Even if they are 30 ,you must get 25% as ascribed in the constitution or there will be run off between the 3 runner ups

When you are writing an exam and the examiner ask you to answer question 1 and any other 4 what does it mean?.
If you don't answer question 1 and answer the remaining 4,it means you are wasting your time.

The problem with INEC is that they don't listen, two highly respected legal personality in the country Mike and Olisa had told them ahead of time about the 25% issue but they kept mute, now the matter is before the court, less see how they would go about this.


INEC is not a Court of Law to give any opinion or comment on 25% issue. The Court of Law is the right place to interpret that. The two senior Lawyers should know better and they should have approached the Court for interpretation instead of writing to INEC.

25% is not perculiar to FCT. It was included just as a state being a federal Capital Territory. Tinubu met the required percentage. He didn't get 25% in Anambra n some other places too

The 36 States and FCT is a list of items . If you have a list of two or more items in English, the last comma is removed and replaced with the conjunction AND.

Example;

-3 States of the Federation and the FCT have declared Friday as public holidays.

Can also be written as below;

- The States of Lagos, Oyo, Ogun and the FCT have declared Friday as public holidays.

Or

The FCT and the States of Lagos, Ogun and Oyo have declared Friday as public holiday.

Other examples

- Please buy bread,milk and cheese.

To list out the 36 states one after the other by their names is absurd when those feature in multiple places in the constitution. Also a list can be arranged anyhow and does not need to have a form. The constitution could list the states Alphabetically starting with Abia,....and Zamfara where FCT would be listed under F. Would this mean someone also has to get 25% in Zamfara or they are not duly elected?

I say it again. Any SAN bringing such up is nothing but deluded and need to return back to English classes. These are beer parlour arguments not fit for a court of law. If i were to be the Judge to preside over this. Would ask the petitioners to go stand under the sun for 1 hour for waste of my time.

Even in Legal perspective, the concept of FCT being more equal than other states alone throws away the basic tenents of the Nigerian constitution and citizens rights that states that all Nigerians are equal and have equal rights to freedom of association and religion. Any SAN with common sense should know this but it's not unusual that we like to chase shawdows when we should be focusing on more productive things.

If it’s a state like you said why isn’t it having it’s own house of assembly and Governorship rights. ? I think there’s a reason why it’s called the nation’s Capital

you just nailed it with Thor's hammer. FCT is a territory carved out from different state therefore you cannot allocate a 25% requirement on it as it would be a dublication. The thinking of the constitution is that you can use the FCT as a state if you lack the ⅔ requirement. It is in the reading of the statement that misinterpretation comes in. It should be read ⅔ in the 36 states (and the FCT) which means that the FCT is optional. The word and the FCT means the FCT is secondary, and not necessary but can aid in achieving the required result.
PS
Just like when Lagos state was the capital, then we had Ikeja as the seat of Lagos state government and Lagos Island as the seat of FG. Therefore can we then say one would have required 25% in Lagos as a state and another 25% in Lagos Island which was a federal Territory then? That would be absurd.

I understand you guys obsession with questioning everything but even the SANs know this is plain and they are just grasping at straws here especially when there was a precedent that the Supreme court already decided on in 2003. I have an overview but don't have the full ruling as law union as archived it and requesting subscription for me to access.

I am not too sure of the full details of the case but it seemed the Presidential elections in Ogun State in 2003 was cancelled or so due to irregularities. And Ogun was one of the states Obasanjo was counting onfor fulfilling the 2/3rd of 36 States and FCT requirements. With Ogun cancelled, it meant OBJ had only 23 states and the FCT. Buhari went to court to state that since he now only had 25% in 23 states, it meant he didn't meet the requirement for spread and therefore the election should be annulled.

Court rulling was that FCT based on Section 299 should be considered a state and based on that OBJ still satisfies the requirements.

I am not 💯 sure on the wordings. We really don't keep online records well in this country so articles on the judgement is so scarce to cite but would look into archive.org if i can get a copy.

Let's even for the sake of argument say that the constitution recognise FCT as a state , the AND on it's own is a conjunction. It says whatever else you might have achieved in the election you need to obtain 25% vote cast in FCT. Whether FCT is a state or Capital Territory is, for the purpose of the conjunctive clause, immaterial.

I see no way out for Tinubu in the case, unless there is a miscarriage of justice.
