Geometrix:But you can only prove non-compliance through calling witnesses from all the polling units disputed which is practically impossible due to time constraint. That is why the evidence Act, Electoral Act and even the Constitution have to be amended to discard of the presumption of regularity of Official acts. INEC has to be completely severed from the litigation process of election petitions and be made mere spectators. The present statutory scheme makes them willing participants in electoral heist by criminal Nigerian politicians. This matter is beyond Obi and even Buhari was a victim of our electoral system--that is why he hates the Judiciary and lawyers (maybe that is partly the reason for his shabby treatment of Osinbajo) generally. In fact, the travails of Buhari at the Courts made him hate educated Nigerians and Christians generally (because they are the most educated in this country. Now is Obi's turn to face the horror of our electoral jurisprudence. |

But on this Court matter, Peter Obi's legal team were unable to prove that there was no substantial compliance with the Electoral Act. The burden in election petitions are quite high because the jurisprudence in that area of law has been that INEC has always been protected by the courts as having "Substantially complied with the extant electoral laws" It is an unfortunate situation and only legislation can remedy the defect of our electoral system, not litigation. |

But i am am a legal person and i know what i am saying given my training and many years of practice. I cant wait for the dismissal of the petition. The Supreme Court will gladly affirm the dismissal of the Court below because Appellate Courts are loathe to set aside or reverse the court of evidence (In this case the Court of Appeal). Obidients will insult the Judiciary tire but on this point, the Judiciary are innocent because Obi did not prove how he won and the other pre-election issues raised have been legally killed by Wole Olanipekun and his team. |

My soul still yearns for Justice because i believe Obi was cheated but the reality is that our Judicial system is weak and corrupt. Also, Bola Tinubu hired the best lawyers in the land and they have delivered for him legally. Any unbiased legal mind can attest to that having read the written addresses and perused the evidence adduced. The bitter truth is that Peter Obi has not proved that he won the election at the tribunal and the cases in court are won by the preponderance and quality adduced. Unfortunately for Peter Obi, he had the burden of proof since he is the petitioner and he has not discharged that burden. Igbo "Obidients" will continue to insult but the law is an ass and it does not pander to emotions. |

I read a part of it this afternoon and i slept off. I will complete it this night sha but this is the end of the road for Obi legally. It was an emotionally torturing journey for Nigerians because the Obidients and Igbos raised the tempo of the elections because, they thought -- and they are right, that it is the turn of Igbos. But Tinubu is just too much of a Tiger for our institutions to handle. The man is too wealthy and he practically bought the election and used his money to hire the best lawyers in the land. Peter Obi should try again in 2027. |

Even though i knew this was the end of the road legally for Peter Obi since i saw Wole Olanipekun's written address, i expected more from Peter Obi's lawyers. While i may be a junior colleague of theirs, i am not happy with the quality of the written address. The address lacks coherence, logical flow and is filled with grammatical errors. I sure will not add that kind of low quality written address to my library. I wont say more than that. We await the just dismissal of the petition. I urge any interested person to compare and contrast the quality of Wole Olanipekun's written address to the filed by Peter Obi's lawyer. Let the difference in logic, flow, clarity and coherence be the decider. I wish Peter Obi well. He has tried but, legally, this is an anticlimax to the expected legal fireworks from his lawyers. I am disappointed. Have a nice weekend everybody. |
I logged in just to respond to this even though i am not married but i am old enough to be married. The answer to your question is the economic stability and the calmness that married men have. I came into some money almost a year ago and i had all the fun i can have with women. I slept with all kinds of women and i had them to my fill. The fact is that women are just criminals who want stability and money. After i depleted my funds on women and pleasure, a lot of the women ran away and i learnt a valuable lesson as a man:Never run out of money and purpose. Once a man has money and a good handwork or profession to take his time, thwen women will be NOTHING to him. The fact is that women are NOTHING without the attention and comfort we men bestow on them. In fact, we are the real prize. Now, i have another tranche of millions in my account and the thought of sex and women irritate me because my money gives me a sense of purpose and a calming effect. I dont tremble at the sight of any women and women can smell a man of substance from a mile away. My advice to young men is to be all about your money and chase that money. Other than the ability to have children, women are useless to a man. They are a drain of resources to us and they distract our focus in life. |
juman:I am not an APC agent. Just being categorical from what i have seen and read from a legal standpoint. The 25% of the FCT point of the petition remains dicey but i want to believe the Supreme Court will use the mischief rule to settle the matter for peace to reign. I dont like APC but i have to succumb and defer to our weak institutions. |
@ gajagojo See bro, me i know Nigerians did not vote for Tinubu after we had suffered for 8 years under Buhari. Nobody can convince me otherwise. As for Buhari, he did not have any choice but to deliver the Presidency to Tinubu even though he does not like him. I just left you win the argument because i dont have strength to argue. But you can never convince me or other sane Nigerians that Tinubu won that election with the legitimacy of Nigerians. The present is the most important thing, let us leave the past behind. Since our institutions are not strong and Nigerians are too disunited to resist tyranny, we will keep managing and those who will die of hunger will die. The poor are the most bigoted and useless anyways. Lets move ahead brother. |

Gajagojo:By design, our laws make it hard for any petitioner to prove electoral irregularities beyond reasonable doubt because there is a presumption of regularity with the official acts or conduct of election by INEC. Also, the electoral Act unfortunately makes INEC a party to election tribunal suits which is very wrong because INEC will do every thing to defend itself, including hoarding critical documents and evidence from any petitioner that wants to overturn an election. Peter Obi won but there was a prior plan to give the presidency to Tinubu and there is nothing anybody can do about it. |

We yorubas that used to be there have left it for the igbos youths to destroy. I have cant for the tribunal to render its decision dismissing the petition. We need rest from all the noise. How can any sane Nigerian believe a Nigerian Court can rule in favor of Peter Obi, an Igbo man? Our judicial is not that strong. |
