Look at order 3... it says all parties go back to status quo antebellum.. that is the state of affairs before the matter was instituted at the state high court.

Now Oko jumbo became speaker 8th May.... the order by Wali was given 10th May so what is status quo antebellum 😂

The appeal court was careful not to grant any of the prayers Martins requested that had to do with the meat of the matter like asking the court to remove oko jumbo as speaker and render his actions as null and void. That language was not used. The AC avoided granting amewhulee prayers as that would amount to deciding the main matter that should rightly start from the FHC.

Disclaimer: I am not a lawyer but it appears like common sense to me. Let the lawyers in the house dispute me.i'm willing to be corrected . 😂

The governor seems to misunderstand the game being played. If he understood, he wouldn't have gone to court. They don't need to defect now because they control APC in Rivers and PDP at the national level.

The national PDP is supporting them against the governor in court, and it is superior to the state PDP chapter. The real drama will unfold during electioneering

Lastly, since you think you're correct, why did you think the governor went to the Rivers state high court instead of the federal high court?

Think beyond the house of assembly because the governor can get the speaker to remove anyone. But in court, you'll have to prove beyond reasonable doubt that the said member cross-carpeted to a new party. My point you're deflecting from is that only the party can confirm if someone is still their member or not; the judge can't rely on any other source, not even the resignation letter or video evidence, because the lawyer can easily disprove that.

Which other party are there members of? Who is chief that declared their seat vacant? Has inec given effect to that? Do you have a written letter of their defection or resignation?
The court has severally stated that when there is a contention between written and oral/audio and other evidences,written evidences will always prevail.

You are very stubborn o! There is an affidavit of defection in addition to their defection letters read out on the floor... you are saying there must be a letter to the party chairman. Yes, they will write to the party chairman as a later step but it doesn't invalidate a process they have clearly started.

Omotosho of the FHC gave a restraining order barring their seats from being declared vacant after amaewhule and PDP had submitted documents showing they had truly defected. This was in January this year at the height of their madness when they were fully convinced by wike they wouldn't lose their seats. Martins having realised later that it was a blunder is now trying to claim they never defected but they will surely lose their case if omotoshos judgement is appealed against.

The Appeal Court just decided on an issue that goes to the root of the suit at the FHC.

Mind you, Justice Omotosho's ruling (FHC) on the same issue which recognised Amawhule's group was subsisting until a court (SHC) without jurisdiction did abracadabra. I laughed when I saw that.

I was under the impression that the appeal was discussing the meat of the matter only to decide on JURISDICTION by a lower court.

We are talking jurisdiction so why are you bringing evidence when it's obvious the main issue of defection hasn't been heard by any Court.
Omotosho gave an injunction against their seats being declared vacant right? So fubara still has to prove their defection in court.
