The supreme court has held that Kashim Shettima, vice president-elect, is not guilty of double nomination as alleged by the Peoples Democratic Party (PDP).

A five-member panel of the supreme court said this on Tuesday — while delivering judgment in an appeal filed by the PDP seeking to void the election of Shettima and President-elect Bola Tinubu on the grounds of double nomination.

The opposition party claimed that Shettima was still the APC’s candidate for Borno central senatorial district on July 14 when he accepted the nomination for vice-presidential candidate.

According to the appellants, Shettima dropped his senatorial nomination on July 15.

“Facts is that the fourth respondent who had earlier been nominated by his party as a senatorial candidate was given another option or imperative to be the party’s vice presidential candidate. He accepted the second option with a mindset intention and action to relish the first nomination as senatorial candidate,” Emmanuel Agim, supreme court judge, said.

“The party nominated another person to replace him. His prompt and diligent withdrawal as senatorial candidate demonstrates plainly that he had no intentions designed or plans to hold two nominations…the fact that he withdrew after being nominated as vice president is of no mention.

“Multiple nominations with the electoral act does not occur simply because he accepted a second nomination, the fact that the acceptance was immediately relinquished so as to pave way for another person to replace him as senatorial candidate cannot be overlooked or disregarded.

“We have to be very careful the way we read provisions of facts particularly when they are public interest issues and for presidential requirements where it is broad knowledge where it is very clear that the purpose of the statutory provision is to avoid a situation where the person holds two nominations to have an election as a candidate either in two constituencies or political parties.

“The purpose of that provision is to avoid the situation but where a person has clearly said ‘no I don’t want’, and relinquishes one, I do not think it will be acting in good faith to jump on him and infer something else.

“Above all, there was no double nomination. So it is very wrong to contend that the vice-presidential candidate had a double nomination.”

Senior Advocate of Nigeria Kenneth Ahia, has posited that the judgement obtained from a federal High Court in Kano which purportedly nullified the election of Abia State Governor-Elect Dr Alex Chioma Otti OFR, can not stop the inauguration of Otti as governor of Abia State come 29th May 2023.

The Court in Suit No FHC/KN/CS/107/2023 filed by Mr Ibrahim Haruna Ibrahim against the Labour Party and the Independent National Electoral Commission, INEC, ruled that the failure of the Labour Party to submit its membership register to the INEC within 30 days before their primaries renders the process invalid.

But in a swift reaction, Kenneth Ahia SAN stated 7 points why the federal high court decision in Kano does not have effect and can not stop the inauguration of Abia State Governor-Elect Dr. Alex Chioma Otti OFR.

They are;

1. Section 77 does not provide any punishment for any party that does not comply. Consequently, a court cannot impose any punishment.

2. It is a pre-election matter and under Section 285(14)(a), it must be brought by an aspirant, otherwise no locus standi.

3. By Section 285 (9), it must be filed within 14 days of the occurrence of the event. In other words, the suit must have been filed within 14 days of the failure of the party to submit the register.

4. Like earlier stated, the FHC in Kano does not have the jurisdiction over Abia State.


5. Dr Alex Otti was not a party to the suit in Kano. It is therefore laughable that the court will make an order specifically targeting him.

6. Alex Otti became the Governorship Candidate of Labour Party on 09 June 2022, then any pre-election litigation questioning his candidacy must have been commenced not later than 14 days from 09 June 2022— meaning the case must be filed not later than 23 June 2022

7. Any case filed not later than 23 June 2022 must be determined not later than 180 days from the date of filing. Assuming it was filed on 23 June of 2022, the 180-day timeline terminated on 20 December 2022.

The legal luminary went further to explain that the federal high court judge in Kano, expressly refused no nullify the elections of the Labour Party candidates in Abia, stating that the candidates were not party to the suit.

A former National Chairman of the All Progressives Congress, Adams Oshiomhole, has said that one of the presidential candidates in the just concluded presidential election, Atiku Abubakar of the Peoples Democratic Party and the Labour Party, Peter Obi respectively, is lying in their claims to have won Saturday’s poll.

The PUNCH reports that the PDP and the LP have rejected the declaration by the Independent National Electoral Commission that Bola Tinubu of the APC won the presidential election.

Also, Atiku and Obi during separate press conferences claimed to have won the elections.

However, the former Edo State governor while speaking on Channels Television’s Politics Today on Thursday said Atiku and Obi were accusing themselves of rigging each other out.

