Eagba:Hi, I'm not sure I understand your question fully. On what grounds would the tenant /3rd party even be able to sue if there was "due notice" as you say? If it's about the forceful eviction then the landlord really should not forcefully evict a tenant whose rent has expired and has been given the correct notice, he should use the machinery of the courts to evict the tenant and not take laws into his own hands. That would be self help and in such a case, the tenant should be able to sue for the appropriate reliefs regardless of any "no contest" agreement you may have signed. This is because you have a constitutional right to seek redress for wrongs done to you which overrides any other law, you are also entitled to approach the courts for the protection of your fundamental human rights. A preliminary point to note is that it is actually during the lifetime of a tenancy that a landlord should issue a Notice to Quit so that the notice expires at the same time as the tenancy and you do not stay beyond the end of the tenancy. Landlord must not wait until tenancy ends to issue quit notice Your first port of call should be your lease agreement, that is what governs the length of notice required. Where the Lease Agreement is silent on the issue, then you can fall back and have recourse to the provisions of the law on length of notice. The rule is if you are a yearly tenant (i.e you pay your rent on a yearly basis and not weekly or monthly for example), then you are entitled to six months notice which is to expire on the eve of the end of the tenancy) for example, if you pay your rent yearly on January 1 of every year, your 6 months notice must be such that the 6 month period ends on December 31 of that year. In your own case currently, if there is nothing different in your lease agreement on length of notice, I will say that your landlord has not issued you with the proper 6 months notice as required by law. What he has actually issued is 5 months notice and same does not even expire on the eve of the anniversary of the tenancy as stipulated by law. As your tenancy expires August 31, he should have given a Notice that will lapse on August 30 and must be 6 months in length, in other words, he should have issued it no later than February 28, anything after that is not up to 6 months notice. This being said, my humble advice is for you to start looking for alternative accommodation as even if you are able to successfully challenge this notice and stay beyond the date given, once your tenancy expires, you will still be liable to pay the landlord on a pro rated basis, for however long you stayed extra in the property. So to avoid issues you may start looking. However, the choice is entirely yours, seek advice from a good lawyer and do you, all the best. I y |
Its so sad that 4 years later, in 2019, we're still being faced with such uninspiring choices for the highest office in the land. I remember in 2015 it was "a choice between a former dictator or a failed president" and I recall asking rhetorically, "what if the former dictator is also a failed head of state?". Sadly Nigerians went for the former dictator and we can all see how that's turned out. For the record, I DO NOT believe for one second that there is any Jubril or whatever his name is in Aso Rock and I know its the same Buhari elected in 2015 who currently resides there. However, the Prof seemed a bit too eager to display his qualifications and his knowledge of the subject and quite unlike a PhD holder, was too impatient to analyse the stories and tailor an appropriate response. Perhaps the routine misuse of words by many Nigerians is also a bit to blame here. What I've always heard re the Jubril story is that he's an impostor from Sudan who's undergone extensive surgery and tutoring to look, talk and act like Buhari (again I am not saying this is true). However, cloning if I am correct has to do with using a living thing's DNA to create an exact replica of the original. This is where Prof Boroffice's thesis would have been very apt as the clone would require a normal growth and development pattern to reach adulthood. Nnamdi Kanu and the peddlers of the Jubril story have never said (as far as I know) that Buhari's DNA was used to clone Jubril, rather, Jubril was supposedly found and altered physically to look and act like Buhari. |

The operative part of the NYSC Act simply states that "with effect from 1st August, 1985, a person shall not be called upon to serve in the service corps if; at the date of his graduation or obtaining his diploma or other professional qualification -he is over the age of thirty...". For those like Ali Baba who cannot comprehend, the important point is at the time of graduation or obtaining his diploma or other professional qualification. Thus, if you are below 30 years old at that time, whenever you decide to work in Nigeria (even if your are 70 years old then) you are required to serve. Oga Alibaba, nobody said she claimed to have served, she had also not "clearly passed the age to serve" as you erroneously state because she graduated at 22 by her own admission. All the other categories of people you refer to would be liable to prosecution if found guilty, by all means prosecute them if you are able to, this fact does not take anything away from Kemi Adeosun's guilt.
