HealthRe: 500 Nigerian Nurses Risk Sack In UK Over Fraudulent Registration by N3TRAL:
The article is summarized as follows:

To become a nurse or midwife in the UK you must take Computer based test (CBT) in your country and when you come to the UK, you'll take the practical test.

The regulatory body in UK has noticed that the outcome of the CBT taken in a centre in Nigeria was marred by irregularities and they're presuming that there was general examination malpractice at the Nigerian centre so they're not really sure if those who passed the exams are qualified to practice as nurses in the UK or not.

how did the "the plethora of leniency pleas sent by prominent African individuals and organisations, in the form of letters posted to representatives of the British Government, influence the court in tempering justice with mercy"?

what is the mercy that was tampered in this case?

what was the thrust of those pleas?

At this point we cannot deny that the plethora of leniency pleas sent by prominent African individuals and organisations, in the form of letters posted to representatives of the British Government, influenced the court in tempering justice with mercy.

It's a fair conviction and sentence, especially, due to the fact that the case is the first of its kind in the United Kingdom brought under the Modern Slavery Act of 2015.

The just concluded general elections have exposed the ignorance of "exposed" Nigerians regarding the organisation of society.

The law abhors vacuum. The constitution prohibits a leadership lacuna.

The position of the law is that a candidate who is declared elected by INEC is constitutionally qualified to occupy the office he was elected into until a court of competent jurisdiction declares otherwise.

The timeline set by the law for determination of election petition by the election tribunal is 180 days from the date of filing the petition.

The court has to carefully scrutinize the prayers of the parties and avoid reaching a decision per incuriam . The Labour Party, the PDP and their candidates filed their respective petitions on the last day of the 21 days stipulated by law to avoid mistakes. They made use of their complete 21 days to avoid rush and to present well researched and compelling arguments.

The Tribunal is obliged to deliver judgment after it carefully exhausts its 180 days to avoid error. Don't pressure the court!

Interesting, so basically the northerners are just black Arabs, because not only did they adopt their religion, they adopted their cultures too.
They pay close attention to anything that happens in the Arab world.

For instance, the hate America just like the Arabs and would wish for the destruction of the State of Israel.

Boko Haram, ISWAP are their version of Al Qaeda and ISIS.

They may not be physically Arabs or identify as Arabs but I'll say that they may be classified as Arabs ideologically.

If the northern ancient traditions have been abolished for Sharia, then how do they celebrate their cultures? I mean you can't be an African tribe without an African culture.
The cultural replacement and the gradual fade of indigenous traditions in core Northern Nigerian States may be traced to the 19th Century Jihad of Usman Dan Fodio who was a Fulani Islamic teacher.

He waged wars against the traditional rulers of what would later be defined as Northern Nigeria after the final design of the Nigerian Map. He defeated most of them and established a caliphate with Emirates answerable to the caliphate. The Sultan of Sokoto is the most revered traditional ruler today and he is the head of the Sokoto Caliphate established by Usman Dan Fodio. The Sultan of Sokoto is the custodian of Islam in Northern Nigeria.

If the highest traditional ruler in Northern Nigeria is the custodian of Islam in Northern Nigeria, it therefore follows that Islam is the tradition of Northern Nigeria. Islam is much more than a religion to its adherents. It's a way of life and regulates every aspect of its faithfuls' lives, including how they can drop a deuce or how women should dress. Islam is the most political religion and the depth of politics in Islam has usually been cited to justify islamophobia.

For instance, only your face should be left out of the hijab as a woman in moderate Islam and only your eyes should be seen from your niqab in extreme Islam. Most traditional attire of African tribes barely covers a woman's body and would therefore conflict with the mode of dressing acceptable in Islam.

Note, the jihadists invaded Northern Nigeria before the Britain established its rule over Nigeria.

Umemulo is not a South African ceremony, but it's a Zulu ceremony because we have 10 different tribes here in SA. Even though our languages may be similar, our cultures are different. Even our traditional dance moves are different with each tribe.

In my culture we have what we call Koma, it's for kids as young as 8 to 12... But if you've never participated in the ceremony, you can still go even when you're older because there's no age limit. It's believed that if you've never participated in the ceremony, then you can't get married to someone who has.. You'd have to go to the ceremony first before getting married to the person.

As for my mother, she was just being dramatic and overprotective, what she did has nothing to do with culture.

It seems like you guys always assume that all black South Africans are Zulus,or their cultures are the same as Zulus, I don't know what is it with you guys and the Zulu people... Maybe I should open a thread and list all the South African tribes for you guys.
As an African I understand the diversity that's existent in the artificial nations partitioned and formed by the colonialists. In Nigeria we're more than 250 tribes.

I know that they're a plethora of tribes in South Africa and Zulu seems to be more prominent. If you don't mind, you can proceed with your planned exposition of the diverse cultures in South Africa. I think your country is really unique and I'll tell you a lot about South Africa's uniqueness in subsequent conversations.

Thank you for your detailed response.

Our legal system consists of both Roman Dutch law, English common law, customary law, and religious law.

Roman Dutch law dates back to 1652 when the Dutch first came to SA with the purpose of creating a refreshment station along the cape for passing by ships. The law originates from the Netherlands.

English common law dates back to 1820 when the British first came to SA and this law mostly deals with public law like criminal procedure, the constitution, civil procedure, and etc. The adversarial and inquisitorial systems originate from this law.

