Politics › Human Rights Violations And Breach Of Contract: Skye Bank, The Nation Newspaper, by Pharoh(op): 6:59pm On Dec 18, 2009
In a novel civil litigation that is bound to test the ability of a US citizen to sue Nigerian-based defendants, Patrick O’ Keke has brought a Nigerian bank-Skye Bank, a Lagos-based newspaper, “The Nation”, and ten “John and Jane Does” to a US court over allegations of breach of contract, interference with contractual relationship, and harassment.  According to the court documents, obtained by Saharareporters, the suit claims stated that on October 30, 2009 Mr. O’Keke signed a contract for the purchase of an advertisement to be printed in the November 2, 2009 issue of “The Nation” for the price of N253, 000.

The advertisement space was to be used for a rejoinder denouncing civil rights abuses in Nigeria, namely incidences wherein the corporate banks love-peddler their female workers in order to secure powerful clientele.  After hearing about a specific case in the Nigerian High Court, where Skye Bank was accused of encouraging a female employee to use her feminine appeal to bait potential wealthy patrons, O’Keke further researched the issue and found it to be widespread.  It is in response to this practice of using prostitution to gain new accounts that O’Keke drafted the rejoinder.  It is also a response to ads that Skye published on two accounts, slandering the plaintiff in the Nigerian trial and her family.  O’Keke felt it was his place as an attorney and a believer in equal rights for women to write the rejoinder.  Similar ads criticizing this practice of prostitution were to be printed in The Nation in the coming months at a discounted price.

Upon hearing of the impending rejoinder, Skye bank allegedly offered The Nation a sum of money to refrain from publishing the piece.  Skye also contacted many other newspapers and publications and paid them to refuse to publish the rejoinder.  John Doe and Jane Doe 1-10 are also suspected to have been hired to threaten the life of Mr. O’Keke if he did not cease attempts to publish the rejoinder, and also to indicate to Mr. O’Keke the power that Skye holds over courts and publications in Nigeria, should they choose to wield it.  When the advert condemning Skye and other Nigerian banks did not run in The Nation, O’Keke contacted the paper and was told that Skye had paid a large sum for it to not be printed.

O’Keke seeks compensatory and punitive damages for financial and emotional distress after having his life threatened repeatedly and as a result, having to continually change his travel and living arrangements.  Further incentive for O’Keke to file a suit arose because in the failure of the rejoinder being published, women all over Nigeria were refused an opportunity for an audience of millions to be made aware of Skye’s civil rights violations.

Because O’Keke is a citizen of the United States and the monetary sum of the allegations exceeds $75,000, the suit has been brought to the United States District Court rather than the Nigerian Court.  Jurisdiction has also been invoked under the Aliens Tort Statute, which allows cases of human rights abuses brought by foreign citizens to be tried in United States courts, even if the abuses took place abroad.

Politics › Re: Updated! Skye Bank Sued For Female Prostitution ( Now In New York) by Pharoh(op): 6:54pm On Dec 18, 2009
It has now taken a new dimension with another suit in New York United States.

When the advert condemning Skye and other Nigerian banks did not run in The Nation, O’Keke contacted the paper and was told that Skye had paid a large sum for it to not be printed.

The issue at hand however, is whether or not the refineries are illegal and whether their operators (not explored youths hired for peanuts)  are criminals. Then answer to that is an emphatic Yes![/quote]There will not be a need for all these arguments if we were practicing true federalism.

Things can't always go right. Time . . time - one thing that never is allowed at Chelsea - is all we have to wait on!

Kalou? . . I can't wait for January for DSanto to return . . though he's gained experience at Blackburn . . Alardyce's style of football could turn the fella in the wrong direction for too long.

In January, Anelka, DiSanto and Borini will lead the way. Kalou should not be allowed to come back from Africa. .  grin

Politics › Reps Investigate Mass Failure In O'levels Exams by Pharoh(op): 4:55pm On Dec 17, 2009
The House of Representatives has asked its committee on education to investigate the mass failure of candidates in the West Africa Examinations Council (WAEC) and National Examinations Council (NECO) assessments recently.

The committee was also asked to provide the House with the yearly record of failure in the two examinations. The decisions followed a motion sponsored by Umaru Kurfi (PDP-Katsina), which was unanimously adopted.

Too much failure

Mr. Kurfi noted the significance of education in the country, but regretted the failure rates in both exams each year, as revealed by some officials of the examination bodies.

The 2009 WAEC results indicate that only 356,981 out of 1,373,009 candidates, representing 25.99 percent, obtained five credits including English Language and Mathematics. This translates into a 75 percent failure rate.

Mr. Kurfi said he was disturbed that "this ugly trend in the nation's most important sector is capable of preventing the realisation of Vision 20-2020, the Millennium Development Goals (MDGs) and the Seven-Point Agenda, if adequate, realistic and sincere measures are not taken."

Mohammed Monguno (ANPP-Borno) said the mass failure is a replica of the decay in the education sector and that the legislators, as representatives of the people, must find out the cause of the problem. He warned that the education of Nigerian children must not be toyed with.

Beni Lar (PDP, Plateau), who said that teachers in her state have been on strike in the last five months, sought an amendment that the committee should report the failure in the examinations to the House every year.

Mohammed Ndume (ANPP, Borno) said a majority of those who failed the examinations are from public schools while most of the candidates that passed are from private ones. "This means that the gap between the rich and the poor will keep widening," he said.

State of emergency

Friday Itulah (PDP, Edo) called on the executive arm of government to declare a state of emergency in the education sector. He said those known to have performed well in government like Dora Akunyili, the information minister, should be redeployed to the ministry of education to rescue the sector.

Samson Osagie (PDP, Edo) complained that though education is on the concurrent list, the difficulty the states are facing in accessing the Universal Basic Education Fund (UBEC) also contributes to the falling standard of education.

Ita Enang (PDP, Akwa Ibom) blamed the mass failure and the falling standard of education on training of teachers and called for the resuscitation of the teachers' training programme in the country.

Others who supported the motion included Abike Dabiri-Erewa (AC, Lagos) and Betty Apiafi (PDP, Rivers). It was unanimously carried when the speaker, Dimeji Bankole, put it to vote.

Remembering Zik

The lawmakers also voted unanimously for a motion urging the federal government to take over and complete the construction of the Zik Centre, Zungeru in Niger State. They also asked the government to rename the centre the Zik Centre for Governance and Legislative Studies when completed. The motion was brought by Bala Adamu Kuta (PDP, Niger) and 17 others.

Mr. Kuta said that, in 1980, the federal government and some individuals initiated an institution at Zungeru, the birth place of Nnamdi Azikiwe ,to be known as the Zik Memorial Centre.

According to him, Mr. Azikiwe, though an Igbo, would always be remembered and respected by all Nigerians and Africans for being "a patriotic politician, an intellectual icon, a statesmen and a great nationalist."

He said the objective of the centre was not only to immortalise the name of Nnamdi Azikiwe but also to appreciate, study and emulate the politician.

Mr. Kuta expressed regret that construction of the centre has been abandoned half way and the structure has now turned out to be an abode for reptiles and hoodlums.

Adding to this, Gozie Agbakoba (PDP, Anambra) also appealed to the federal government to complete the Zik Masouleum, Onitsha.

He said N3.1 million was earmarked for the centre in the 2009 federal budget, but it has not been completed.

This is very good and i hope they also give the Anioma people their own state. I have always advocated that instead of creating states for the people let us dissolve the present states and let everyone propose what they wish so we can create states once and for all.
