High Court sitting in Abuja.

Testifying as prosecution witness (PW3), Bali Ndam, a civil servant and legal officer in the Office of the National Security Adviser, ONSA, told the court how the ONSA wrote a letter to the EFCC requesting the Commission to investigate some payments made for contracts that were never executed.

Ndam told the court that, a sum of N400m (four hundred million naira) was transferred to Destra Investment Limited from the office of the National Security Adviser.

Destra Investment Limited, the second defendant in the matter, is a company owned by for the embattled spokesperson of the PDP.
He identified the documents marked “exhibits A to C” presented as emanating from the ONSA as well as EFCC on the investigation of the said payments.

The admissibility of the documents was contested by the defence counsel, Onyechi Ikpeazu, SAN, on the grounds that, a witness can only testify to a document made by him and not by someone else.
Ikpeazu also argued that, the documents did not have a certified true copy attached to it”.

“Besides, the Annexure to the documents are electronically generated and should satisfy the provisions of Section 84 of the Evidence Act”, he further argued.

Responding, counsel to EFCC, Sylvanus Tahir stated that the documents have been misconstrued by the defence.

He submitted that, the letters cannot bear a certified true copy because they bear the original signature of the maker and not a photocopy.

“It is a public document which can be tendered in court by the recipient and testified to by a public servant like the witness. The electronically generated documents are only correspondence and not a statement of account as provided for by Section 84 cited by the defence. The documents are all relevant in the case. I urge your lordship to admit same”, pleaded Tahir.

In a bench ruling, Justice Abang opined that there were several departments of the government involved in the prosecution of this matter which included not just the EFCC, but the ONSA and other government organisations.

According to him, any officer in the department involved in the prosecution, can appear to testify or tender any correspondence issued by that organisation.

The judge further stated that, it is only a public document for the payment of a prescribed fee that requires a certified true copy.

Therefore, if the letters are admissible in court, the annexure can also be admissible. The document cannot be presented in piecemeal as they are all relevant in the case.
“I hereby admit the evidence as exhibits “A – C””, he ruled.

Under cross-examination, Ndam maintained that, the sum of N400m (four hundred million naira) was transferred to Destra Investment Limited from ONSA.

Justice Abang, thereafter adjourned the matter to January 27, 2016 for continuation of trial.
