"The first order of the sentence issued by the examining magistrate found that Abba Abacha, born November 9, 1968, son of the late General Sani Abacha, was guilty of participation in a criminal organisation," Geneva Canton's justice office said in a statement.

It said the examining magistrate sentenced Abba to a suspended jail term and ordered the confiscation of his assets worth $350 million �which is held by his criminal organisation and seized through international assistance in Luxembourg and the Bahamas.�

Agency reports say the court was not immediately available for comment on the duration of Abba�s suspended jail sentence.

In yesterday's statement, the Swiss authorities also said they had convicted a financial intermediary who is currently domiciled in the Principality of Monaco, for having been part of the �criminal organisation� run by the Abacha clan.

The person, who was not named, has been sentenced to pay an unspecified fine.

�The person has also been ordered to pay the Canton of Geneva 10 million Swiss Francs -- which corresponds to illegal gains obtained from these culpable activities," added the statement.

General Abacha, who died in June 1998, is suspected of having siphoned over $3 billion from Nige-rian between his coming to power in November 1993 and his death four-and-a-half years later.

Some $700 million of his loot, which was stashed in Swiss banks, have since been returned by Switzerland to Nigerian authorities.

The General Abdulsalami Abubakar and later, Olusegun Obasanjo regime had put pressure on the Swiss government in a bid to recover an estimated $3 billion in embezzled state funds sent abroad by Abacha during his four and half-year rule.

Abacha used a circle of family members, close aides and business associates to transfer the loot.

At Nigeria's request, Switzerland froze hundreds of millions of dollars held there, as have Luxembourg and Liechtenstein.

Between 1999 and 2007, the Obasanjo government succeeded in recovering about $700 million of the looted money from the Swiss government.

Recently, several leading banks in Switzerland have been criticised by the country's regulators for accepting money from the Abacha family

In a 2002 report, the Swiss Federal Banking Commission said 19 banks had dealings with Abacha and did not report suspicions of money laundering to the Swiss authorities.

Six banks - three branches of Cr�dit Suisse Plus, Cr�dit Agricole Indosuez, Union Bancaire Priv�e and MM Warburg - were singled out for failing to run adequate checks on new accounts, including those opened by General Abacha's two sons.

�The mere fact that significant assets of dubious origin, from people close to former Nigerian President Sani Abacha, were deposited at Swiss banks is highly unsatisfactory and damages the image of Switzerland as a financial centre,� Banking Commission chairman Kurt Hauri said in 2002 after a 10-month investigation.

The commission said that almost a third of the Abacha money deposited with Swiss banks had first been banked in the UK, United States and Austria.

It has been revealed how Super Eagles striker, Obafemi Martins, extranvagantly squandered about N3.1 trillions while a player of Newcastle.

His former management company, NVA Management Limited who has dragged the player to court over breach of contarct, told the jury how the player’s account almost went red because of his lifestyle.

A former Premiership footballer routinely blew his £75,000 a week wages in a matter of days and was constantly overdrawn, a court was told yesterday.

Obafemi, ex-Newcastle striker 25, was paid the handsome salary after he joined the club for a £10million fee in August 2006.

But despite his extraordinary earnings, his former management team yesterday claimed they repeatedly bailed him out after his bank account continually slipped into the red.

The High Court heard that the Nigerian international player would withdraw £40,000 in cash from his bank account at the end of the week.

But that would only last him two days, the court heard, as he topped up with a further £25,000 on the Monday morning.

He was always overdrawn and repeatedly relied upon NVA Management Limited to ‘manage his life’, the High Court was told.

Martins, who owned several fast cars including a top of the range Porsche 4X4, spent the money funding an extravagant lifestyle of luxurious penthouse homes and fine dining.

He is now being sued by his former management company which claims that he still owes them 300,000 for sorting out his finances.

He told the court that Martins would withdraw £40,000 for the weekend, followed by another £25,000 on the Monday.

‘Despite earning these vast sums of money he was constantly overdrawn,’ added Mr Tennink.
He said the firm, which looks after the affairs of several footballers, film and music stars, said that Martins had agreed to pay them for simply managing his life.

It was under their stewardship that Martins agreed a £2million image rights deal ‘simply for being Mr Martins’.

He also had lucrative sponsorship deals with various companies including Pepsi and Nike but had not been paid.

When the company stepped in to run his affairs they sorted the unpaid contracts, bringing in thousands of pounds.
They also organised visas when he travelled to Italy, where he once played for Inter Milan, and sorted out his passport, his mortgage and property valuations.

They even arranged critical illness cover and were constantly running up and down the motorway from their London offices to Newcastle in a bid to do all that he required.
‘But surely these were things a secretary could do?’ asked Judge Richard Seymour QC, referring to the size of fees charged.

‘It was a Jeeves-type of role that they performed.’
Mr Tennink protested that managing every aspect of his life was just part of what they did, and asked the judge to bear in mind the sort of figures these players earned.

He said Martins had come to them in July 2007 and had agreed a fee of around £300,000 plus 20 per cent of any sponsorship monies they managed to acquire on his behalf.
“He asked for these services to be carried out,” Mr Tennink told the court.

Before they managed his affairs, Martins had not been paid a penny for his image rights for the use of his name on Newcastle shirts and mugs and had received nothing from his sponsorship deals.
He could not even find the contracts he had originally signed, Mr Tennink added.