Oshiomhole said, “Between His Excellency, Peter Obi, my very good friend and His Excellency, Atiku Abubakar, one of them must be lying. That is clear by the fact that Atiku who came second said he won, Obi who came third said no he is the one who won.

“So, between the two of them, they must be trying to rig each other out, so one of them must be lying and when they go to court I am sure that is one thing that will be showing when you have two people claiming victory. So, they are indirectly accusing one another of rigging each other out even for the second position.”

The APC chieftain maintained that the presidential election was credible and Tinubu was the only contestant that lost his state, adding that even sitting governors in the APC lost senatorial bids in their states.

Mr Onyekachi Nwebonyi of the All Progressives Congress (APC) has emerged victorious in Saturday’s election to represent Ebonyi North Senatorial District in the Senate.

The Returning Officer, Mr Nwogo Obasi announced the result at the INEC office in Abakaliki Local Government Area on Sunday.

Obasi said Nwebonyi defeated Senator Sam Egwu, the first civilian Governor of Ebonyi State, who was seeking the position for the third term.

Nwebonyi of the APC scored 65,863 votes to win, while his closest opponent, Mr Ejiofor Chukwu of the Labour Party scored 42,283 votes to emerge second.

“Egwu, who came third got 26,569 votes.

Similarly in the district, Mr Nwachukwu Eze of APC defeated his Labour Party and PDP opponents to win the Ebonyi/Ohaukwu Federal Constituency seat.

“Eze scored 22, 794 votes to beat his closest challenger, Mr Ndubuisi Agbo of the Labour Party, who polled 14,168 votes.

“The candidate of the PDP, Mr Victor Aleke has 11,611 votes and came third,” the Returning Officer declared.

In his reaction, Eze commended his constituents for giving him their mandate to represent them.

“The election has shown that there is a future for Nigeria. This election in my constituency has been adjudged the most peaceful and fair since the return of democracy,” NAN quoted him as saying.

The governor lost to his All Progressives Congress (APC) counterpart in the district, David Jimkuta.

He is the candidate of the Peoples Democratic Party (PDP) in the district.

Channels Television reports that the APC candidate polled 85,415 to defeat Governor who raked in 45,708 votes. The candidate of the Social Democratic Party (SDP), Michael Magaji came third with 4,133.

The International Monetary Fund (IMF) has advised the Central Bank of Nigeria (CBN) to extend the February 10 deadline for the use of old naira notes if the difficulties in getting new notes persist.

“In light of hardships caused by disruptions to trade and payments due to the shortage of new bank notes available to the public, in spite of measures introduced by the CBN to mitigate the challenges in the banknote swap process, the IMF encourages the CBN to consider extending the deadline, should problems persist in the next few days leading up to the February 10, 2023 deadline,” the statement reads.

The Benue State Governor, Samuel Ortom, late hours of Sunday called the bluff of the presidential candidate of the Peoples Democratic Party, Atiku Abubakar, saying, “to hell with Atiku”.

The governor made the statement when he hosted his colleagues from Rivers, Oyo, Abia and Enugu States to a dinner party held at the government house, Makurdi.

The four governors, Nyesom Wike of Rivers State, Okezie Ikpeazu of Abia State, Seyi Makinde of Oyo and Ifeanyi Ugwuanyi of Enugu State, had arrived in Makurdi on Sunday for the official flag-off of the PDP governorship and parliamentary campaign scheduled for Monday.

They are expected to inaugurate some projects in the state before the campaign.

Ortom said he would not support Atiku’s presidential bid to continue the killing of Benue people.

The governor lamented the killing of 18 persons in his council area last Friday where a young man in his 20s had his eyes removed to send a message to him.

He said, “To hell with Atiku and anyone supporting him. They should go and tell him. You want me to be slave for a Fulani. It’s better I die. Anybody supporting Atiku is an enemy of Benue.

My people are being killed and you want me to be quiet.

“My tenure ends in May and you can do whatever you want if you think you have the powers. I have written my will. When I gave it to my wife, she cried all night. If I die at 62, many of my mates have gone long time ago and If I die today, I’m a fulfilled person but let it be recorded that I died resisting the invasion and killing of my people.

“I will never support a Fulani man to become president. If there is another person who is ready to work with me and ensure the security of my people, I will work with him,” Ortom said.

The governor appreciated God for journey mercies granted to his colleagues from their various destinations to Benue State and described them as true friends of Benue people.

