Electoral Act amendment will die natural death, says Senator

The amended Electoral Act which places Senatorial and House of Representatives polls first in the sequence of elections will die a natural death, Senate Committee on Police Affairs Chairman Senator Abu Ibrahim said yesterday.

The Katsina South senator also said President Muhammadu Buhari would not assent to the bill when it gets to him.

Ibrahim was one of the nine senators who walked out of the Senate chamber on Wednesday following the adoption of the conference report which endorsed the alteration of the elections sequence. The report was prepared by a committee comprising members of both chambers.

Section 25(i) of the amendment which placed the National Assembly polls first in the sequence of elections sparked a row in the Senate on Wednesday.

The senator said the National Assembly had no right to usurp the powers of the Independent National Electoral Commission (INEC) under the Constitution to fix elections.

Ibrahim claimed that the amendment was never discussed in the Senate, saying it came from the House of Representatives for the concurrence of the upper chamber.

He said: “President Buhari is an institution. We will not add anything to his electoral value. Some senators do not even appreciate the fact that they will be in more danger with their governors if they stand election alone. Some senators may have problem with their governors but you are arming the governor to attack you if you stand election alone. You will spend more and be on your own.

The amendment also provides that governorship and Houses of Assembly elections should follow the National Assembly polls; the presidential election comes last.

Ibrahim described the amendment as unconstitutional especially when Section 76 of the Constitution is clear on who should fix elections.

He said the conference committee wrongly believed that there was an amendment to the Constitution which gave them power to change the sequence of elections. The amendment, he said, was never signed into law.

Ibrahim said the Senate’s adoption of the conference report was an “effort in futility”, adding: “the amendment cannot stand and the President will not sign it.”

He went on: “When it comes back to us, it will die a natural death.”

The two chambers of the National Assembly yesterday passed an amendment that altered the sequence of elections in the country. The amendment has now upturned the order of elections approved by the Independent National Electoral Commission (INEC) last year.

INEC’s time table puts presidential and National Assembly elections first before the governorship and state assembly elections. With the amendment, the National Assembly election is to hold first, followed by gubernatorial and state assembly polls.

The presidential election which usually comes first will now hold last. The Senate passed the amendment following the adoption of the report of the conference committee chaired by Senator Suleiman Nazif (APC, Bauchi).

Immediately after the vote on the amendment, senators including Abdullahi Adamu, Kabiru Gaya and Ovie Omo-Agege raised a point of order, faulting the procedures adopted for the passage. However, the Senate President, Bukola Saraki, ruled them out of order.

“No matter what the subject matter is, for conference report it has been the procedure and as such with all due respect I have to rule out of order,” he said.

Angered by the development, Senator Abdullahi Adamu led nine of his colleagues to address newsmen on the passage of the amendment. Present at the briefing were Senator Omo-Agege, Malam Ali Wakili, Abu Ibrahim, Abdullahi Gumel, Binta Masi, Yahaya Abdullahi, Andrew Uchendu and Benjamin Uwajumogu.

The protesting senators said 59 of them are against the passage of the amendment. Our correspondent reports that at the moment, the APC has 60 senators, PDP 48 and APGA one. All those who were against the passage are APC members. Abdullahi Adamu queries the rush At the briefing, Senator Abdullahi Adamu said they were totally against the change of election sequence, describing the passage as rushed.

“We are part of the whole of the senators who oppose the process by which the so-called conference report was laid and considered. I had the opportunity, I was heard but the Senate president said my observation was being noted. “The reliance upon the relevant statutes, some of which have actually not been signed to the best of our knowledge, and we did challenge that, anybody who had the signed copy should have produced it there so as to check doubting Thomases.

“We believe the process was rushed. There is no need for the rush. Give everybody the opportunity. There is no reason for just two people to speak on the issue. It’s not the tradition of the Senate. And then the question is put and that’s it, just because it’s a conference report. “We are against what has happened.

We are not the only ones. If you take note of the report that was circulated, the chairman and co-chair did not sign it. We don’t know why they didn’t sign. “Why do we want to make a law that addresses one particular issue targeted at a person.

This is very partisan. You could see from the body language, from the utterances that it is a pre-determined thing by a political party that is threatened by the APC government. Whatever incumbency gives to anyone we are denying that one.

We are not part of this endorsement,” he said. 59 of us are against it - Omo-Agege Also speaking, Omo-Agege said 59 of them are against the passage of the amendment. “For some of you who are familiar with what transpired in the House of Reps, only 36 members were on the floor when this so-called amendment to Section 25 of the Electoral Act was introduced. The position we took is that 36 people cannot determine the destiny of 360 people in the house which is now being carried over to 109 in the Senate.

“The least we are owed is for this so-called amendment to be deliberated upon and our rule is clear. We have 59 senators who are opposed to the inclusion of Section 25 of the Electoral Act. If that division was allowed today, 59 senators would have voted to delete that purported amendment to Section 25.

