A Lagos State High Court sitting in Ikeja has slated March 3, 2015 to rule on an application objecting to the coroner’s inquest into the death of the victims of the September 12, 2014 Synagogue building collapse.
The application was filed before Justice Lateefa Okunnu by the Founder, Synagogue Church of All Nations, Prophet T.B. Joshua.
The prophet had asked Okunnu to determine whether the witness summons served on him to appear before the coroner did not constitute an infringement on his right to fair hearing.
He also contended that the Lagos coroner, Magistrate O.A. Komolafe, had been extending the inquest into areas outside his statutory limit.
Okunnu, on Friday, fixed the ruling date after hearing the reply on point of law filed by Joshua’s lawyer, Chief Lateef Fagbemi (SAN), in response to the submission by Lagos State Government asking Okunnu to dismiss the prophet’s application.
Canvassing his argument in court, Fagbemi insisted that the coroner’s job stopped at the determination of what killed the victims of the building collapse.
He maintained that the coroner had no legal backing to inquire into the possible cause of the building collapse, wherein about 116 victims perished.
He urged Okunnu to stop the coroner’s inquest from becoming “a floodgate for all manners of incursion under the guise of investigation.”
“My Lord, I submit respectfully sir that even in the wider interpretation of the words ‘how’ and ‘manner’, none of those words can accommodate the situation here to allow the coroner to go beyond mere investigation as to the cause of death,” Fagbemi submitted.
He, therefore, urged the court to restrain the coroner from further acting in excess of his jurisdiction, in addition to an order declaring null and void such portion of the coroner’s inquest already conducted in excess of jurisdiction.http://www.punchng.com/news/synagogue-court-to-rule-on-t-b-joshuas-objection/

The re-scheduled arraignment of the alleged kingpin of the April 14, 2014 Nyanya bombing in Abuja, Aminu Ogwuche, and six others before a Federal High Court in Abuja was again stalled on Friday.
Lack of personnel, who would interpret the charges from English to Hausa for some of the accused persons was responsible for the setback at the Friday’s proceedings.
The arraignment had earlier been stalled on February 6, 2015 because some of the accused persons had yet to procure legal services for their defence.
On Friday, Justice Ahmed Mohammed, informed the lawyers of all the parties in the case that the court’s interpreter, Mr. Murtala Abdullahi, had on a compassionate ground travelled to attend to his ailing wife who was critically ill.
“If official language of communication is not understood by the accused persons, then their right to fair hearing will be breached,” he said.
He, however, sought the cooperation of the lawyers so that the case can be treated and determined with dispatch.
“This is a passionate plea for understanding and cooperation,” the judge said.
Responding on behalf of other lawyers, the Ogwuche’s lawyer, Ahmed Raji (SAN), said they had briefly met and had an understanding to work towards the speedy determination of the case.
He added that the defence would not ask for bail for the accused persons in order not to delay the matter.
The terrorism offences the accused persons were charged with are by their nature not ones which the accused are granted bail.
He, therefore asked for an accelerated hearing of the case.
Justice Mohammed then adjourned the matter till March 6.
The other six accused are Akhmad Rufai Abubakar (aka Abu Ibrahim/Maitirare), Mohammed Sani Ishaq, Ya’u Saidu (aka Kofar Rama), Anas Isah, Adamu Yusuf and Nasiru Abubakar.
Meanwhile, the person who allegedly drove the explosive laden Volkswagen Golf car, used for the bombing, Ahmed Rufai Abubakar (aka Dr. Tsiga), was said to be at large.
Another judge of the Federal High Court in Abuja, Justice Adeniyi Ademola, had earlier in November 2014, struck out the charges initially filed against Ogwuche by the police.
The charges filed by police were part of the requirement for extraditing Ogwuche from Sudan, where he allegedly escaped to after the bombing.
But the charges were struck out by Justice Ademola for want of diligent prosecution after the police failed to produce the accused persons in court months after the charges were filed.
The seven accused persons in the newly filed charges are accused of conspiracy, engaging in act of terrorism, belonging to Boko Haram, an outlawed group and refusal to disclose to security agencies, information that would have helped prevented act of terrorism.
Ogwuche was, in count six, accused of rendering supports to a terrorist group by giving money at different times and places in Abuja to the widows of members of the terrorist organisation known as Boko Haram
He and Abubakar (aka Dr. Tsiga) were, in count seven, accused of carrying out “surveillance and identified Silverbird Galleria and other locations as potential targets of terrorist attack.”
The accused persons were said to have committed offences contrary to and punishable under sections 1(2)(a) &(b), 5(b),8(b) 16, 17 of the Terrorism Prevention (Amendment) Act 2013.

