Goodday wonderful people of this forum, i need your advise over a concern that is really stressing me mentally, my wife is a doctor, just got her full GMC registration and license to practice in the UK, we have been married for 6 years and we have a 5 year old son who is a U.S citizen. We are about to apply as a family under Tier 2 for her to resume work in the NHS, However, i was denied in 2013 a visitor's visa to the UK and it was denied under 3207a which is a category for deception. I couldn't challenge it then, however moving forward, my circumstances has changed, and i have a family now and also changed my job from the one i had when i was denied seven years ago. The issue now is that as a family unit, will my past denial with deception alter my chances to move together with my family? N:B this denial was seven years ago, it was a visitor's visa, was single then, My wife is the principal applicant now and she feels that we will be fine because am her dependent with my son, Some people have said different things that it is technically a ban, but on the refusal letter it was not stated so, i need clarity, what are my chances??

please i need help, i have posted this before but didn't get the response needed. I was denied UK visitor visa in 2013 under 320 7a because of a family photograph(parents and siblings) with a different background and it was seen as altered and deception was implored which was not the case because i had no idea that such a photograph will raise any dust. I was single then. Moving forward 6 years later am married to a Doctor and i have a son who is a U.S citizen. my wife is about to apply for Tier 2 to work as a Doctor in the UK and my son and i are her dependents. I was told that my previous visa denial under 320 7a will or might jeopardize the application Because denials under 320 7a is automatic ground for ban under 320 7b since it involves deception. I don't know how true this is, i was not given a ban, i was single then. As a family man whose circumstances has greatly improved with a wife and son and she is the principal applicant, i would like an expert opinion about this so we don't make any mistakes. we are almost there. Somebody please help !!!!

Let me speak to the separate part of your issue that I'm aware of, i.e. how 320 (7A) works:

About 320 (7A) - once you get that, I'm afraid you're virtually banned. The "may" in the "future applications may be denied under 320 (7B)" refers only to serious compassionate grounds for a visa grant. Such grounds are usually grave health conditions or the refugee/asylum scenarios, etc.

However, assuming the reason for your denial under 320 (7A) was overstaying, you just may have a chance. If it was for the use of false documents/making false statements, you need to conclusively show that you were unaware of this to slip out of a 320(7B) ban, which you should have addressed at the time.

Visa issues can also cut across categories - in other words, if you had trouble with a visitor's visa application, it can affect a student's visa application, for instance. I know someone who overstayed for a long while, returned, was denied visitor's visas twice thereafter, and a student's visa (for a master's) twice as well (came from a wealthy family and was fully funded and all that) until she gave up and went elsewhere. This however was before Theresa May brought in the new Immigration Rules in 2011. Things are apt to be even tighter now.

The new rules only make reference to visitor's visas being automatically refused in the event of any deception or fraud with previous applications of any category, but I think its only reasonable to assume that the reverse would also be the case.

Will this affect your wife's Tier 2 application with respect to you as a dependent? I can't say conclusively, not having come across someone who has your specific problem before, but I don't think that you can expect much leniency, if at all in today's hysterical immigration climate in the UK (read up about the Immigration Bill that was passed last night to give you a better idea of what these people are thinking).

wow thank you so much, i got in touch with an immigration lawyer and he made me realize that am not off the hook, and wants to make a request to the home office regarding reports on the issue, In fact am no longer interested, because i understand that all of this might result in waste of time and money until the period of timing is over, Thanks a lot and please if you can kindly relay this case to anyone who can give somewhat a varying opinion over this issue, maybe i might stand a chance with my wife's TIER 2 Application as a dependent Kindly Oblige me. please i need an expert advice urgently, i was denied in 2013 under 320 7(a) which is a category of visa refusal when deception was used, Its a long story. I ddn't get a ban thankfully, but what was written on the letter is that any future application MAY be denied under 320(7b) which is the Ban for 10years. Fast forward 2019, My circumstances have greatly changed, married for five years now and i have a son who is a U.S citizen. My wife who is a doctor is about to apply for her TIER2 visa to work in the UK and i and my son are her dependents. please i would like to know if we can go ahead and apply for her TIer2 as a family, I would like to know if past refusal under 320 7(a) would not jeopardise the application. i am just worried and i need clarity to alleviate my concerns. Thank you all in advance !!

Nairalnders goodmorning, just got a wonderful news from my friend this morning about his ITA to NSW. Am here to ask this question on his behalf, he plans to travel alone for now due to financial constraints on visa fees and flights to Australia for his wife and two kids, However, he wants to know if he can proceed without medicals for every member of his family for now since they will be coming in a few months time after he is settled, or must everyone do a medicals now to continue his application? Even on other forum we still get conflicting information. Yet there has been people granted VISA in the past without assessing their highest qualification. I am in this situation as well and I do not plan to assess. Unless if someone can tell me that it has change.

I think the emphasis is on Over claiming point

As long as you are sure of the point you should be save

The above are my opinion. And I stand by it, If wrong please someone correct me with following info...

1) point claim
2) Name of school and country of school
3) Equivalent according to CEP ( lawland can help us out here)

Please oga bellong i would like to find out if i can use my notification of result instead of my certificate which was gotten at a later date . The date on my notification of result allows me with 15 points work experience, which is what i need to qualify for state nomination. I would also want to know when applying to DIBP, if they will just accept the notification of result or its a must to submit certificate thanks.ure, I know.
