I have taken time today to study all the court cases in Rivers state and the judgements so far given.

The summary is that Fubara is losing heavily in both federal high court and court of appeal.

So far, Federal high court and court of appeal have ruled against pro-Fubara court cases

So far, there are two issues that pro-Fubara camp has taken to supreme court and it seems pro-Fubara camp will lose both cases cos federal high court and court of appeal ruled against pro-Fubara camp.

The first case is this one op mentioned. Also it started in November, the restraining order is not a judgement...the federal high court later gave a judgement which Fubara rejected and appealed and also lost yesterday. And Fubara has directed that the case be taken to supreme court

The second case has to do with the defection proper and it was initiated at Rivers state HIGH court.... pro-Fubara camp won at the STATE HIGH court but lost when the case was taken to appeal court. The case is currently at supreme court. The second case on the same defection issue was instituted by APP political party, a pro-Fubara camp, at the federal high court and unfortunately APP lost the case.

If pro-Fubara camp lost the two cases at the supreme court, Fubara will most likely face a big problem in Rivers state cos his actions will no longer have any legal backing

From what I can see, Fubara goofed on many fronts.

1. Fubara ought not to have started a confrontation with the state house of assembly so early into his tenure to the extent of demolishing the house of assembly so that the elected state lawmakers won't have anywhere to perform their functions. Fubara attempted to control the state house of assembly and he failed. Using 5 lawmakers to take over the powers of 25 others is morally and legally wrong. If you support this action in a democracy then there's something wrong with you.

2. Fubara was not sincere in accepting the offer of peace agreement everyone agreed to. He pretended to accept the offer of peace just so he can get past supreme court hurdle, cos his election victory was at the supreme court then. Immediately he won the election case, Fubara went ahead to remove the chief justice of Rivers state and install someone loyal to him. At the same time, he also reshuffled his cabinet to redeploy those he perceived as against him. This move was against the peace agreement he had with the others and also caused the issue to escalate.


In summary Fubara is losing heavily in the courts. If he loses at the supreme court, the 25 lawmakers he's been preventing from carrying out their duties will have the legal basis to return and the federal government will give them security to conduct their legislative business. They may likely start impeachment proceedings against Fubara if he continues to behave like a bull in a China shop.

As for every other person who goes about misinterpreting the judgements of the courts, it's time they start getting sued for undermining the judiciary, causing confusion and instigating lawlessness

Not true! The first appeal court ruling you mentioned was simply om jurisdiction. The appeal court simply agreed with the FHC that the SHC did not have jurisdiction and the suit should have been instituted at the FHC.

The issue of defection HAS NOT BEEN RULED ON BY ANY COURT TILL DATE.

And note also that this was a suit that should have been withdrawn in obedience to Tinubu which wasnt done... Fubara withdrew his.

Now you want fubara to obey a court judgement PROCURED BY WIKE in the guise of "obey rule of law"... you are jokers!! 😂 😂

Below is proof that what was before Justice Omotosho was not the issue of Martin and his committee members defection as the suit was filed while they were still in the PDP and as the first document shows that the court sat on the 30th of November 2023.

The suit was against the call for the National Assembly to take over the functions of the Rivers State House of Assembly- which they were still members at the time- and for the governor to continue to deal with them as Assembly members. Look at the 16 entities listed as defendants in the 1st and 2nd documents. No INEC who conducted their elections, no PDP who sponsored their elections, so how would the judgement have reinstated them after they defected the next month; precisely on the 11th of December 2023 and approached a different court on the 13th of December 2023 to protect them against INEC who conducted their elections, and the PDP that sponsored their elections. See the 3rd and 4th documents and read paragraphs 16 and 17 of the 4th document very carefully.

Mine is to state the fact, you can do whatever you want to do with it.
