Such restaurants don't typically play loud music so I'm wondering why they're been cited for noise pollution undecided
This particular one does. They have a grill outside where they make suya and they sometimes play very loud music. Between them, the defunct The Place Nightclub, Lennox Mall and a crazy pop up market that suddenly appears at parking lots in that area, they make an incredible amount of noise. Some of those places play loud music through the middle of the night (from around 10pm till around 4am).

Thankfully LASEPA has now visited every single one of them (apart from the pop up market) and there is peace.

What you are asking for already exists both at the federal and state levels.

Unfortunately I'm in transit at the moment, so I'm going to compose this post entirely from my memory, but I'll provide more information when I get to my destination.

The law that created the Nigerian Environmental Safety Regulatory Agency (NESREA) empowers it to set noise limits. Individuals and organisations must comply with this limit or they will be made to pay fines for every day that they contravene the regulation and they can also be jailed. Unfortunately I can't remember what the limit is.

In Lagos State, LASEPA has set a limit of 55 decibels during the day and 45 decibels at night. I watched an episode of Sunrise Daily (between 2005 and 2009) in which the then commissioner of environment, Dr Muiz Banire talked about noise pollution.

He said that he tested the generator in his home and discovered that he was contravening the law and he had to get it soundproofed. He said that citizens could complain to LASEPA and LASEPA would initially issue a warning to the defaulter to reduce the noise being emitted. Then they will conduct inspections to see if their warning is being complied with and lastly, they will seal the property if the problem continues.

I've posted a long list of example of action taken against churches, mosques, bars, factories, hotels etc. and ways in which you can contact LASEPA. I'll search for them when I get to my destination or you can use the Nairaland search bar and type " Naptu2 Lasepa "

Lasepa has taken action against lots of churches, mosques, music stores, hotels, bars and factories that have been engaged in noise pollution and there are many nairaland threads about those incidents, so I'll encourage you to complain, because the system works.

Politics › LASEPA Shuts Down Olaiya Foods & Bukka Hut In Lekki Phase 1 Over Noise Pollution by naptu2(op): 3:20pm On Oct 24, 2023
LASEPA @LasepaOfficial

As part of its continuous endeavor to tackle Noise Pollution and other environmental violations, the Lagos State Environmental Protection Agency (LASEPA) has taken action by sealing off Olaiya Foods Catering Services and Bukka Hut of Lekki Phase 1 today.

This decision stems from their persistent disregard for environmental regulations and their contribution to noise pollution.

Alright, I understand you. But from the secular posted, they said it was due to environmental reason, that's why I'm baffled because Kingfisher, like I said, is at the back of Marcopolo and as far as I know, the environment is clean and tidy. Nobody dumps any waste in the water at the back of Kingfisher. So I guess it is for LASG to intimate us which enviromental law Kingfisher broke.
OK, let me break it down.

Environmental reasons could mean a lot of things, not just cleanliness. The Lagos State Environmental Protection Agency (LASEPA), which shut down Kingfisher, has shut down more places for things like noise pollution and air pollution than for issues of cleanliness.

The environment encompasses things like air quality, sound (noise pollution), water quality, discharge of harmful chemicals, etc.

Bro, KibgFisher is at the back of Marcopolo. They are in the same compound. So I find it ridiculous that the LASG can seal KingFisher and not seal Marcopolo also.
The issue is why was Kingfisher sealed? Nobody has provided an answer to that.

Of course KingFisher can be sealed and Marcopolo won't be sealed if KingFisher breaks the law and Marcopolo doesn't. It doesn't matter if they are in the same compound.

If KingFisher makes loud noise (that makes residents complain) and Marcopolo doesn't, then KingFisher will be sealed and Marcopolo won't. Why should Marcopolo suffer because of something that it didn't do? Similarly, if KingFisher disposes of its waste improperly and Marcopolo doesn't, then Kingfisher will be sealed and Marcopolo won't be sealed.

Remember, Marcopolo can sue the government if they are wrongly sealed.

So it doesn't matter if they are in the same compound.

But all these are just speculations. We need to know why Kingfisher was sealed before we can make any conclusions. I prefer to deal with facts, not speculations.
