Ex-minister ‘acquired properties in associates’ names’

Former Petroleum Resources Minister Diezani Alison-Madueke is likely to lose some United States properties traced to her.

The Economic and Financial Crimes Commission (EFCC) is probing Mrs Alison-Madueke for over $10 billion slush funds. It has initiated a process for the seizure of the assets – in line with United States laws.

EFCC Chairman Ibrahim Magu has just returned from the United States where he discussed with the authorities how to attach the properties, The Nation learnt yesterday.

In the last one year, the EFCC has traced assets and items worth about $10billion to Mrs. Alison-Madueke and her business associates, Mr. Kola Aluko and Chief Jide Omokore.

Some of the assets include an $18million peoperty (over N6.3billion at N350 exchange rate) in Abuja.

A top EFCC source, who spoke in confidence, said: “We have located some assets allegedly owned by Diezani and some of her business associates in the United States. We are already collaborating with the US Government to attach these assets.

“In fact, the EFCC chairman, Mr. Ibrahim Magu, spent about one and a half weeks in the US to work with the relevant agencies to trace Diezani’s properties, some of which are believed to have been secured through business fronts like Kola Aluko. “We have submitted relevant documents to the US authorities in order to facilitate the seizure of the assets.”

Responding to a question, the source added: “Some of these properties were acquired through some business fronts like Aluko and Omokore. “We even have a in which houses on a street in Switzerland have been traced to an associate of Diezani.” The EFCC is working with anti-graft agencies in Britain and the United States.

“Don’t forget that the EFCC initially secured a Mareva Injunction from Justice O.O. Oguntoyinbo to freeze some foreign accounts and seize some assets linked with Diezani’s associates in the United Kingdom,” the source said.

Accounts have been frozen in some of overseas financial institutions. They include BNP Paribas (Switzerland), LGT Bank (Switzerland), Standard Chartered Bank (London),Barclays Bank (London), Standard Energy (Voduz, Switzerland), HSBC (London), Corner Bank (Lugano, Switzerland) and Deutsche Bank (Geneva).

Section 34 (1) of the EFCC Act 2004 empowers the Commission to freeze any account suspected of being used for financial crimes. The section stipulates that “the chairman of the commission or any officer authorised by him may, if satisfied that the money in the account of a person is made through the commission of an offence under this Act or any enactment specified under Section 6(2) (a)-(f) of this Act, apply to the court ex parte for power to issue or instruct a bank examiner or such other appropriate authority to freeze the account.”

The National Crime Agency (NCA) in the UK arrested and quizzed Mrs Alison-Madueke and four others on October 2, 2015 for alleged bribery, corruption and money laundering. Also the EFCC has interrogated five more suspects since her interrogation. The NCA last year obtained permission from a Westminster Magistrate’s Court to seize 27,000 pounds from Alison-Madueke and two other women.

Although NCA detectives have visited the country this year in line with the probe, it was unclear as at press time when she will be formally arraigned in court in the UK. While the UK investigation was in progress, the EFCC uncovered another $115million poll bribery scam in which the ex-minister was implicated.

But Mrs Alison-Madueke has described allegations against her as “cold-hearted” and inhuman because she is ill.

Her statement said in part: “Coming at such a critical time in my life when I am battling cancer, this poorly executed propaganda bares on its face like tribal marks, a clearly malicious attempt to victimise an innocent woman in what appears an exaggerated plot to validate and give credibility to the anti-corruption crusade under Nigeria’s new regime. “People who are battling cancer or those who have lost their loved ones to this medical condition understand what I am going through at this time.

“This is what makes me ponder at the cold-heartedness of those who will go any length to defame and destroy in the name of propaganda. What happened to our shared humanity? ”I have absolute regard for the law and believe that people who have breached the laws that govern societies should be made to face the wrath of the law.

“But in a civilized society, a responsible government owes its citizens absolute commitment to the principles of rule of action know it.law, equity, fairness and justice. Bill to rescue economy ready

President Muhammadu Buhari will be seeking emergency powers from the National Assembly to push his planned stimulus for the economy.

The objectives of the action-plan on the economy, which is in recession, include shoring up the value of the naira, creation of more jobs, boosting of foreign reserves, reviving the manufacturing sector and improving power.

Government sources said the decision to seek emergency powers for the President was based on a proposal from the economic team headed by Vice President Yemi Osinbajo. The team reviewed the various policies so far introduced and how they have affected the economy.

The economic team, it was learnt, gauged the mood of the polity and decided that unless there is an urgency which some of the extant laws will not permit, “the recession may be longer than expected and Nigerians will not get the desired respite, which is the goal of this government”.

An executive bill titled: “Emergency Economic Stabilisation Bill 2016” is to be presented to the National Assembly when the Senate and the House of Representatives resume from vacation on September 12.

In the bill, the executive will be asking for the President to be given sweeping powers to set aside some extant laws and use executive orders to roll out an economic recovery package within the next one year.