The House of Representatives may ban the use of Hiace buses for commercial transportation pending the outcome of an investigation into the road worthiness of the buses.Following incidence of incessant accidents associated with such buses in the country. The House of Reps on February 19, Thursday, mandated its Committee on Land Transport to investigate the use of Hiace buses for commercial transportation.The investigation became imperative after an accident involving 11 female supporters of Nigeria’s first lady, Dame Patience Jonathan who lost their lives in a ghastly auto crash thatoccurred on Saturday night, February 14.

According to Premium Times, Honorable Stella Dorgu (Bayelsa-PDP), who moved the motion raised the concern that many buses often burst into flames in the event of accident resulting in deaths.

The law maker cited the recent road accident in Bayelsa that led to the death of some prominent female politicians from the state to buttress her point.

She said that the politicians were burnt to death when their vehicles were involved in multiple crashes on the East-West road, Ahoada, Rivers.

“The road, which is under construction, has claimed the lives of many Nigerians on various occasions including Mrs. Imari Oba (mother of First Lady, Patience Jonathan) on July 23, 2013.

‘’Unnamed women and children burnt beyond recognition on 15 Nov. 15, 2013 and seven other Nigerians were killed in another vehicle crash on the road on Dec. 26, 2013.”It would be recalled that Governor of Bayelsa State, Seriake Dickson, has said that a mass burial will be conductedfor deceased female politicians. The decision was reached with the families of the dead because the corpses were burnt beyond recognition.

An undisclosed number of inmates on Friday gained entry into the armory of the Calabar Prison , Cross River State, and attempted to escape after a gun duel but were overpowered by a combined team of security agents.
The incident, which occurred at about 11am, was said to have caused pandemonium as residents of neighbouring Afokang, Iman and Jebbs in Calabar South axis of the metropolis scampered to safety during the gun duel.
The Afokang end of the prison fence was broken during the process while two inmates were said to have escaped, but the state controller of prisons, Mr. Clement Udosen, said no inmate escaped.
It was, however, not clear how the inmates gained access to the armory, but it was learnt that a total of 53 rifles were recovered after the incident while one could not be accounted for.
The prison armed squad was said to have been overpowered but they immediately called for reinforcement and the situation was brought under control after 40 minutes of gun duel with the inmates.
An anonymous prison official said about 17 hardened criminals consisting kidnappers, drug barons, ex-militants and armed robbers were brought to the prison two weeks ago.
He said their arrival sent an alert that something untoward might happen.
An eyewitness, Solomon Okoro, said two of the inmates escaped through the broken fence but one of them was apprehended by vigilant youths in the neighbouring Afokang Street while the other escaped.
Okoro said, “We heard gun shots at about 11am. Although gun shots within the prison yard is not new to us, but this time it lasted for a long time. That was how we got to know that there was problem. We stopped hearing the shots and that was when the reinforced team started coming.
“We learnt the inmates exhausted their bullets. At the end of which, the wall was broken, two escaped but one was apprehended by some community youths.”
Reacting to the development, the state Controller of the Cross River State Command of the Nigeria Prisons Service, Mr. Clement Udosen, said no inmate escaped, confirming that they actually got access to the armoury.
He said, “By 11 o’clock in the morning, I was in my office in the headquarters, the DC in charge of this prison called me that there was serious problem in the yard so I came and the whole place was filled with people with rifles, people who had come here to help us, the soldiers, police, civil defence, state security service and others.
“Two of the cells’ inmates organized themselves and overpowered the prison staff and rushed to where we have the armoury, seized the rifles there and went back firing at the staff. In that confusion they broke other cells and the whole yard was filled with inmates. They carried what they could get to break the fence.
“Luckily for now they have all been rounded up and nobody has escaped. A lot of people have been injured and one staff had been rushed to the hospital. Right now the doctors with his team are treating those injured. On casualties (deaths), it is the doctor that would ascertain that because he is treating them.”
“Most of those injured are the inmates. Three of our staff were wounded and one rushed to the hospital. There was no external invasion. It was an attempted jailbreak and luckily nobody escaped. The other security agencies helped us especially the 13th Brigade of the Nigerian Army because they stationed 10 solders here, morning and night and these are the ones that really helped us. Awka- CHAIRMAN of Ohaneze Ndigbo Elders Advisory Committee and first republic minister, Chief Mmabazulike Amechi yesterday directed Igbo electorate to vote according to their individual choice because Ndigbo have no preferred presidential candidate for the March 28, 2015 general elections.
Addressing reporters at his Ukpor, Nnewi South local government area country home, Amechi, who is among Igbo elders challenging the adoption of President Goodluck Jonathan by Chief Enwo Igariwei –led Ohaneze Ndigbo, said the advice to Igbo voters was because the two leading presidential candidates, Jonathan of PDP and General Muhammadu Buhari of APC, have failed to reckon with the Igbo nation.