Martins paid the company £67,500 in January last year and another £25,000 in April last year.
But the question for the court to decide, said Mr Tennink, was whether there was a ‘binding obligation’ for him to pay the outstanding bill of over £300,000.

After Newcastle were relegated from the Premiership last summer Martins was sold for £9million to German Bundesliga Champions Wolfsburg.

Martins, who once owned a penthouse apartment overlooking Newcastle’s exclusive Quayside, is fighting the claim.
The hearing is scheduled to last for three days.

Edo Chief Judge slumps, dies in Abuja

ABUJA — THE Chief Judge of Edo State, Justice Michael Edokpayi is dead. He gasped to death Monday night in the room of his hotel located in Area 11, Abuja, after he reportedly slumped.


The late Chief Judge was in Abuja for the ongoing 2009 Biennial All-Judges Conference holding at Andrew Otutu Obaseki Auditorium of the National Judicial Institute in Jabi, Abuja.


He led a number of serving judges of the Edo State High Court to Abuja for the conference on Sunday.


The conference was declared open Monday by President Umaru Yar’Adua.


According to one of the judges in the state and participant at the conference who preferred anonymity, the Chief Judge was full of life all through Monday before he left the conference centre in the evening.




She said that it was the Administrator of the Institute that broke the news to them through phone on Tuesday morning.


“When I heard about it, I did not believe it because he was full of life as at yesterday evening (Monday) when he left the conference venue for his hotel room.


“All I know is that he travelled all alone to Abuja without any of his aides around him.


“I alongside other judges in the state went to the National Hospital where they said his body was. We were shocked to see his corpse.


“The Chief Judge is dead, so the hospital confirmed to us,” the judge added.


She however said the judges in the state held a meeting afterwards to return to Benin because of the incident.


She said they would return to Edo state this morning.


The judge however said she had no details of how the chief judge died.


Vanguard however gathered that the incident took place around 11:32pm.

According to a version of the story, a visitor to whom the Chief Judge had given an appointment had asked after the judicial officer from the reception but was not allowed to go into his hotel room.


According to the story, the receptionists were said to have put a call through to the judge’s room but could not get a reply.


The visitor who was waiting at the reception also reportedly called the mobile line of the late chief judge without response.


The receptionists who allegedly confirmed that the judge had earlier collected the key to his room from them had to go to the room only to discover the lifeless body of the judicial officer on the floor.


The discovery made them to raise an alarm.


But the version said that before they could rush him to the hospital, he had given up the ghost.

Another version said that somebody was with him when he slumped and that it was his visitor that raised an alarm before he was rushed to the hospital.


As hazy as the details of his death were, so also was the cause of his death at press time yesterday.


But Vanguard spoke with the Chief Medical Director of the National Hospital, Dr Olusegun Ajuwon, on what could have caused the judge’s death to which he said it might not be unconnected with heart attack.


But he quickly added that all he said was nothing but a mere guess and that no one would be able to say with certainty what caused his death until an autopsy was conducted.


He said there was no way they could conduct a coroner inquest on his corpse because his case did not fall under that category.


Hear him: “the record shows that he was dead before he was taken to a private hospital, Ferobrod, at midnight.”


Ferobrod is a private hospital located in Garki 11 in Abuja.

The CMD added: “His corpse was later brought to the National Hospital at exactly 3:52a.m this morning (Tuesday).


“Presently, we can’t confirm what caused his death until when an autopsy is conducted if the family will allow it.


“And except they carry out an autopsy, we can’t issue any death certificate on him.


‘But I think it is high time we began to take myocadia disease seriously.


“I am not saying that he died of X Y and Z but that the cause of his death could be stroke or heart attack,” he added.


When Vanguard visited his house in the Edo state capital yesterday, his younger brother and Permanent Secretary in the State Ministry of Lands and Survey, Mr. Anthony Edokpayi was seen being consoled by visitors.


The younger Edokpayi who was visibly shocked by the death of his elder brother, described his death as “a big blow to the family and the judiciary”.


Justice Edokpayi was appointed the state Chief Judge by former Governor Lucky Igbinedion in 2006.



Sad day for Edo — Gov Oshiomhole


Meanwhile, Governor Adams Oshiomhole has described as sad and shocking, the sudden death of the state Chief Judge.


Oshiomhole who mourned the Chief Judge at Government House yesterday, while launching the new security outfit in the state “Operation Thunderstorm”, narrated that “this morning, we heard about the sudden death of the Chief Judge of the state and we could not believe it.


“He was with us last Sunday, during the Thanksgiving Service of the 1st anniversary of this administration and he was very strong. There was nothing to suggest that he will die. We are sad by what happened but we recognised that God gives life and death and there is nothing any of could do now. But it is a very sad day for us in this state”, he said.


Oshiomhole further prayed God to accept the soul of the deceased, and give the family the strength to bear the loss.

Intel has announced plans to start selling new dual-core Arrandale chips in the first half of next year.

The chips will target mid and high ranged ultrathin notebooks.


The three new 32mm CPUs will be the 1.2GHz Core i7-640UM, the 1.06GHz Core i7-620UM, and the 1.06GHz Core i5-620UM.

They will be selling in thousand-unit trays for $305, $278, and $241 respectively.