He said Wike held a title as the Eagle of Tiv land, noting that when he, Ortom, was attacked, Wike was the first person who roared, saying that kill Ortom and you have killed the whole Nigeria.
He did not keep quiet when Benue was under siege, he visited with stakeholders from Rivers State and committed N250 million and subsequently he has committed over N700 million to Benue IDPs.”

Ortom condemned some Benue sons, particularly those at the National Assembly, who, according to him, are keeping mute over the killings going on in the state, saying, “From tomorrow, I’m turning my venom on the National Assembly members from the state who are romancing with Buhari to kill the Benue people.”

He stated that as the state launches the campaign, it is his belief that the PDP will win the 2023 elections.

“As we trust in him, 2023, if the elections will hold, we are good to go and by the grace of God we will win. Benue is PDP and PDP is Benue State,” he said.

He warned those who may have planned to come to Benue to rig elections to shelve such plans because, “If you come here to rig any election, we are not going to accept it.”

Speaking on behalf of the G-5 governors, Rivers State Governor, Nyesom Wike, said they were out to save the country from the present condition of total collapse.

“The G-5 are the integrity governors and anyone can challenge us. We have come to give Governor Samuel Ortom solidarity support for the flag-off of campaigns in Benue and to tell Benue people that we are with Governor Ortom. Like us or hate us, we are with Ortom. You cannot break us. We are bonded together.

“Leadership is risk-taking. Whether you like him or not, Ortom has shown leadership,” and he called on the people to support him all the way.

He further reiterated his call on the National Chairman of the PDP, Dr Iyorchia Ayu, to respect agreements that he would resign if the presidential candidate of the party came from the north.

Nyesom Wike, governor of Rivers, says the children of Iyorchia Ayu, national chairman of the Peoples Democratic Party (PDP), will disown him if what he has done in the party is revealed.

Wike spoke on Friday in a media chat in Port Harcourt, the capital of Rivers state.

The Rivers governor, who has been at the centre of the demand for Ayu’s removal from office, also alleged that the PDP national chairman received N100 million bribe from a sitting governor.

“In fact, let me also tell you, Ayu collected N100 million from a governor,” Wike said.

“If not for the love of this party, if we release what we have, Ayu’s children will go to him and say we are no longer your children.”

Benue Governor Samuel Ortom has said report he has broken political ties with Rivers Governor Nyesom Wike is false and misleading.

Speaking to journalists on Tuesday shortly after presiding over the Benue North-West Senatorial district PDP caucus meeting at the Benue Peoples House, Makurdi, Ortom insisted he stands with Wike on the injustices meted out on him.

According to him: “The report is misleading. I just came back from London this morning with Wike and I still maintain my stand on what I said. I have not moved away from there.

“I still sympathize with Wike for the injustices meted out on him and our group.”

The Governor added: “The party leadership has not been fair to Governor Wike based on the activities that took place during the convention and after the convention.

“They have not been able to adequately deploy the internal conflict resolution mechanism of the party to resolve those issues.

“I still sympathise and stand with Wike and let the leadership of the party at the national level do the right thing. It is not too late to do so.

“Politics is about interest and where your interest is not protected, you have the right to protest.


“We remain committed to the PDP but still want the right thing to be done, so that everybody will be carried along.”

While noting that it is not late to resolve the issues, Ortom further pointed out that with the interface he had with the Board of Trustees (BOT) of the party, he hopes that issues will be properly addressed.

“The issue in contention about the national Chairman, the BOT, was here some few days ago and we deliberated on the matter. They sought to know what my feeling was about the crisis and I told them the truth as far I am concerned.

“I gave them my recommendations and I hope that justice will be done so that our party will gain its position to take over power in 2023,” he said.

The Governor maintained that despite the crisis rocking the party at the national level, Benue does not have any problem, stressing that “from bottom to top, we are good to go, as far as our party is concerned. I am working for our candidates.”

Ortom insisted that he cannot work against PDP but he will support every candidate, emphasising “that does not mean I am not aggrieved, Wike is aggrieved and I am aggrieved too.”

On the outcome of the caucus meeting, the Governor said after due consultations, a Benue North-West Senatorial campaign team for the Senate seat will be constituted, pointing out that it will be integrated into the main campaign council of PDP in Benue State.

Governor of Rivers State, Nyesom Wike, has given reasons why he thinks the presidential candidate of the Peoples Democratic (PDP), Atiku Abubakar, can’t be trusted in next year’s election.

Wike, in a media chat televised live on Channels Television, said Atiku made three promises which he has reneged in all.

