But we submitted my sister's application first week in November, and exactly 3 weeks later, she received an email that "her application a bit complicated" so might delay a bit. Check your Visa, what's the date by which you need to be in Canada? I think you just need to send them the new admission letter through webform, so you don't run into problems at the border. VERY VERY LONG POST ALERT! However, I thought to write this long so that different people can pick a thing or two...... Do read along.................... Hello everyone, thank you for your kind words and congrats to all who have gotten their PPR thus far. As promised, I'll try to share my story with you guys, even though it's incomplete as of yet. Family of 5 Study permit for me and 3 children, visitor's visa for hubby Submitted June 10, 2020. Biometrics request June 11 Biometrics done August 24 (a day after VFS reopened) GCMS requested August 28 Refusal September 24 GCMS came back Sept 28 Now, from the GCMS notes, I noticed the following: 1. The decision to refuse was taken as at July 11! Guys try to order your GCMS as early as 6 weeks into your application. 2. There was an error in reaching one of the reasons for my refusal. I had done an MBA in Nigeria, going for a Masters of Finance, but the VO interpreted it that I had done an MFin previously and so there's no career progression. Immediately i received the GCMS, I torn between reapplying and seeking a Judicial Review (JR). The reason I considered the JR in the first place was because I felt the refusal simply unfair and baseless. Yes, a visa is not my right, however, as long as an individual meets the guidelines set in place, it is only fair that they receive a positive outcome. Another reason I considered it is because, it's an opportunity people rarely use and this has given VOs the leeway to keep refusing people on a whim. If more people contest their refusal and win, it will likely lead to an overhaul of the current system going on in Nairobi. October 2, I contacted an Immigration Consultant on Instagram about the possibility of reapplying. After reviewing all my documents, he insisted I go for JR, but hubby was not convinced. 1 because he didn't want to "fight" the Canadian immigration system and 2, he wasn't sure if the outcome would be successful especially considering the cost difference between paying a lawyer and reapplying. Well, Consultant introduces us to an Immigration Lawyer. He reviews my documents again and said that I had a "Perfect" application, and so there's no reason for a refusal. Then he went ahead and offered to go ahead without a DIME being paid! If he loses, he goes away empty handed, but if he succeeds, then we pay a certain amount above the initial base amount. Hubby was more confortable with this arrangement. October 29th after many back and forth, we submitted our application for JR. We were meant to get a response exactly 30 days which was to lapse on November 29th. November 29th, Lawyer receives an email from the IRCC lawyers asking for additional 3 days to file their response. And then silence, no further communication or even the expected response. December 19th, I received an email saying there was a notification on my GCKey. I logged on, and saw that the portion that usually shows "refused" had changed to "submitted". Every other member of my family's own still remained "refused". We called lawyer, he said he hasn't heard from them. Now, "success" with regards to our agreement with the Lawyer is when IRCC asks for "settlement". So at this point, it seemed like my application had been reopened without any agreement between my Lawyer and that of IRCC. The wait was unimaginable! January 12 I ordered GCMS and it came back February 12, and in it, it was stated that my application has been reopened because of a JR and my Lawyer has accepted the terms of the settlement! Immediately, we sent the GCMS to him, still he maintained he hadn't heard anything from them. February finished, nothing! March 3rd, Lawyer receives a letter requesting for a settlement on the case and the terms of the settlement. This was the exact same letter in my GCMS notes posted to my portal AS AT DECEMBER 2020! Anyway, we felt at least things are moving small small. March 11, I received a request for additional documents. Really, what was important were new LOA and Financial statements. March 24 uploaded the requested documents. April 10 did up-front medical April 29 Up-front medical passed May 3, review for uploaded documents started. June 16, Correspondence letter and PPR, 2 minutes apart. Hubby and the children's applications were not reopened, we're currently in a dilemma as to whether to reapply for them or right a letter to IRCC. Your kind suggestions would be highly appreciated. A few things to note from my personal experience: 1. The VOs are not as smart or as efficient as we tend to give them credit for. 2. Most times, approvals and refusals are given based more on feelings than clear evidence before them. 3. While I understand that JR is an expensive route, it would be nice if more people do it as it will highlight a lot of the rubbish they do at the embassy. 4. Lastly, let's be considerate to other people about how we boast after getting PPR. Trust me, the things you boast about: perfect SOP, Prayers, Documents etc, there are people who did all that and more and still got refused. In the course of this journey, I also started to pursue a student visa in tbe UK before things started looking up, and believe me, the system with the British is far more transparent than that of Canada. Once you meet the requirements at submission, you are over 80% sure you'll be awarded the visa. But there's a lot of bias and subjectivity with the Canadian embassy. I want to thank every single contributor to this Agile forum for the work you do! I submitted a "Perfect Application" ( according to my Lawyer) thanks to the stuff I got from here. Also, I want to thank @frankrobben for his patience and selflessness here. People drag him all the time, but he never relents in being helpful. I remember the day I wrote about the JR option and his contribution and how he was dragged and insulted. Yet, he and I have never had any direct encounter and the Consultant and Lawyer did not come from him. Well done! I pray everyone gets their prayers answered as well |

