i think that all depends if your sponsoring your own stay or if you have family in UK who is sponsoring you.

My hubbys uncle lives here in the UK and he always sponsors his sister and she dont work, she always gets the visa.

cant you just book any free cancellation booking on www.booking.com?
and then just add the confirmed reservation?

then post it to them asap, with your application reference hoping they will pick it up before a decision is made.

I use that site all the time, but make sure you get one is free cancellation up until 24 hours before check in smiley

Firstly, driving without insurance is a big offence in the UK, the implications of which is only felt when you do get into a road traffic collision. You shouldn't have done this. Secondly, why did you not renew your student visa on time?!

Thirdly, if your wife is British, why have the both of you not taking advantage of the Surinder Singh immigration loophole?!

You really need to be speaking to a good immigration solicitor. I think your options are to either utilize the Surinder Singh loophole by emigrating to Ireland and living for a minimum of 3 months, or go back to Nigeria and apply for a Spouse visa. If you choose the latter option, be prepared for a long battle with the UKBA before you get the Spouse visa based on your previous offences. If I were in your shoes, I will be doing some research into the Surinder Singh route.

Can i point out that a EU citizen has to be working (not just living) 12 weeks and 1 day from the date their spouse is in the EU state with them in which the Brit or other EU state member are exercising their treaty rights.

its taking on average of about 5-6 months from entry to the 5yr Family permit, if my husband doesn't get his spouse visa i will be going to Ireland ...or Malta both of which is English speaking smiley

Ireland immigration is not as tough as UK's? Oh wow... well, it's never too late to kick-start that relocation plan. .. if your mind is made up, then go ahead.. but just hand in there a little and hope for the best outcome of your hubby's visa... I believe it will end in praise.
Am as anxious as well... am just trying to get my mind off it and have other things occupy my mind...pleasant things that is... this distance is killing me..

Southern Ireland (ROI) is under Irish/EU law not UK, so the Surinder Singh option can be done via Ireland, thats why i mentioned it since its closest to UK and i could drive there on a ferry smiley

Im saving for it just in case, no matter how prepared you try to be, no one can ever predict the immigration, lets just pray we all get a nice puppet handling our applications and a decicion is made grin

I'm already looking into relocating to Ireland and how i go about it, even if hubby gets his visa i will talk to him as will be nice to eventually both settle somewhere different.

i guess I'm also looking into a back up plan, as I know the UK immigration are very tough and refuse on minimal things sometimes.

I wish i knew about this last September when i was made redundant, it would have saved so much hassle as i was living with my father no debts lol, had savings which was well enough to start up home in say Ireland.

I am just worried and anxious to the point im not even sleeping sad

Nope nothing yet I know Sheffield has received my docs they signed for them at 6.22am this morning

But the TLS is still at Transferred for Decision mode, so maybe they still waiting for hubby's passport etc to state its received by UKVI

Please @Justwise and other gurus... what does it mean when you get a mail saying Unfortunately, the processing of your application has been non-straightforward and we have been unable to resolve your application within these customer service targets.
Does this mean the visa will be refused at the long run? Please anyone ever gotten this and still granted visa? I need any glimmer of hope now am so worried getting this email.... I applied for EEA family permit visa

Please dont panic this is a standard email they send if they wont be able to process your application within the specified time.

Ive seen other EEA applicants receive this email too

We didn't put my sponsor a letter of employment stating his salary etc even though we got a letter stating he is employed with them 2.and we only submitted 2 months payslip of his second job. they said we met all other requirements. Just those two evidence was d reason we were denied. Justwise and other gurus, pls advice and appealing and reapplying at d same time.

I'm surprised they didn't just ask you to send the additional information

Think it depends on you and your partner, an appeal can take anything from 6-9 months if you can afford to then you have the choice to do either.

i did manage to locate on the UK site it was $1501 so I knew to expect higher fees but definitely needs to be stated--- misrepresentation i say

what where their reasons for refusal, I have seen many couples supplying everything and yet still get refused, I would appeal as i couldn't afford the fees to reapply unless i decided to relocate to Ireland but that's really something I dont want to do as I look after my elderly and disabled father here in the UK

Dont give up, fight, it will be a long wait but in the end worth it smiley hugs xx

@ Jangolo, yes, that's wat i paid for NHS too and applications fee too is £956, NHS £600. Still waiting but applied in Sept 15 if u wanna pay for Priority Service it's £360.

Thats not the actual fees because you have to take into account its in US Dollars so exchange rates then non stirling transaction fees, If you paid in Naira I am sure all banks charge for non home currency fees.

my charges are:

Visa application in £987.89 plus non sterling fee of £27.17 making it a total of £1015.06

the IHS NHS fee: £619.98 plus non sterling fee of £17.05 making it a total of £637.03

The immigration should really make this clear when noting fees, it was just as well my credit card had such a high limit to process both tongue

so both of these I paid £1652.09

This may be of interest, one of the ladies on the FB forum ' I love my foreign Spouse: defend the rights of cross-border couples' done a priority service and still waited 4 weeks and got a decision after that of a woman who done normal service the same time, their Husbands were both from Turkey.

I wouldn't waste the extra money, to me thats my husbands flight money smiley

I think it would be easier to obtain in the UK, as I was able to get all mine for our communication evidence without any issues here in UK, however hubby couldn't get his either, but I use Rebtel to call him which i printed the full itemised call history right back from July 2014 until today, printed whatsapp and Facebook history too.

