How did the the other appeal court verdict favour Amaewhule and co ? People whose seats have been declared vacant.. an order yet to be VACATED by any court to this day?

If Amaewhule and co want this matter settled once and for all, the suit at Justice Okorowos FHC is waiting for them.

The law is against the 1999 constitution that stipulates 3 years for elected LGA chairman.

But every right thinking person knew those guys were gone for good. I said it here that if Amaewhule and co were to return they wouldn't come back with those LG chairmen.

RSIEC has slated LG elections for October. TIme for the CTC chairmen to do their underground work.

I don't understand how one man will want to control a whole state structure to the detriment of the people and people are cheering him on , defending his impunity because he rigged elections for thier god in Aso rock.

One selfish, greedy mam wants access to Rivers treasury for his selfish aim and idiots are calling a man who has the balls to resist him an ingrate!

We must be cursed in Nigeria. No other valid explanations!

APPEAL COURT STRIKES OUT CASE ON LG TENURE ELONGATION

Court of Appeal, Port Harcourt division on Monday struck out the appeal on the following matters for lack of merit.

1. CA/PH/137M/2024

THE POLICE CAN NOW VACATE THE LGA COUNCIL SECRETARIACT FOR PROPER TAKEOVER BY C.T.C CHAIRMEN.

The Court of Appeal sitting in Abuja has dismissed appeals filed by Cookey-Gam & Ors on the elongation of their tenures as Local Government Chairmen in Rivers State.

The tenures of the LG Chairmen have been a subject of controversy following an amendment by the Rivers State Assembly led by Martin Amaewhule for the extension of their tenures. This has been a follow-up to the crisis involving Governor Sim Fubara and his erstwhile mentor, Ezenwo Wike.

However, a High Court sitting in Rivers State had struck out the amendment seeking extension as been contrary to the Constitution of the Federal Republic of Nigeria 1999 as amended.

The panel of the Appeal Court today upheld the decision of the High Court, refused the extension of the tenures of the Chairmen whose positions expired in June and dismissed the case for been unmeritorious.

If you say the appeal court judgment is only about jurisdiction and that it doesn't return Amaewhule, why do you need to appeal it?

Just concentrate on the substantive suit which you say is at the federal high court.

Meanwhile, this is the CTC of the judgment delieved by the appeal court. Pay attention to the highlighted part. You'll see why you shouldn't waste time with any fool who tells you the judgment was about jurisdiction

You bring insults when you can't argue logically and it's unfortunate. I can see Comprehension is a very serious issue for you. The matter FOR NOW is purely about JURISDICTION. Oko jumbo has approached the SC about clarification on wether the AC ruling on the FHC having JURISDICTION instead of the SHC is indeed correct.

Brother, the SC is going to rule only on jurisdiction too. It has the final word as oga kpata kpata on which court the meat of this case should first be decided on.Expectedly, the SC will agree with the AC that indeed the FHC , not the SHC has jurisdiction to hear the case.The parties will go back to the FHC for a definitive ruling on the main issue. Whichever party doesn't like it now goes to the AC court. If its still not favorable to any party, they have the chance to go the SC where this case finally ends. Should I draw pictures for you

If you think the SC is going to make a definitive statement NOW about the vacancy of their seats then you need to get a bit more informed before you showcase you ignorance proudly to the whole world . The only thing worse than a dunce is a proud dunce!

Till date, NO COURT has made a pronouncement on the vacancy of their seats... not the SHC or FHC and not even the appeal court. Go and look at the CTC.

The underlined in red in your screenshot is purely a ruling on JURISDICTION... that has an effect on the state of things BUT NOT A DEFINITIVE SOLUTION TO THE QUAGMIRE!

The verdict of the HC/AC/SC when the real case is brought up still does not change. It's as easy as ABC the outcome of the judgment.
There may be a way but it's just wishful thinking.

That's the game plan but when the main matter finally starts at the FHC, it is martins and co that will prove to the world why their seats must not be declared vacant as has already been pronounced by edison who was speaker at the time...

I don't rigmarole. The same people who claimed that the FHC does not have jurisdiction but the SHC have now seen the judgment of the Appeal Court.
Is it this same case you people want to take to the SC?
You are the one who went to court , so it's your responsibility to show proof of defection in the FHC where jurisdiction lays and let the judge serve judgment.

All this stalling will not help anyone. I dont even know what is the quorum now of a 3 member SHA. Do you?



It's unfortunate that 90% of you arguing here don't even know what the issue is about.. Oko jumbo has headed to the SC for clarification on JURISDICTION!!!
The substantive suit or meat of the matter I.e the case of wether their seats were rightfully declared vacant HAS NOT STARTED!!!

Supreme Court is NOT FINALISING ON wether they defected or not.. Supreme court is simply going to either agree with or disagree with the appeal court that YES, the state high court DOESNT HAVE THE POWER to declare seats vacant.

Once Supreme Court agrees that with appeal court that state high court doesn't have the power to hear the case... all the parties WILL PROCEEED TO Federal high court to now start discussing the main issue of wether declaring seats vacant was im order.

Are you still confused? It's very straightforward!!!

