Moreover, washington's size has no correlation with the Abuja situation. Abuja is a big ass place. I have been there many times and a Minister and Governor can operate therein without their functions colliding. We have both democrats and republicans holding office in Washington State without hassles. Pramiyal Jayapal of the progressive caucus of the Democratic Party in the US House of Reps represents the good people of Washington State. In total, 8 Democrats and 2 Republicans represent Washington in the US House of Representatives. So why cant the indigenes of Abuja enjoy the same rights since the Supreme Court is set to nullify their special status donated and enshrined in section 134 of the 1999 Constitution ? |
naijapips04:The PEPT may be correct. What we professionals are saying is that there are real life consequences for the affirmance of PEPT's judgment. The framers of Section 134 of the 1999 Constitution are old, wise and considerate military guys who have shed blood to keep Nigeria one. How bad can a President be if he cant get 25% in Abuja?? Is he that hated ? ALL NIGERIANS live in Abuja. It is a melting pot and the symbol of Nigerian unity. A Nigerian President must get 25% there. If that provision must change due to a constitutional interpretation by the Lord Justices on the Supreme Court bench, then the people of Abuja must be accorded their due rights. |
2mch:What are you talking about? Everybody has moved on but we are just analyzing the effects of the precedent of the upcoming judgment. I am tired of you APC guys jaree. And it is a pity most of you are yorubas. We yorubas are supposed to be fair, wise and just but partisanship has done a number on you guys. We are talking about Nigerian constitution but you guys insist on tribal bigotry to destroy the constitution. My own kind of yoruba still cares about the constitution. I dont hate Asiwaju and i wont burn the constitution and destroy Nigeria's Supreme Court because he is a fellow Yoruba man. Things have to be done appropriately for Nigeria to still stand as a united country. You might think you are spiting the igbos but you are destroying Nigeria. Some of us lawyers dont have any other profession and we wont allow Asowaju Tinubu to destroy what we labored almost 8 years to achieve because of one man's ambition. |

Tingotoe:I dont think distance has anything to do with this issue. And we both know Washington DC is located inside Washington State. Washington is one and not two, the size notwithstanding. Likewise, FCT can have a minister while a Governor has and exercises executive powers donated by the constitution and the mandate of the electorates. This is not a difficult issue at all. It is just a constitutional consequence which will flow from the Supreme Court's judgment. |

Fkmodhi:It is a catch 22 situation for the Court. Whatever decision it renders will have real life consequences. Unless they dont want Nigeria to be governed by the 1999 Constitution again. These issues are all interwoven. Judgments are not delivered without deep consideration of its effects on the society. |

Besides, a potential Supreme Court precedent nullifying section 134 is about to strip the territory of its special status. It is only fair to accord them they same right now that they are ordinary like other Nigerians. |

Likewise, the people of other states like Abuja (as per potential Supreme Court judgment) also dont have two heads to be able to elect their Governor while the indigenes of Abuja are deprived of that right. helinues:If the Supreme Court affirms, it does not disturb the Federal Government from appointing an FCT minister for specific areas in Abuja, like Maitama, Wuse and the 3 arms zone. The Governor's purview and mandate will cover the whole state (Abuja). Please research how washington has a mayor D.C and a Governor for the whole Washington state. Heck, even Lagos had a Governor while it was the Federal Capital. It is really not that difficult unless you want to make a caricature of the Supreme Court's judgment. This is constitutional law my brother. Judicial precedents, especially Supreme Court constitutional precedents do have real life effects. This is no joke. I expect the indigenes of Abuja to be preparing with their legal teams. |
Unless the law we practice in Nigeria is not the same with other parts of the world, then the indigenes of Abuja are about to have their own brand new state courtesy of the Nigerian Supreme Court. Broken down for the layman to understand, the judgment of a Supreme Court on a Constitutional provision has the power of law. This is because once a provision of the constitution is interpreted against its textual provision, it means the Supreme Court has nullified that provision and there will be need to amend that section of the Constitution in adherence to the Supreme Court's interpretation. You see, the force of a Supreme Court constitutional precedent is heavy because it changes the public conduct and reliance on the law. There is a difference between a statutory precedent and a constitutional precedent. If the Supreme Court affirms the Court of Appeal (PEPT's) judgement and interpretation of the petitioners' challenge to INEC's violation on section 134 of the Constitution, it means the whole game has changed regarding the status of the FCT. Some APC supporters might say it is impossible to have a President and a Governor in Abuja. If they do so, then their argument will be flawed because the state of Washington in the US has a Governor (Google Jay Inslee) administering the state through the legitimate means of election by the inhabitants of Washington. It is only D.C (District of Columbia) that has a mayor in the person of Mirrel Bowser (I dont know if i got the name right). So, in essence, any affirmance by the Supreme Court of the PEPT's interpretation of the provisions of section 134 should naturally lead to a flood of litigation by the indigenes of Abuja to force the National Assembly to amend the Constitution in line with the Supreme Court's nullification of Section 134 of the 1999 Constitution (As amended). I am very happy that the people of Abuja are about to have their state and acquire the right to elect their own Governor, 3 Senators and 10 House of Reps members under the auspices of a Supreme Court constitutional interpretation which nullifies section 134 of the Constitution. Any other interpretation will mean the judgment of the PEPT will be reversed and the election of February 25th, 2023 nullified for noncompliance with the constitution. If you ask me, any judgment by the Supreme Court is a win-win situation for the Nigerian people. I would however not put it beyond the Supreme Court to affirm the PEPT's judgment and still dismiss any subsequent suit/litigation brought by the indigenes of Abuja for the Court to recognize Abuja as a state in line with its own precedent. I mean, this is Nigeria. If that happens, i will finally accept that Nigeria is a lawless country and that i am in the wrong profession. Nigerians of all walks of life need to acquaint themselves with the Constitution and know the power that a Supreme Court constitutional precedent has on that one binding document. Any other outcome will mean we dont have a constitution in Nigeria. Selah. But for his fellow igbo elites to have kept quiet, it sends a very bad message. It means Nigerians wasted their votes, money and lives for an unworthy man from an unworthy region. Baba niyen....that is the President. He worked and struggled for this position. Not like that igbo sissy (Peter Obi) who deceived young Nigerians to vote for him but he cant convince his fellow Igbo elites to support him to regain his "mandate". Everything will be over by this time tomorrow. |
