Interpretation is different from making decisions for them. CBN and federal government didn't actually violate its own CBN acts and guidelines on legal tender change. They followed all the due process and timeline stated in the CBN act. I will quote you when the SC sends this case to the dustbin. The ruling of the court was an order of interim injunction, and not the main substance. The case would be heared on 15th, and I hope it's decided on that day without any form of adjournment.
@ emboldened is the disputed part

Cbn doesn't have its own guidelines, it was established by the legislative arm of governmnent.

You dont need to quote me.I am not bothered about the correctness of the case but the intendment.it is intended to keep on hold the naira swap till after the polls and they will succeed
That's my fear! Those useless SC justices might adjourn the case for another day, probably after the election.
I don't want parties throwing money up and down in the name of vote buying. I just want free and fair election.

Nothing is being disputed here! CBN has an act which was legislated by the legislature and co signed by the executive, which now makes it a law. What the legislature can do now is to further amend that act, otherwise, the act would still subsist. It just like saying because legislature made an electoral act, then it's no longer a law. Once a legislation is made, and signed by the executive, it has become a biding law, except it's amended by the same legislature and signed by the executive.

Judiciary don't make laws, they only interprete it.

The legislative arm of government makes laws.

Sorry! I actually meant the legislative arm. CBN has its own act, just like INEC, and they followed all the guidelines.

And only new guidelines issued by the legislature can change it. Definitely not the Supreme Court.

The supreme court will interprete the guildline set by the legislature, they don't change anything.

CBN guildline can not go against the law setting it up, otherwise it will be deemed unconstitutional by the judiciary.

For example, if the law setting up CBN states that it can't reject and money it already approved as legal tender through the Executive but it then sets a guildline that is against that law, the guildline will be deemed unconstitutional by the judiciary.

That's why this case is in the court.

Everything I said in my post reechoed here.

Supreme Court has no jurisdiction over this case. If the plaintiffs were serious, they know that the right place to institute the case is at the High Court.

What the lawyers of Kaduna, Kogi and Zamfara have done is abuse of court process.

Jurisdiction is a threshold issue. The court will definitely dismiss the suit.

The court will hear the case on 15th February and adjourn for response of the prosecution to the submission of the respondent till February ending. Finally, judgement will be entered March ending. By then, even the CBN will no longer be interested in the Naira redesign as the political gain they intend to achieve would have been defeated. For now, old and new notes remains legal tender till February 15th.

An interim order last only for 7 days. The adjourned date of 15th February is for hearing of the motion on notice and not the substantive suit, which could either vacate the order made today or extend it. However , If we are to interpret the law strictly, Supreme court does not have the original jurisdiction to entertain a matter between AG States and CBN, that's an abuse of Court process.

You can see that the judgement by the Supreme Court is null and void on CBN and they are still sticking with the old deadline.

It is what it is.

The authority being claimed by CBN was derived from the Constitution and can only be interpreted by a law Court. The Supreme Court being the Apex court in Country its decision is final.

Exclusive list seized the moment rights, well-being and peace of the Nigerian people is at risk or affected. The Supreme Court has a duty to prevent anarchy and unwarranted civil unrest in the country.

For the Federal Government preliminary objection and any other pleadings can only be heard by the Supreme Court only if the Federal Government obey it's earlier order.

So 10th of February deadline is no more in the picture. FINITO

The Supreme Court has original jurisdiction in any dispute between the Federation and a state or between states and also has appellate jurisdiction to hear and determine appeals from the Court of Appeal.

The dispute between different branches of the executive can be taken straight to the supreme court even in developed countries like America.

The Row vs Wade repeal

The Affirmative action repeal case still going on

If the action is deemed unconstitutional by the supreme court, it's reversed immediately.

We are talking about monetary policy here. The jurisdiction of the Supreme Court, as decided by several precedents, cannot interfere in the economic policy of the government.

The AGF is wasting his time. This matter don tie wrapper. Nyesom Wike is dragging Rivers state into the case by early next week with different set of prayers like arrest of the CBN Governor for contravening the CBN act, then the supreme court will have to shift the Feb 15 deadline because other states like Lagos, Jigawa, Cross River and many more grin will be lining up to join the suit with their own prayers. Before the Supreme court hears the substantive suit, Bola Tinubu the Jagaban would have been sworn in as the next President of Nigeria and Commander in chief of the armed forces.

The case will drag into next month before the supreme court will be able to deliver it's interpretation because the agf has not said anything to solve what is on ground.
Well on the 15th the supreme court will let us know wether it has jurisdiction or not!

Interestingly, the governors are alive in challenging the president but this same governors refused to take FG to court for allowing the citizens of their state get killed on a daily basis by bandits!
Same governors hands got tied when students stayed at home for more than 7 months and didn't take PMB and education minister to court!
Nigerians now know where the priorities of most of the apc governors including their paymasters lie!

I just pray this naira issue don't lead to something disastrous . Right now I can still see people selling small goods like food items collecting old notes because buyers don't have access to new one and aged people don't have accounts and understanding of money transfer. If the deadline is 10th really I see serious riot across most parts of the country and I'm afraid it will be brutal