However, I would like to ask a few location specific questions since I would be going to Halifax, Nova Scotia. 1. What is the best location to stay with family? 2. Which region within Halifax has the best Elementary and Middle school, as that will likely determine where we'll stay. 3, Are there specific Elementary and Middle schools that can be recommended? 4. Good evening all, My GCMS notes finally came out (unfortunately I can't post here because of personal details intertwined in the final paragraph). I was refused for: Purpose of visit Family ties (I applied with family, but hubby won't be staying with us) However, from the notes, I noticed that an error was made regarding my previous studies, which now made my proposed study not to make sense. I indicated that I have an MBA from school A, the VO noted that I had an MSc Finance from school B, whereas my proposed study was MSc Finance, therefore it wouldn't make sense to be pursuing the same course again. Also, following from above, they felt the amount of money I plan to spend on my family (again using the erroneous previous study) was too much investment to add value to me and may not yield enough to offset the costs in the future. Please, dear experts, how do I address this? Thank you for your anticipated responses |
I would like to say something about this Judicial Review issue. And I'm not making the comment because I might consider it or might not, but because, it is important we analyze issues objectively. This is more so as most of here going to do Post Graduate programs, would need a lot of critical analysis skilss in a lot of different areas of our lives. I agree absolutely, that the cost of a JR is high, infact too high, but to call those who may want to follow that path "irresponsible", shows an "absolute" take on issues rather than being open-minded. It might interest you to note that the cost of a 2-year MBA fees and expenses will cover the POF for more than 2 families under 32 with Masters using the Express Entry program. Therefore, a person who goes to Canada through EE can also say everyone trying to go as students are "irresponsible" considering the cost differential. There are people here whose school fees are less than 10k, while some cost over 40k. Everyone is free to analyse their costs how they deem fit. People generally make their financial decisions based on where they are and their perspectives, which may have little to do with affordability. If I decide to do the JR, it will not be on the basis of "recouping it soon" but on the basis of "it's part of the expenses of schooling in Canada. A visa is never a right, but a privilege, but there's a reason the JR is put in place! It is for "Procedural Fairness". I have seen profiles that were refused here, and I have sincerely wondered if due procedural fairness was followed. Have a good evening everyone! |
Thank you very much for your response. I'm waiting for the GCMS notes as I expect it will throw more light on the issues. However, my hubby is not coming with us, with a decent job here. Doesn't that count as enough family ties or do they think he will leave his job to go and hibernate illegally in Canada? Also, I gave a very detailed plan of what I intend to come and do back in Nigeria. Someone had privately advised me to do Judicial Review, only to come here and see @Frankrobbn1 talk about it. At this rate, the High Commission in Lagos should be given power to conduct interviews and issue visas here rather than throwing us to Nairobi. Good after all, Congratulations first and foremost to everyone who has received positive feedback. I pray everyone will get theirs! So I got a refusal for my SP last week and the reasons were: 1. Purpose of visit 2. Family ties. I'm female and I applied with my children. Hubby was meant to remain here. Interestingly, after so many web notes with them telling me they were working on my profile, I had been rejected since June 30 (I applied June 10). It was after the refusal that my eligibility review was updated and showed June 30. I have requested for my GCMS notes in order to know what they are actually worried about. Now, my questions are: 1. How do I address the "purpose of visit" ( mind you I made a very tight SOP addressing it) 2. If I decide to leave my children out of the second application, will it raise eyebrows? A brief overview of my profile: Chartered Accountant with and MBA Going for a Masters in Finance School fees fully paid Enough money to cover all expenses, even if the children go with me. Good morning @FrankRobbn, Ordinarily, I would have ignored and moved on, but I think it is important qe all get some facts straight. We are all here to learn and share information with one another and sincerely you have done a lot to help people here. However, there's an attitude which you and several others who because of the time you have spent here believe you are now gods, so nobody is allowed to either "think" or "have an opinion" without an attempt to short them down. That I am new to Student Visa thread does not mean I lack the ability to think for myself in every area of my life including applying for study permit. It is tiring that when people make posts all you guys do is look for holes to pick out. Sometimes, just chill and do ypur own findings or move on. That notwithstanding, find attached the proof to the main position you criticized. I am very happy for @ObaniDavid's testimony, and if I were him I won't share a screen shot of the letters, haters and doubters should all go and hug transformer. I maintain: IRCC said they will continue to PROCESS AND REQUEST FOR ADDITIONAL DOCUMENTS, while waiting for applicants to provide them. The only thing is that no final decision will be made or anyone refused on the bases of incomplete documents. A visa officer can process and complete an application with or without Biometrics. You have submitted enough documents to show who you are! Canada only introduced Biometrics barely 2 years ago in 2018. Besides, are you aware that they have given a waiver to Essential Temporary Workers who are unable to give Biometrics in their countries to get it done at their port of entries? What does thay tell you? Visa applications can be processed without Biometrics if IRCC chooses to authorize it. Everything I have written here is verifiable on the CIC website. Your current position is "pre-covid", right now, things are not as rigid as you're trying to make it look. As for your friend, every application is different. Anon123: |
I stand to be corrected though, but from IRCC communications, they will continue working on applications, requesting for documents as the need arises until people are able to provide all the documents. What I can deduce is that people might even get medical requests if they find them eligible while waiting for Biometrics to be done. Hello @Lekiboboe, I had the same issue the whole of yesterday using Gtbank (both savings and current) and FCMB without luck. I eventually used my sister's stanbic (savings) and it worked once.