He said: “The caretaker committee of Ohaneze Ndigbo has issued an advice to Igbo voters everywhere to vote according to their individual conscience. This is because none of the two principle Presidential candidates has come to discuss the four cardinal issues so fundamental to the interest of Ndigbo.
“These are security for Ndigbo and their properties during and after the election particularly in the North; the callous neglect of Igbo territory since the end of the civil war; reparation for atrocities committed against Ndigbo over the years and during the civil war; and implementation of the recommendations of the Justice Oputa panel.
“Apart from the four cardinal issues, there are other vital aspects of government and governance which should have been discussed before Ndigbo would be committed wholesale into one basket of support for one candidate or other.
“As at this moment, the Presidency is headed by the South-South; the judiciary is headed by a Northerner; the two arms of the legislature are headed by Northerners; the Armed Forces and security agencies are headed by Northerners and non-Igbo.
“There is no Igbo in any of these arms of government in a federation that should reflect true federal character according to constitution. These are issues that ought to have been discussed with the presidential candidates.
“If Jonathan is re-elected in the forth-coming election, his Vice will be a Northerner; if Buhari is elected, his Vice will be a Westerner of Yoruba origin.
“Ideally, Ndigbo should extract an agreement with one or both Presidential candidates and their political parties that at least the next legislature should be headed by an Igbo.
“These vital issues and the position of Ndigbo in a federation like Nigeria is what the elders and leaders, patriotic leaders, of Ndigbo insist must be discussed with the presidential candidates.”
He accused some Igbo leaders of trading the fortunes of the people by allegedly receiving gratifications to commit the whole Igbo voters to one particular presidential candidate without any bargain for the good and future of Igbo land.
“History and posterity will not be kind to those who trade away the great Igbo nation and her future for Naira and Dollar,” the elder statesman said.
Amechi also spoke on the ongoing political campaigns, especially between the two leading political parties, saying “if there is an occasion on which we need fervent prayers and God’s merciful intervention in Nigeria, it is now.”
He said further: “The country is moving in a wobbly track which could easily lead to a precipice. There had been great tension in the country which has been aggravated by the postponement and change in the previously scheduled dates for the election, particularly the presidential election.
The bitter tone and low level of the presidential campaigns by the two major political parties gives great cause for concern. It is known that in Nigeria losers hardly accept defeat.
“With the body language of the presidential candidates and their backers and chop chop followers, coupled with the bungling of the INEC, I shudder at what will be the security situation in the country when one candidate or the other is declared winner.
“If anything goes seriously wrong, the Independent National Electoral Commission, INEC, shall be held responsible. The commission had four good years to prepare for the elections and the National Assembly gave them all the funds they requested for the election.
“The presidency also has its own share of the blame because being responsible for security and its inability to guarantee security for the election personnel, materials and observers; it has a big share of responsibility for any unwholesome development.”