He said immediately after the presidential primary of the PDP, Atiku visited him in his home in Abuja and said: “Ayu mus.t go.” Wike claimed that Atiku gave him the assurance on the ground that the north can’t produce the presidential candidate of the PDP and also retain the national chairmanship position.Wike also claimed that Atiku was the first person that broached the idea of making him his running mate.

Wike added that at their meeting with the PDP presidential candidate recently in London, Atiku told them that he had confronted Iyiorchia Ayu if he indeed said he would resign should the north produce the presidential candidate of the PDP. He said Ayu confirmed that he made the pledge. He said Atiku assured them that Ayu would resign within a week. He said Atiku has not kept that promise.

Wike also slammed the PDP’s national chairman, Iyorchia Ayu, claiming he is very corrupt.He alleged that Ayu collected millions in naira from some stakeholders of the party in Lagos on the pretext that governors of the party were not willing to fund the party. He said the money didn’t enter the account of the PDP.

Wike also alleged that a former minister of police affairs, Maina Waziri, was one of the arrowheads misleading Atiku. He said Maina Waziri lacks electoral value because PDP has never won his state, Yobe.

When asked what he would do if the party refuses to yield to his demand that ‘Ayu must go,’ Wike said “when we get to the bridge, we will know what to do.”He was further asked if he would direct his people not to vote the PDP in the presidential election, he responded: “don’t put words in my mouth.”

But he insinuated that his people might vote the PDP in other elections apart from the president.

Nyesom Wike, governor of Rivers, says Iyorchia Ayu, national chairman of the Peoples Democratic Party (PDP), may cause the party to lose the 2023 presidential election.

The governor said this on Thursday while reacting to recent remarks made by Ayu on calls for his resignation.

While speaking in an interview with BBC Hausa on Wednesday, Ayu said those demanding his resignation are children.

“When we started the PDP journey, we did not see these children. They are children who do not know why we established this party,” he had said.

“We will not allow one person to come and destroy our party.”

TheCable had reported how Wike’s allies demanded that the PDP national chairman should step down — as a precondition for resolving the rift with Atiku Abubakar, the party’s presidential candidate.

Some members of the party’s national working committee national (NWC) are also said to be pushing for a probe of the party’s finances under Ayu’s watch.

Speaking on Thursday at the inauguration of roads in Ikwerre LGA of the state, Wike said those who Ayu described as children brought him from nothing to be chairman of the party.

He said if Ayu remains arrogant and refuses to resign, it may cost the PDP the 2023 presidential election.

“You can imagine what power can do. You can imagine how ingratitude — how people can be ingrates in their lives,” Wike said.

“I thought as a chairman of a party who wants to win elections, your business is to bring peace to your party; your business is not to divide your party. Your business is not to show arrogance to your party.

“Yes, the children brought you to be chairman of the party. The children brought you from the gutter to make you chairman.

“Ayu, you were impeached as senate president. Ayu, you were sacked by Obasanjo in his administration. Arrogance cannot take you anywhere.

“Now, we have seen that you don’t want the party to win the election. We will help you.

“These children — these people you call boys — brought you from nothing.”

Wike alleged that Ayu doesn’t want to resign because of the billions of naira in the PDP coffers which were made from the sale of forms during the party’s primary elections.

Governor of Rivers State, Nyesom Wike, on Tuesday, took a swipe at an unnamed ‘rapist’ and member of the Peoples Democratic Party who was present at an event in Kano State on Monday to receive the Senator representing Kano Central, Ibrahim Shekarau, from the New Nigeria Peoples Party.

Wike spoke on Tuesday at the commissioning of the Ogbunabali Sandfilled Area in Port Harcourt, the state capital.

Channels Television had reported that Shekarau in May left the All Progressives Congress after a fallout with Governor Abdullahi Ganduje. Shekarau joined the NNPP but barely three months later, he dumped the party after a fallout with its presidential candidate, Rabiu Kwankwaso; and returned to the PDP where he was a member in 2014.

Shekarau was on Monday readmitted into the PDP at an elaborate event in Kano attended by the party’s bigwigs including the PDP presidential candidate, Atiku Abubakar; PDP national chairman, Iyorchia Ayu; the party’s Board of Trustees chairman, Walid Jibrin; former Jigawa State governor, Sule Lamido, amongst others.