“You don’t make a law to target one person. The perception is that the law is targeted at the president. I will continue to protest it.

I can tell you it will not become a law,” he said.

Amendment not economical - Binta Masi On her part, Senator Binta Garba Masi (APC, Adamawa) said the reordering was not economical. “Now we are having economic crisis in our hands and instead of us to look at the welfare and wellbeing of our people, we are looking at selfish interest in the long-run. It’s self serving - Wakili Also speaking, Senator Malam Ali Wakili (APC, Bauchi) said the amendment was self serving.

“Why did they wait until after the INEC has come out with the timetable? If we look at the cost-benefit to the economy, four elections in one month! It is not well for the economy, politics and security. “We had, inside this chamber, considered conference reports and we dissolved into house, looked at them clause by clause, raised observations and returned them back to the House of Reps.

Why must it be different in this case?” he said. It’s illegal -Uchendu Senator Andrew Uchendu (APC, Rivers ) said the amendment was illegal. Citing Section 132(1), he said the change of the sequence was in conflict with the law, saying the constitution overrides any other law.

Section 132(1) reads: “An election to the office of President shall be held on a date to be appointed by the Independent National Electoral Commission. We’ve no business on election sequence -Kurfi Senator Umaru Kurfi (APC, Katsina) also described the amendment as illegal. “This is absolutely wrong.

We are lawmakers, elections are for INEC, so why should we worry ourselves with election? This thing they are doing is absolutely illegal. There is no way they can achieve it,” he said.

Spokesman of the Senate, Aliyu Sabi Abdullahi (APC, Niger) and Senator Suleiman Nazif (APC, Bauchi) addressed the press countering the claims of the Senator Abdullahi Adamu-led camp. Due process followed -Sabi In a swift reaction, Sabi said due process was followed in the amendment of the Electoral Act. He said the amendment was done to deepen democracy. “By our procedures, the Senate has passed its own version, the house has passed its own version, the next thing to do is to have a conference committee to harmonise. “Our rule says whatever position we have taken, and there is a similar one in the house, we harmonise but where the house has taken a position that we have not taken, we are bound compulsorily to adopt that of the house.

“Where the Senate has taken a position and the house has not, that conference committee is bound to adopt the recommendation from the Senate. I think within the context of this particular assignment, that is what happened,” he said.

Odds against N/Assembly’s reordering election sequence

The National Assembly’s re-ordering of elections is not a fait accompli because there are other hurdles ahead, Daily Trust reports. The new decisions taken by both the House of Representatives and Senate, which puts presidential election last in the sequence of 2019 elections, were at variance with what INEC said.

Credible sources close to INEC and the presidency said the National Assembly’s decision might suffer a setback. “President Muhammadu Buhari has enormous powers of disallowing the amendment to sail through,” a source close to the presidency, said.

“He can withhold signing it into law if he pleases and time frame of election might not give the National Assembly the latitude to do something funny,” he said.

“But most importantly, INEC can go to court and have the National Assembly’s decision dismissed with dispatch,” the source added.

The general impression was that the idea was self-serving and might likely work against President Muhammadu Buhari in the event he decides to run for a second term next year. When contacted on the matter,

Spokesman of INEC chairman, Mr Rotimi Oyekanmi said he did not hear of any plan of going to court for now. “Not to my knowledge,” he said in a text message last night.

But a different source at INEC said in the event the electoral commission decides to go to court, it will out rightly win the case. “There is nowhere in the world an act of parliament overrides the Constitution of the country.

Section 132(1) of the 1999 Constitution is explicit, it says elections should be held on a date determined by INEC; so what happened in the National Assembly is a nullity of sort,” he said. “This is besides other encumbrances on the number of legislators who participated in amending the Electoral Act…there was no quorum in any of the chambers,” he said.

Governor Rochas Okorocha, on Tuesday met with the Most Beautiful Girl in Nigeria (MISS NIGERIA), Miss Ugochi Ihezue who is an indigene of Imo State at the Government House and they agreed to aggressively pursue Youth-Oriented Programmes and Policies.

Miss Ihezue is from Akokwa in Ideato North LGA, Imo State. Governor Okorocha who received the beauty pageant and her entourage including the parents said although his administration has embarked on certain programmes and policies for the youths in the State, but the current war his government is waging against illicit drugs and other related matters in the State is very dear to him, because the exercise is aimed at saving the youths from self-destruction.

He described Miss Ihezue as a good example of what a youth should be, adding that her status as MISS NIGERIA would be an encouragement to other youths in the State in particular, and beyond, and commended her carriage which made her to win the crown.

Now, the Western region who gave Buhari about 55% of their vote in 2015, will increase it to 80-90% or about 6-7 million votes.