Customary law is our indigenous laws of course, they're the laws of our forefathers and we have traditional courts that deal with them, they're referred to as Chiefs courts. The law is recognised by the South African constitution.. What I don't like about this law is that you're found guilty until proven innocent, unlike the other laws whereby you're found innocent until proven guilty... grin grin grin

And with religious laws, everyone has the right to practice their own religion in peace and without criticising other people's religious beliefs. Every religious belief has got a representative in parliament.. We also have church of Satan which was established back in 2019, if I'm not mistaken.. You're welcome to come and join it.. grin grin grin
Wow! Thank you.

Customary law is an integral part of our legal system. In the South we have customary courts , district courts and customary court of Appeal. In the North we have Sharia courts and Sharia court of appeal. Islam is predominant in the Northern region of my country and so their ancient sacred traditions have been abolished for Sharia. The customary court of appeal and Sharia court of appeal are created by the Nigerian constitution.

The customary courts and Sharia courts rank lower in hierarchy to the High Court of a State, Federal High Court or National industrial Court, which are all courts of concurrent jurisdiction. However, the Sharia court of Appeal and the Customary court of Appeal are at the same level of court hierarchy with the three latter courts mentioned in the preceding sentence. There's the Magistrate court that ranks lower than the high court but higher than customary courts.

The Supreme Court is the Apex court of Nigeria and below it is the Court of Appeal.

Our legal system is purely Inquisitorial. The judge, Magistrate or Qadi (Sharia) is regarded as an unbiased umpire.

I think South Africa is more liberated than Nigeria. Your country also has a better human rights record post-apartheid.

I'm pseudo- agnostic but identify as a Christian. I don't mind trying out new things.

I didn't have any seniors being from the first batch of students the school had. However, I must insist that kids are wicked. I was silently shunned by the others. Yes they complimented my art and English writing skills, said I was quiet and almost somewhat cute, but I was extremely criticized and abhorred as a freak, an odd person, a weirdo, a funny person, a caricature, kept out of social circles, someone to be tolerated for the sake of tolerance, etc. The teachers were in on it too, I don't want to go on about how they showed it, it would seem like a movie. Only my art and literature teachers really kinda liked me. Today I don't have any close friend amongst them.

And people don't change, after ten years I was added to the classes group chat and nobody wanted to come near. The ones that came close were snobbish and proud as they had been in secondary school. One or two were nice to me though. In summary, the majority only even added me because they were curious about what happened to me after ten years. After that I was distanced and forgotten again.

One lesson here is don't think your low to somehow middle class kid will thrive simply because you put them in a school of the middle class/rich kids. It can work out the right way, but it can also work out the wrong way, like it did for me.
You'll most likely be diagnosed with a social anxiety disorder if you sought professional care.

It's okay to be different and I love perculiar people like you.

She paid this other family friend who was doing her third year to keep an eye on me and make sure that I don't get out of line and she would every now and then report back to my mother... Me and the woman became close and I thought maybe it was because she's a family friend, but nope, she was on duty.. grin grin

I only got to find out about it during the second semester... grin grin grin
Reading this post and the one before this took my mind to Umemulo. I know it's a South African ceremony. I think Zulu people celebrate it. Does your tribe celebrate it?

Is the special protection by your Mum related to the prestige that comes with the ceremony?

From the videos I have watched the parents seem to be very proud that their female children graduate as "good girls" and kill a cow to celebrate it. Something like that.

Not South African but I'm interested in cultures. Pardon me if I'm disturbing you 🌹.

You get your LLB degree, spend at least two years working as a candidate attorney at a law firm, that's if you want to be an attorney, and write your professional exams from any law society within the country.

But if you want to be an advocate, after obtaining your LLB degree, you'll have to work under another advocate for about one year and then make an application to the high court... You'll then be called to the bar and write your bar exams.
Thank you for your response.

I can't relate with the difference between an Attorney and an Advocate because the labels are alien to the Nigerian legal system. But I guess it's similar to the description of Barristers and Solicitors, and the distinction between them. A Barrister defends clients in court while a Solicitor's legal profession is not built around the Solicitor's appearance in court as a professional litigator.

From your response, it appears as though your legal system has its roots in the British system of legal practitioners specializing as "court lawyers" or not. The Law Society and apprenticeship framework also makes its resemblance with the British legal system apparent. I do not know how much of English Law that your country has received into its legal system due to the prior settlement of Boars.

Until 1962, the procedure for becoming a legal practitioner in Nigeria was similar to that of your country. After 1962, Barristers were no longer differentiated from solicitors.

One's LL.B degree qualifies them to gain admission into the Nigerian Law School for a one year training, officially called Bar Part 2, if they obtained the degree from a Nigerian University. To get the qualifying certificate, an aspirant to the Nigerian Bar must complete 3 sets of dinners, go through a compulsory court and Law Firm externship program and pass the 5 mandatory courses of the Nigerian Law School. With one's Qualifying Certificate from the Nigerian law school, an aspirant is eligible to attend the Call to Bar ceremony , get a certificate of "Call to Bar". The Qualifying Certificate and Call to Bar certificate are the prerequisites to get one's name enrolled in the Supreme Court Roll of Legal Practitioners in Nigeria.

If one gains admission into the Nigerian Law school with an LL.B degree obtained from a foreign university, the aspirant will spend 2 years at the Nigerian Law School for Bar Part 1 program and the Bar Part 2 program already described in the preceding paragraph. Bar Part 1 is to get the foreign LL.B holders acquainted with substantial Nigerian law because the Bar Part 2 program focuses strictly on adjectival/procedural law.

Another question my new friend:

Is the legal system of your country Adversarial or Inquisitorial?
