A Senior Advocate of Nigeria (SAN), Femi Falana, on Saturday said the era of absolute immunity had gone and that President Muhammadu Buhari, his deputy, Yemi Osinbajo and governors who committed criminal act could be arrested while in office and taken for trials.
Mr. Falana said this while speaking on: “Limit of executive immunity” in Benin to mark the 60th birthday of the Secretary to the State Government (SSG) of Edo, Prof. Julius Ihonvebere.
Mr. Falana said that immunity did not also extend to electoral fraud.
Mr. Falana said according to a Supreme Court ruling, there was no longer absolute immunity. Therefore governors involved in criminal charges, including the leadership of the National Assembly must face the law.
Mr. Falana had earlier in an article published by PREMIUM TIMES on June 22 quoted the Supreme Court as ruling in Chief Gani Fawehinmi vs. Inspector General of Police (2002) 23 WRN 1:
“That a person protected under section 308 of the 1999 Constitution, going by its provisions, can be investigated by the police for an alleged crime or offence is, in my view, beyond dispute. To hold otherwise is to create a monstrous situation whose manifestation may not be fully appreciated until illustrated… The evidence may be useful for impeachment purposes if the House of Assembly may have need of it. It may no doubt be used for prosecution of the said incumbent Governor after he has left office. But to do nothing under the pretext that a Governor cannot be investigated is a disservice to the society.”
He urged the Senate President, Bukola Saraki and his Deputy, Ike Ekweremadu, to face the forgery charges against them rather than politicking about it, saying “they have no immunity to dodge the charges against them.’’
He faulted the invitation extended to the Attorney General of the Federation, Abubakar Malami, by the leadership of the senate over the forgery allegation against the senate president and his deputy.
“The senate is now politicising the issue, saying it is political victimization but not that the offence was not committed.
“As leaders of the National Assembly, you are supposed to be above board and that is even the more reason you must be careful.
“But I want to remind the senate that the Attorney General of the Federation is only answerable to his boss, who is the president and nobody else.
“The same thing applies to the states, so there is no longer absolute immunity in this country.
“And that is why what is happening in Ekiti today about money found in a bank and the governor is saying it is illegal to freeze his account that is not true.
“Any issue that is criminal in nature must be treated as such,” he declared.
Mr. Falana however described Mr. Ihonvbere as a resourceful Nigerian, who fought doggedly for the nation’s democracy.
Governor Adams Oshiomhole; the Minister of Niger Delta Affairs, Usani Uguru; Speaker of the state House of Assembly, Elizabeth Ativie and other members of the State Executive Council were present at the occasion.

Abuja - The Supreme Court on Friday affirmed the appointment of Oba Mufutau Gbadamosi, Okikiola Esuwoye II, as the Olofa of Offa in Kwara.
Justice Walter Onnoghen delivered the unanimous judgment of the five justices, Olabode Rhodes-Vivour, Nwali Ngwuta, Mary Peter-Odili and Amiru Sanusi.
In his lead judgment, Onnoghen held that the appointment by the Kwara Government was in line with the customs and tradition of the people of Offa.
Onnoghen held that Anilelerin is the only authentic ruling house that could ascend the thrown of Olofa, adding that the Olugbense ruling house had no historical backing.
``From the history, customs and tradition of the people of Offa, it is clear that Anilelerin ruling house, is the authentic and only ruling house backed by native law and authority that can ascend the thrown of Olofa.’’
He also dismissed the principle of rotation of the kingship in Offa land.
``If there is rotation as claimed by the Olugbense family, the principle will have started before the ascension of the immediate past Olofa, Oba Mustapha Olanipekun.
``This court also found, as a fact, that there is no rotational policy in existence as far as the stool of Olofa of Offa is concerned.
``The claim of the Olugbense family has no historical backing and therefore, the claim of the appellant, through a counter claim on the issue, succeed and is hereby affirmed.’’
The court also held that the ascension to the throne is by election and not by rotation as claimed by the Olugbense family.
He also declared the state government Gazette of 1970, which recognised Olugbense ruling house was null and void because it was contrary to the customs and tradition of the people of Offa.
The apex court also set aside the judgments secured by the plaintiffs at the state High Court and the Court of Appeal Division in Ilorin.
The court, however, expressed the hope that the customs and traditions of the people being dynamic was subject to changes depending on the practices of people concern at the particular time.
``It is hoped that in due course Offa people, particularly the ruling house will see need and reasons to effect necessary changes to enable Olugbense descendants ascend the stool ones again.’’
The court encouraged the people to talk things over and find a peaceful solution to the problem and advice the state government accordingly.
Alhaji Saka Adeyemo, Abdulrauf Adegboyega Keji and Saka Keji of Olugbense family had challenged the appointment of Gbadamosi as Esuwoye II.
They contended that the appointment contravened Section 3(3) of Kwara State Government Edict
on appointment of and deposition Chief's law of 1970.
The claimants had said that the law made provision for rotation between their family and the Anilelerin family.
In their originating summons argued on their behalf by Mr John Olusola Baiyashea (SAN), the plaintiffs claimed that it was their turn to produce the Olofa in line with the principle of rotation.