Alleged N400m fraud: EFCC asks court to revoke Metuh’s bail, send him to prison

The Economic and Financial Crimes Commission, EFCC, on Tuesday, asked the Federal High Court in Abuja to revoke the bail it granted to former National Publicity Secretary of the Peoples Democratic Party, PDP, Chief Olisa Metuh. METUH

The anti-graft agency, in an application that was made by its lead counsel, Mr. Sylvanus Tahir, urged the court to remand Metuh in prison custody pending the determination of the criminal charge against him.

The application followed the absence of the embattled former PDP spokesman in court for two consecutive dates that his case was fixed for hearing. Metuh is answering to a seven-count criminal charge alongside his firm, Destra Investment Limited. EFCC is prosecuting him over allegation that he had before the 2015 Presidential election, received N400million from the Office of the National Security Adviser, ONSA, without executing any contract.

The agency alleged that the fund was electronically wired from an account that ONSA operated with the Central Bank of Nigeria, CBN, to Metuh, via account no. 0040437573, which his firm operated with Diamond Bank Plc. It told the court that the fund which was released to Metuh and his firm by detained former NSA, Col. Sambo Dasuki, retd,‎ ‎was part of about $2.1billion earmarked for the purchase of arms to fight insurgency in the North East.

More so, the prosecution which had earlier closed its case after it called eight witnesses that testfied before the court, equally alleged that Metuh was involved in an illicit transaction that involved the exchange of $2million. Metuh had at the resumed proceeding on the matter on Monday, failed to appear in court, though he filed a letter pleading for adjournment on ground of ill-health.

His lawyer, Dr. Onyechi Ikpeazu, SAN, further informed the court that he was hosptalised at the Nnamdi Azikiwe Teaching Hospital at Nnewi in Anambra State. To support the claim, Metuh forwarded to the court, a letter dated January 21, 2018, which was signed on behalf of the hospital by one Dr. O. C. Based on the letter, Justice Okon Abang deferred the trial after EFCC said it grudgingly conceded to the adjournment request in the interest of justice. Meantime, when the case resumed on Tuesday, Metuh was also not in court, a development that led EFCC to apply that he should be made to attend his trial from Kuje prison. It will be recalled that the court had on January 19, 2016, granted Metuh bail after he had spent five days in prison custody. The embattled PDP chieftain who was arrested on January 5, 2016, was docked before the court after he had also spent 14 days in EFCC custody. Justice Abang granted him bail to the tune of N400m, with his international passport seized by the court.

While applying for revocation of the bail, EFCC, faulted the letter from the hospital on the premise that it was not supported with a verifying affidavit, adding that it did not make any reference to the case pending before the court. The prosecution equally rejected plea by Metuh’s lawyer for the court to conduct independent invetigation with a view to ascertaining whether or not Metuh was hospitalied.

According to EFCC lawyer, “The court should decline the invitation to order investigation into the veracity of the letter. There is no basis for that. “Having regard to the absence of the first defendant from court yesterday and today for inexplicable reasons and also having regard to the fact that he is enjoying the bail of this court and has taken steps to undermine and jeopardise the full objectives and purpose of bail in the administration of criminal justice, the prosecution is constrained to apply for the revocation of the bail of the first defendant pursuant to sections 173(b) of the Administration of Criminal Justice Act and section 169 of the same Act. “It follows without mention that we are vehemently opposed to application for adjournment.

And we pray this honourable court to revoke the bail granted to the first defendant and commit him to prison until the conclusion of his trial. Once the bail is revoked, he will be attending his trial from the prisons.” Metuh’s lawyer however urged the court to refuse EFCC’s application and vacate the days already fixed within the week for continuation of the trial. “My learned friend has not placed any material before the court on why the bail granted by my lord after an extensive application should simply just be revoked. “The essential facts to support such revocation must deal with the facts that the defendant is a flight risk, he is interfering with witnesses of the prosecution or interfering with due administration of justice”, Ikpeazu argued. Similarly, counsel to Metuh’s firm, Mr. Tochukwu Onwugbufor, SAN, also urged the court to place value on the medical report and adjourn the trial till a later date. Earlier, Metuh’s lawyer notified the court about his client’s decision to call 10 more witnesses in defence of the charge against him. Justice Abang subsequently adjourned further proceeding in the matter till Wednesday.

As a supporter of this government, this development is rather unfortunate.

This plan is totally contrary to what this APC government's Minister of Power, Fashola publicly stated policy : that all future power plants will be located at the source of the material that powers the plant.

Fact is that all Gas resources in Nigeria today comes from the Eastern Region. Period. So locating plants in Lagos, Abuja etc and then piping Eastern Region's Gas resources to these areas will fail.

The exploited peoples of the Eastern Region, may sabotage the pipelines thereby rendering these parasitic plants useless.

When you take the jobs and tax revenues that belong to the Eastern Region to Lagos, Abuja etc, it further exploits the people of the Eastern Region who own these natural resources.

In addition, it us no longer a secret that 97% of all blocks from Eastern Region are owned by Hausas and Yorubas!!!

The best thing is to build all gas powered power plants at the source of the raw materials, right in Eastern Region. Period.