Commenting on the event, Wike, who was not at the homecoming of Shekarau in Kano said, “I was watching television yesterday (Monday) when they went to Kano to receive Shekarau. I saw one rapist from Rivers State sitting at the back where he went to join them to receive Shekarau but I asked him; ‘How many people have you made to join your party in your state?’

“You have gone to receive somebody somewhere but you have not made efforts to receive other people to join your own party in your state. You like when food is ready, you’ll go but for you to cook, it is where people have cooked that you go to eat the food but you won’t cook your own,” he said.

“As people who want the party to win or who want their candidate to win the election, what role are you playing in your state to make sure your party wins the election? How many people have you been able to galvanise, mobilise them for them to leave their party to join your party? That is to show you are committed, willing and ready to make your party win an election.”

Governor Nyesom Wike of Rivers State has asked Alhaji Atiku Abubakar, Presidential Candidate of the Peoples Democratic Party (PDP) to be mindful of those around him if he wants to win next year’s election.

Speaking in Port Harcourt during the inauguration of the Rivers State House of Assembly Quarters by the Speaker of the House of Representatives, Femi Gbajabiamila, on Friday, Wike said those around Atiku might cost him the election.

Wike said some persons were busy going after him when the target ought to be how to win the 2023 general election for the PDP.

“This should be the focus of all true lovers of PDP who want electoral victory. You’re supposed to be talking about how you will win election. All these rent seekers around him (Atiku) are not doing him any favour. Rather they are trying to make him not to win election. But if that is what they wish, I wish them good luck.”

“You see that I am not talking. I am doing my work, so leave me to do my work. Those concocting ideas everyday, social media cannot make you win election. Election is about the people and by the people. Those in Abuja with you (Atiku), tell them to go home and campaign for you to win election. Leave Wike alone, enough is enough.”


Wike also distanced himself from the suit filed to challenge the presidential ticket of the opposition party, saying mischief makers were linking it to him.

“People have called me throughout this morning and said all kinds of things that I went to court against Alhaji Atiku Abubakar. I want to say categorically, if I have a reason of going to court, I will go to court, but I didn’t go to court.

“Yesterday too, they said I removed all PDP flags at Rivers State Government House. But I just have to say these things for Nigerians to know that I have kept quiet, and been busy delivering dividends of democracy for my party to win election in Rivers State.

“But I want to tell the candidate, it is the candidate’s group that are doing all these things. Let the world hear, they are the ones plotting all these things, thinking that they will spoil my name, they can not.


“I didn’t go to court, I have no reason to go to court. But those of you who are plotting and saying that I went to court, saying Wike went to court, I say shame on you. Shame will be on all of you.

“I have told the candidate, you will win or lose this election because of people around you. Anybody who knows me know too well that if I was going to court, I would have gone to court within two weeks after the primary because it is a pre-election matter and after two weeks, you can’t go to court.

“The legal adviser of the party called me and said he knows that there is mischief going on. But that he knows me very well, if I’m going to court, it is not those kinds of lawyers that I would have used; I don’t even know the lawyers.”

Wike said during the 2019 general elections, the people claiming to love the PDP in the South-South sabotaged the party’s chances in the region.

He said instead of them, particularly the governors, to strategise on how to win the 2023 election, they were wasting their time to plot against him.

“When I see people talking about PDP today, I say to myself what is going on in this world. In the South-South, they all betrayed us. President Muhammadu Buhari wouldn’t have won the 2019 election because he wouldn’t have had the spread.

“But all the States in the South-South made Buhari to have 25 percent. It was only Rivers State that did not give Buhari 25 percent, I am challenging anybody on it. Today, I see people talk about PDP. When we were supposed to have won election in PDP under Alhaji Atiku. Rivers State gave the highest votes, Rivers gave the highest support in terms of logistics too. Let anybody come and contradict me.


“I told Atiku the other day, I said to him, all these governors that you think they are working with you what happened in 2019? Nobody wants to say the truth. I have said it, everybody, go to your State and deliver. It is ‘Operation deliver your State’. It is not to just talk. It is not to stay in Abuja. I don’t stay in Abuja, I don’t sleep there.

“I am here (Rivers) everyday with my people. I will tell Rivers people to demand for report card. See my report card, they are the projects we are delivering. I will tell them see why you will vote for our governorship candidate. See why you will vote for all the other (PDP) candidates.”

Gbajabiamila noted that the facility would provide serve as a conducive accomodation for members of the Rivers State House of Assembly.

He described the project as a worthy achievement that would impact the performance of the legislature in the state, commending the men and women who envisioned and executed it.
