Clearly the rejected law was passed in June and rejected in July.

The current law was passed in July and transmitted to the presidency in August.

Joshua Dariye of Plateau state comes to mind... He was impeached by only 6 out of 24 lawmakers in Plateau State under heavy security protection.

The problem is, when you get impeached, you go to court. Next thing you’re suspended as a senator by the same cabal that impeached you. The court case will be long because the same cabal will try to stall it, God help you if you have a compromised judiciary. By the time this process goes on and on, your influence in the senate has worn out, money changes hands, loyalty switches, deals are made and some of your colleagues will compromise with the new leadership and move on

The portion of the constitution is ambiguous because it did not says 2/3 majority OF ALL the members of that house and neither did it say 2/3 majority OF THE ENTIRE members of that house.

Saraki knows this and that is why he is jittery.

He only needs to be removed by a number greater than half of the total number of the senate since the constitution omits words like ALL and ENTIRE.

Once a number like 55 and above senators gather , that number has a quorum formed in it which is supposed to be 1/3 of the number of senators in the house which is 36 and all that is required is 2/3 votes from the 55 present to impeach him.

Until that portion of the constitution is amended, it will remain ambiguous and saraki can be removed based on that ambiguity and he can argue the rest in court but the deed would already be done

This is a pure lie. It does not matter how many times you repeat it. It is not true. The Courts have also pronounced on this issue so there are precedents!

The number of the members of the Senate from 2015 - 2019 is a CONSTANT. It is 109. It is not a VARIABLE. This number can not possibly change from Monday to Tuesday depending on the numbers present because of the wide ranging implications.


More than 2/3 of the Senate is 73 at least and that is what you need to impeach the Senate President.

At least 1/3 of the Senate is 36 at least and that is what you need to form a quorum.

This is the law

It is amazing the number of Senators are clear to you lot when you discuss forming a quorum but becomes ambiguous when you want to talk about impeachment. Why are you not arguing that you only need 1/3 of the numbers present to form a quorum?

The essence of the section of the law is to ensure stability in the case of 2/3 and to ensure views expressed are for the collective good at all times in the case of forming a quorum.

those suggesting that 2/3 of 1/3 can impeach the Senate President are saying even 24 persons can impeach the Senate President in a 109 Senate. This is not the law nor the intention of the law.

Adams Oshiomole knows this and simply wants to engage in impunity. But what is on display here is the fragility of our democracy.

when the Senate come back from Recess I think Saraki should be brave and put this issue live on TV. Let Pro and Anti Saraki Lawmakers make their arguments live on TV and let us see if Nigeria does not have up to 40 good men/women to stand up to this kind of nonsense.

Once again here is the constitution. The court should be the interpreter not your uncle Bukola. Simple majority is more than half and 2/3 majority is exactly what it states but there is no mention of ALL senators just like there was none in simple majority that gave saraki the senate presidency.

At Channels TV Sunrise Daily today, 2 grown up lawmakers, true patriots stood by the rules and constitution of the country and lectured everyone to stop heating up the polity for no reason.

The PDP guy made it quite clear that Saraki can not just wake up and declare Akpabio's seat vacant because there is a laid down procedure which must be followed.

The APC guy made it clear that anybody from any party whether majority or minority can be Senate President. and alluded to 73 members required to impeach Saraki. He hope Oshiomole has the magic wand to produce the required 73.

The primitivity in Nigeria politics must stop. Just take a look at Oshiomole in this video he spent more than 38 minutes talking about Saraki when we have all kinds of challenges to address together as a Nation. Insecurity, bad economy, unemployment none of these mattered to Oshiomole rather he is devoting all his time on Saraki. The FG is also doing the same thing. People are getting killed in Benue and the North East while hundreds of DSS operatives are deployed against civilians in the NASS.

This lack of civility must stop. The Senate leadership should fix a date and time clear to everyone and announced with at least 1 week notice so that all Senators can be present. Preferably when the NASS planned recess is over because I don't consider Saraki's leadership of the Senate a National emergency.

When all living Senators are present, let there be an up or down vote on Saraki impeachment live on TV. If APC can Produce 73 then Saraki goes.

This is how a civilised/democratic Nation should operate. This madness must stop!