Buhari will be seeking powers to:

abridge the procurement process to support stimulus spending on critical sectors of the economy;
make orders to favour local contractors/suppliers in contract awards;
abridge the process of sale or lease of government assets to generate revenue;
allow virement of budgetary allocation to projects that are urgent, without going back to the National Assembly.
amend certain laws, such as the Universal Basic Education Commission (UBEC) Act, so that states that cannot
access their cash trapped in the accounts of the commission because they cannot meet the counterpart funding,
can do so; and
to embark on radical reforms in visa issuance at Nigeria’s consular offices and on arrival in the country and to
compel some agencies of government like the Corporate Affairs Commission (CAC), the National Agency for Foods
Administration and Control (NAFDAC) and others to improve on their turn around operation time for the benefit of
business.
The extant law on procurement does not allow contract award earlier than six months after decision. Part of this is a mandatory advertisement of the contract for six weeks. The economic team has found this to be unacceptable, given our present circumstance.

Although the president has the power to order the sale or lease of any government asset to raise cash, “the procedure is cumbersome and long”. The draft bill is meant to ease the process. The government source said about nine government assets may be leased or sold to generate around $50billion to shore up the nation’s foreign reserves and the value of the naira against the United States dollar.

The source said: “Nigeria may be broke at the moment but we are not a poor country, given our assets and capability.” About N58 billion is trapped in UBEC’s coffers because the states cannot access it as a result of the key condition, which is the payment of 50 per cent counterpart funding. The government is seeking an amendment to the law so that states will pay only 10 per cent as counterpart funding.

The objective is that state governments will have access to cash to develop education. This will facilitate creation of jobs since contracts will be awarded for the projects.

As for contract awards, the government, by the provisions of the law, cannot mobilise contractors with more than 15 per cent of contract sum. This is considered to be undesirable by the economic team given the pace the government wants to move in turning the economy around and in the provision of critical infrastructure. The bill will seek to allow the government to mobilise contractors with 50 per cent of contract sum.

The move to get government agencies to fast tract their operations is to enable foreign investors to come into the country without the current bottlenecks. Consular offices will now be expected to make visas available within 48 hours and visitors, especially tourists who intend to pick up visas at the entry point, will be able to do so. Time wasting at the airport with duplication of agencies screening incoming passengers is to be eliminated. Those leaving the country should go without hassle.

For the power sector, the government plans to truck gas from source to the power plants to enable them get what they need for generation. A government source said: “This may be more expensive but it is a price to be paid for Nigerians’ comfort”.

It was learnt that President Buhari will engage the leadership of the National Assembly before their resumption to solicit support for the bill’s quick passage.

“The initial argument is that the Speaker is the nation’s number four citizen and the modalities of summoning him ought to be different. But we have checked the statute books, neither Dogara nor any of the principal officers has immunity from investigation and prosecution.

“We have not foreclosed investigation into the alleged budget padding. Whoever is talking of any other solution than this ongoing probe might be referring to another platform.”

The source said the commitment attached to the investigation accounts for non-reopening of the office of the Appropriation Committee in the House which was locked following the budget padding allegations and the counter allegations.

“Until we have conducted substantial investigation, the office will still be firmly locked by security agencies. That is a strong room of exhibits,” the source said.

Asked of the extent of investigation, the source added: “We have got sufficient documents for preliminary investigation which is already in progress. “The Clerk of the National Assembly has up till next week to submit the draft and final copies of the 2016 Budget to the panel.

“All we need now is to interact with the four principal officers immediately they return from recess. If they fail to report, the law has a provision for taking card of such.” The source confirmed that 10 chairmen of committees in the House will take their turn after the four principal officers.”

On the appearance of House Leader Gbajabiamila before the SIP, the source said: “Although Jibrin did not mention his name in his petition and addendum, he had audience with us on Friday for over one hour. “It was a comprehensive session which provided more insights into the workings of the House. “He did not say or mean that he is above the laws of the land or that he is shielded by the law or has immunity for any infractions of the law. “This clear restatement of the law has been twisted by sections of the media to mean that neither security agencies nor the courts could investigate or prosecute or try him! “This is most uncharitable and a deliberate and calculated attempt to pitch the Speaker against the Nigerian public and paint him as lawless.

“As an Officer in the Temple of Justice, Dogara not only owes unalloyed allegiance to the Judiciary but also to the institutions of law enforcement. He indeed swore to an Oath of allegiance to the Constitution of the Federal Republic of Nigeria. “Dogara should not be portrayed as insensitive or arrogant as this is contrary to his true nature of humility and humaneness that has endeared him to his colleagues and Nigerians.”

You are so lost on the trend of this story that you failed to notice the following:

1. The FG came out to say the budget was not padded (that sounds like a defense of Dogara)
2. The APC has been inviting Jibrin continually, looking like they want to muscle him into keeping quiet
3. The EFCC just reopened a fraud case against Jibrin. This looks very much like a state-sponsored attempt to keep him quiet.

Whatever is happening between those two, your PDP insinuations are not only wrong, but they are also misinformed! Dogara seems to be the APC good boy now and every outfit seems to be defending him...

Unfortunately, your obsession with hatred for PDP will make you blame them for a crime committed in Benin Republic self...Naija people!

You obviously appear out of the loop on the foundation of Saraki and Dogara's travails. Fact is that both men engaged in the "highest form of treachery, fraud and deceit" against the bigger APC interest. Those are the words of the then APC spokesman, Barr. Lai Mohammed.
