The Categories Of Land Status:

In summary, land in a state is classified into 3 types.

Note: All land is in the care of the government and it has sole responsibility for the use of the land.

1. Excision
2. Uncommitted Acquisition
3. Committed Acquisition

As you can see not all land under government acquisition is bad we just have to know the differences and the right steps to documentation, and ratification which is the perfection of land purchase involving the government.

Most of the lands we buy will be in need of the ratification, not minding what any seller or estate agent might want to make you believe.

Do your background check and investigate the status of the land before purchase because most of the estate agents and sellers themselves are not informed.

That is because the Land Use Act, Laws of the Federation of Nigeria 1990, Chapter 202 states that :
An Act to Vest all Land compromised in the territory of each State (except land vested in the Federal government or its agencies) solely in the Governor of the State, who would hold such Land in trust for the people and would henceforth be responsible for allocation of land in all urban areas to individuals resident in the State and to organisations for residential, agriculture, commercial and other purposes while similar powers will with respect to non-urban areas are conferred on Local Governments. (27th March 1978) Commencement.

And we need to engage the best steps to do due diligence and not rely on what people say or if there are buildings already in the area.

Please do note that in anything land matters only a Land surveyor is to be contacted and consulted, not even a lawyer and that is why land information is given by the office of the surveyor-general and not by a judge or in court.
Note: In any zone that land falls within an original survey plan is needed to proceed to process any other titled document in the process of land regularisation, which is to change the land situation so that it follows the rules of laws, on land ownership in Nigeria.
I am saying this because most people don't know that lawyers are trained and licensed to prepare, manage, and either prosecute or defend in court acting as an agent for another and who also give advice on legal matters and not land matters. In the case of land matter, your lawyer will only defend if a Survey Plan that represents you as the landowner has been produced and can be presented in court.