An Economic and Financial Crimes Commission (EFCC) witness, Michael Wetcast, on Wednesday told the Code of Conduct Tribunal that Sentate President, Bukola Saraki, authorised the transfer of $ 3.4 million to his account with the America Express Bank in New York, United States of America.
The Senate president was arraigned by the EFCC on a 13-count charge bordering on allegations of false asset declaration and money laundering at the Code of Conduct Tribunal.
He had earlier pleaded not guilty to the charges.
At the resumed hearing of the case, Mr. Wetcast, led in evidence by EFCC counsel, Rotimi Jacobs, said the defendant directed GTBank to transfer the funds to America Express Services, Europe Limited.
He said the money was later forwarded to Saraki’s bank account at America Express Bank in New York with registration number 730580 on August 25, 2008.
The witness said on November 5, 2005, that $20,000 was lodged into Mr. Saraki’s GTB account at GRA Ilorin branch by one Bayo Dare and Abdul Adama.
The defence lawyer, Paul Usoro, did not object to the admissibility of the bank documents, but he reserves his arguments till a later date.

Dnt return the money. Bank will not contact you when a wrong posting occured on your line. They go straight to debit the account. This is a scam and foul play.

Why were you told to return it to union bank? is union and first bank the same? moreover the acct name dnt look any similar.

MARRIAGE IN ISLAMIC SHARIA

Woman has the right to accept or reject marriage proposals. Her consent is a prerequisite to the validity of the marital contract, according to the Prophet’s teaching. It follows that if an "arranged marriage" means the marrying of a female without her consent, then such a marriage may be annulled if the female so wishes:

Ibn Abbas reported that a girl came to the Messenger of Allah, and she reported that her father had forced her to marry without her consent. The Messenger of God gave her the choice...(between accepting the marriage or invalidating it) (Ahmad, Hadith no. 2469). another version of the report states that “the girl said: ‘Actually, I accept this marriage, but I wanted to let women know that parents have no right to force a husband on them.’” (Ibn-Majah).

The Muslim scholar, Dr. Bilal Philips had to say the following about Chilad marriage in a recent interview:

The concept of child marriage, of course in Islam, if a person classified as a child is married, when they reached the age of puberty and maturity, then they have a right to choose whether to go on with that marriage or not. So it becomes a marriage on paper. You know, they take place on paper on agreements with families; it is not going to be done again between individuals where the possibility of exploitation is, you know, more prevalent; but once the person reaches of age, it could be between two young people or could be a younger person and an older person, you know, either way male-female, female-male and when they reach that age of puberty then the decision is theirs. I know there has been something in the newspaper quite recently also, you know, concerning there is a girl in some place in the States who is about 13 years old got married, you know; it was a big thing to do that , particularly in the States; that State doesn't have clear laws prohibiting it. So there was a big uproar about it, you know. But it had been going on for quiet a long time … in the previous century the nineteenth, eighteenth … this is something not uncommon. The desire to want to protect young people is a genuine desire; but where, you know, families are involved, people are not being forced etc, then this is not something which should be looked at in the negative light. But before we go on to another issue, there is another point that I think is important, to touch on in the arranged marriage setup. Why it is that the West is so much opposed to this and that would … I think this is an important point because if it was common in the West before but now it is looked at so negatively there must be some factor and I think this is what we need to address that really from a Western point of view because the families are broken up to such a degree that individuals are now on their own - a young woman leaves her home, she reaches her mid teens or whatever, she has to go out on her own and fend for herself. The idea of parents coming after that by telling who's good for you to marry this one or that one, it becomes ludicrous because she is now on her own taking care of herself. Why would anybody now want to come and tell her whom she should marry or would be good for her to marry. This is something totally in her own hands. Similarly with the young man : no suggestions, why suggestions because he is taking care of himself and so it is in this context that the idea of an arranged marriage may seem so unnatural whereas in the context where families are intact, you know, and children remain in the home until, you know, they reach the point of marriage and then they leave the home, then, it is not unreasonable or not, you know, it should not seem strange and it doesn't to those people to marry on this basis.
Al-Azhar Al-Sharif, the highest religious body in the Sunni world, has recently released a new manual on the rights of Muslim children.

"Marriage in Islam is regulated by certain rules, namely, children must reach puberty and maturity so that they can get married," it reads.

So people should stop campaigning that underage is been taken as a wife. Thank you