It is not Amaewhule that will prove that he did not defect . It is those who took him to court will show proof that he actually defected and had right to declare his seat vacant.

Oga, what was the state of things prior to the may 10th ruling? Martins and co were busy making laws parading themselves as lawmakers even though their seats had been declared vacant(an order by the legislative not vacated by any court till date). πŸ˜‚.. that is the status quo we are returning to. Maybe they will find shade under one mango tree to hold plenary, make laws and over ride the governor as usual.. meanwhile the governor is working with assembly members whose seats have not been declared vacant. Its very simple. .. when they tired of making fools of themselves, na them go use their hand go Federal High Court for clarity the same FHC where their affidavits are littered everywhere.

Amaewhule is still the aggrieved "speaker" who is not recognised because he and his cohorts still TILL TODAY have not convinced any court that they didn't defect and should still keep their seats.. they are depending on issues of jurisdiction to still hang in there but it's not possible.

The governor doesn't recognise them so they MUST GET A DEFINITIVE RESOLUTION on the state of their seats..

What was the position of things before the matter was instituted at the SHC I will tell you for free.

1. Justice Omotosho of the FHC recognised Amaewhule as the legitimate Speak of RSHA against the imposter, Edison Ehie and his group of jokers.
2. Edison Ehie as well as this current juvenile assembly members including Oko Jumbo were suspended by Amaewhule even before Omotosho's ruling.
3. The ruling of the FHC (The court with original jurisdiction on the issue) has not been vacated by a superior court.
4. The Court of Appeal nullified the judgement of Justice Wali, stating that it lacks jurisdiction to remove Amaewhule.
What then is the status quo any bellum ?

Besides, Sim is playing no game! Oga is scared and simply playing the victim card. While they are on the issue of jurisdiction at the Supreme Court even when they understand the law, the FHC has already entertained the matter and given a ruling.
Guess what? That ruling is BINDING!


Please go and read the prayers sought in omotosho and the ruling...Neither omotosho or any other judge of the Federal High Court has dealt with the meat of thus matter which is have they defected or not and consequently where the circumstances of declaring their seats vacant IN ORDER?

I ve listened to most senior lawyers on this matter and NONE has agreed this issue was definitively put to rest by any Federal High Court ruling..

I would love to see the CTC of Omotosho's ruling. ...
Remember, that there are lots of cases on this issue including that of Justice okorowo that is still ongoing and hasn't been put to rest.. In that case I'm particular, Martins and co either the PDP deposed to an affidavit that they had left the PDP. They are reluctant to pursue that case because it will sink them.

Look, this matter is far from over. The person who asked those guts to defect didn't do them well and it was due to Wikes delusions of grandeur... his overinflated sense of self importance.
These guys will be embroiled in a plethora of cases till 3 years is up.

Kobo, come on you this thing is not as simple as you are trying to make it out. A document lands on your desk with a minute from the governor asking you to approve a transaction. What do you do?? If youbquestion him he'll simply point at his boss. Of course he knows where all the bodies are buried but his lawyer will get him off the hook easily.

Don't make it a Rivers issue. Its a Nigerian thing. I can bet far worse happens in Lagos state.

it's a multiple page judgement, the appeal court Judges just had to clarify that the state high court has no jurisdiction, go through Martins prayer, mind you Martins did not challenge the jurisdiction of the state high court

If its a win for fubara and his gang, why are they at the supreme court? To what end?

Ehie had resigned. It behoves on the remaining number of house members to chose a new speaker. Remember the 27 others had defected and their seats declared vacant. The cause of the confusion about speakership emanated from the confusing peace aggrement of tinubu.

By right and through normal processes the defecting members should be fighting in court explaining why they defected or didn't defect from the very beginning.

Ehie edison did the right thing constitutionally... the remaining 3 or 4 members are there. You can't throw them away.

Martins was speaker before the high court judgement and he passed 3 bills vetoing the governor, first bill is the local government tenure Elongation bill, second bill is the procurement bill and 3rd bill is the house of assembly civil service commission bill, it will interest you to know that the governor approached the state high court to strike out the LGA tenure Elongation bill and the house of assembly civil service commission bill, if he wasn't speaker according to the governor, why did he approach the court to invalidate those bills? Are you also aware that the governor is obeying the procurement law passed by Martins?

Very good. Now this is what we should discuss. What was the timing of all these? Oko jumbo became speaker on the 8th of May which was the last day Martins and co sat. 10 th of May the wali order was given... so we need to properly define what the state of things were between 8th and 10th of May. That's my view. You see why I said it's a long drawn out case.

There was a long list of prayers ( cant remember all) which included 1. the AC should set aside ruling of the SHC for lack of jurisdiction which they did 2. AC should derecognise oko jumbo 3 pronounce Martins as speaker which the AC refused to grant or talk about as it is the federal high court that should first determine and grant those prayers.

It simply means Martins has a case against the state high court ruling that the appeal court can rightly deliberate on.

Nonsense! The appeal court did not grant Martins any of those prayers as that would be delving into the meat of a matter that should be decided FIRST at the federal high court.. πŸ˜‚