As far as you know, how strict UK Home Office is when someone stays in the UK longer than declared in the Visa Application Form?
Basically, my wife is going to apply for a Tier 2 Dependant Visa, but on the last Visa she had (Standard Visitor) she declared she would have stayed for 5 days, but instead she stayed in the UK for a month.
Do you think UK Home Office could make any problems beacuse of this?

She is only classed as an overstayer if she stayed beyond the validilty of the visa so if its for example a 6 month visa and she stayed just for 1 month within that visa period that is fine, even if she stated she wanted to stay for 5 days, many people extend vacations smiley

1. the online application form the part where they ask family details is it my hubby details i will fill there or mine. (hubby is my sponsor)
you fill it in as your families details, i.e partner is your husband and his name etc, then your father and your mother's details, and if either of you have children

2. the financial requirement from, the part 4 am i suppose to answer it since hubby is not exempted from 18,600pounds
you leave this blank if it does not apply to you, e.g I meet the minimum salary requirements based on employment, so left parts 3B, C,D,E, F and part 4 as i only needed to fill the section relevant to me which was 3A, hope this helps, I am the sponsor but i filled hubby's form smiley

im sure appeals can take 6-9 months ( i had to appeal my ex husbands in November 2008 went to the tribunal in Twickenham after marrying in dec 2007) so was another year before he was granted the visa, im not sure if its the same process but i am aware it takes bwtween the time frame i stated.

i hope this helps, and keep fighting you will get there and the wait will be worth it in the end smiley

Don't send ur original passport but u can make photocopy of ur passport with the data page and all the visa in it and also the entry stamp to Nigeria. Also u can send ur supporting documents the same day ur hubby went for biometric cos biometric gets to Sheffield second day it was taken and also urs will get there around the same time.

Hi Karen,

1. No, you don't fill out the appendix 2 form online, it's a hard copy

2. He will submit both the printed online filled out application form and the appendix 2 hand filled out form when he goes for biometrics. As well as the TB test certificate. I didn't do the English test so I don't know where that is submitted.

3. My hubby added a copy of the application form when he was sending supporting documents to Sheffield and a copy of the TB test certificate but he didn't send the appendix 2 form again. You can add it if it makes you more comfortable.

application is completed online, my husband has his biometrics on Friday this week.

1. the appendix 2 form who sends this, me or my husband? I did fill one out and left it with him luckily when i was there last month.
i thought we would actually have to fill this online along with the visa application.

2. when hubby goes to his biometrics, he has his application form, and email confirmations, and payment emails for both the visa and IHS NHS fees
does the VAC send this along with his passport as on the form https://uk.tlscontact.com/ng/LGV/res/upload/ukvi-uk/West_africa-settlement.pdf it states:

@Portsmouth86, the very day I went for my Biometrics I got two emails from TLS, the first two thingy turned green. First mail said my application has been received....second mail said my application was on its way to UKVI...The following day, 3rd of November, got another mail saying my application has been received by UkVI.
On the 4th I got a call from them for a short interview..hubby was also called same day.
I think mine was that fast cos it's an EEA family permit visa I applied for. No NHS nor visa fee.

ahh ok then maybe it will turn green once hubby done his biometrics then, was worried lol

cant wait now im impatient i bet ill keep checking it haha smiley

I work nights so if they want to call me hope they get me on a day off but will of course keep my phone on loud lol

I never tracked it on TLS, I relied on the emails from TLS and Sheffield. So I cannot say how long it takes to turn green. Truth is, I didn't even know anything turned green anywhere smiley grin

Hahaha, no sleep until I have my visa!
I applied on Monday, 2nd of November. Am joining hubby in the UK. I was called on the phone for a brief interview, hubby as well, ... so we are waiting for their decision. Hubby is in Nigeria at the moment, but we are heading to the airport right about now for his flight back to the UK.
Can't wait to join him soon.

Yes this is what i meant, as yjb85 queried.

It's not necessary however I've chosen to add it to mine, after reading that some visa centres look out for it even if its a spouse visa, I am covering all grounds where possible lool smiley

Portsmouth86 you will send your own bundle of documents to Sheffield while your hubby submit the application form, TB and English test in Nigeria.

Maintenance documents are things like bank statement and payslips

God knows what this woman is on about then on the FB group 'I love my foreign spouse then'

That's made me less stressed, at least we have a set way the file needs to be in so I'm putting it in that order tonight smiley

I have seen a screenshot of someone's email from Sheffield.

It states your 'sponsor' needs to send all the supporting documents, ie English test .... I thought hubby submits it on his appointment after he applies online? ( As in the certificates, English and TB?)

Who posts this to Sheffield?
This person hubby had to send it himself to Sheffield while the VAC just wanted his passport and applications

Worried now as that's time to post here ...I have got a copy in my files in case it went missing.

Also what is maintenance document?

That figure is not actually bad, just getting time off work is my problem because my boss will not give me early Xmas off.

really gutted as I wanted to spend Xmas in Nigeria this year, the last I did that was 2008 and I paid £700 for ticket then because I traveled on 29th of December

Oh no, dumb bosses eh, I would imagine it will be around the same price though as the dates i checked was about 12 weeks after Apho's visa application (seeing if I should go out and come back with him lol, i just have to think i need extra £300 for my visa sad )
