Well, your former company not acknowledging the letter is no ground for them to stop your pay regardless of whether you resigned formally or not.
Even most letters from pension companies state that the pension company will pay the employee, if the company doesn't reply the mail btw 2 weeks.
Go drag the pension company

It's very simple. Look fr a small company n claim you are now working there. Get ur own money n prepare pension n send to them. The new company becomes ur last employed company. Ur pension firm will now send letter to this new company no more the former place that have refused to reply the letter

The simple thing to do is get another employment , even if it's with a family member and then start contributing again

This happened to my friend some years back, exactly the same scenario, truth is they just want to punish you, they have no right not to reply. We wrote a strong warning letter to the company threatening that if the letter is not replied we will take them to court, copied the pension office, pencom, consumer protection, NLC, TUC etc. next thing you know, they replied stating some flimsy terms. Before two weeks they replied

I’m going through a similar scenario. I resigned from my former company about nine years ago. When I did all my records were correct, i.e., name, age, etc., at the time my former company handed over my pension account to the pension provider. I’d been getting regular updates as per my statements and all.

A few years ago, I noticed they had inverted my date of birth, swapping the date for the month, I didn't think anything of this and knew I was going to deal with it when the time came, all that mattered to me at that time was monitoring my funds.

Then I observed they had changed my birth year to 2000. By the way, I’m in my late forties and have been working since the early 2000s. I also noticed they had screwed up my first name, omitting a letter.

Last December, I lost my job and early this month I thought about withdrawing 25% of my savings (as per the pencom law). So I visited their (pension provider’s) website to update my details. I was asked to produce a birth certificate, NIN, and a letter from my former employer confirming my age. I produced the first two believing it was enough to prove both my age (and first name), well, guess what, they rejected the request to have my details updated, claiming that they needed an employer to confirm my age. After a back and forth and cussing under my breath, they told me that the NIN and birth certificate were enough to update my first name but not my age, for that they still needed a letter from an employer confirming my age. I mean, who would need an employer to confirm anyone’s age?

I have heard stories about how corrupt these pension providers are. That's what I think is going on.

Go and submit your resignation letter. Apologize for leaving without a lieu of notice. Let them know you'll make the payment suggested by law for such action. My opinion

Its not a must that your company will respond/reply!

The essence of the letter is to confirm that they actually paid your pension up to the last month you left. But the PFA normally would proceed with the payment after 5 working days without a reply from your former employer.

If the PFA is still delaying with this process, do your data recapture and port out to another PFA . Then start the process afresh after 4 months.

Mine is quite similar to yours. My own case was mismanagement of money. I was arrested, they even sued me. But as God will have it, I won the case in court. But after then, I went my way. They neva sent me any sack letter to this day. I was removed from the group on whatsapp, all my data cleaned off from the system. Now I can't access my 25% money in my pension account. The surprising thing is that, they Re still paying into my pension account.

What of if the company said she went with office property? Anyway, it depends on the job role..A policeman, soldier or banker can't abscond from duty without declaring him or her wanted.

The fault is yours then. If you can still write a resignation letter now do it , but it will delay the money for another 4months. The law cites 4months as the minimum period after quitting job for you to be eligible for the 25%

You did not resign, you a absconded. You're very wrong. I went to the UK on holiday to spend time with my family and I was working remotely for the Financial Institution I was working for (for 6 weeks). But then, I decided to stay back with my family and I did the proper thing by resigning and I saved the email acknowledgement of my resignation.

I started processing my 25% later November 2023 and I got it paid some 5 weeks later.

You see, there is what is called goodwill. No matter how frustrated you were with the organisation, you shouldn't have left the way you did. An employment is a contract and your former organisation can use you for breach of contract.

Talk to a lawyer.

One of the requirements to access your 25 percent is letter of termination or resignation letter. And you wait 4 months before applying. Your not resigning is a very bad decision.
So you have to do the needful by going back to your former employer and regularize your resignation, otherwise you are on your own.

Better go and beg the managing.director or the HRM of the company to treat your matter companssionately

You have lost your benefit. You cannot win. By what is written here, you did not notify them of your resignations; you did not even resign; you absconded.

Take them to court, and they are definitely going to win on the grounds that your immediate replacement cost them.

it is required under pension act that before you can access your 25% you must show evidence of disengagement from job. So, since you didnt resign, you absconded from your job. you should sweet talk to the HR and Manager by begging them to give you disengagement/termination letter. If there is handover you supposed to do, you have to ask them to let you do it now. You have to beg, beg and beg until they do the needful. if it involves, you have to do it. next time, resign properly.

If after all begging they still refused. you have meet human right lawyer, or consumer commission or public complaints for assistance

You are here calling people wicked buy you left a company without giving notice….it’s that not wickedness as well? Do you not realize the disruption you cause when you leave without notice? You didn’t care so why should they care about you?

If I were HR, I wouldn’t answer you just as you didn’t show any concern for me and made my job difficult when you left. You don’t deserve it. I will make you spend the value of the pension on lawyer fees so serve as a deterrent to others.

Now you will reap your rewards. Best check your employment contract.

To others, the reason why you give notice is to give your employers time to adjust to life without you and prevent disruptions, find a replacement. You may void your contract and any obligations the company has to you if you do not follow procedures.

You can still get your termination letter or acceptance of your resignation. since the matter is settle via police intervention, first go to the company and demand for termination letter or acceptance of your resignation. but if they refused, you can go to police to reopen your case file.

Let people be careful, if your job is pensionable under contributory pension scheme, never joke with your job and always collect termination letter or your company give you letter accepting your resignation.

I have noticed that all these pension companies are always looking for loopholes they can use to sit on people's money.

No gree for them.

The following facts need to be understood:

1) the money in your pension account belongs to you not your employer.

2) the pension company does not need any authorization from your former employer to pay you whatever amount you are entitled to.

3) as far as I am concern, how you left your former place of work is none of the business of your pension company. They already have your letter of employment. What they need now is some proof that you are no longer working there.

4) if for some reasons, your former employer refuse to cooperate and give you the letters your PFA needs, the PFA is meant to contact your former employer to get information about your employment status with them. They can only refuse to pay you the money if your former employer can show evidence that you are still their staff; which means they must show evidence that they are still paying you salary and remitting your pension contribution up to date.

If your former employer fail to produce evidence that you are still their staff and the PFA refuse to pay you your pension money get a good lawyer and sue the pension company.

Alternatively you can look for job in another company that do pension contribution, work for some months and make sure you notify your PFA about your new company let them change your employers name to the name of your new employer. After some months you can officially resign and make sure the new company acknowledge receipt of your resignation letter and give you letter of acceptance of resignation.

It means you abandoned the job.Anyway,you can still look for a way to go back there.Its only your 3 months payslip that you need from them to access your 25%.You also need a letter of either restructuring or reducdancy.The other ones are your nepa bills,either NIN or BVN.If you succeed with your former company,please don't do programme withdrawals on your pension.Instead do Annuity programme.Dont say I didn't inform you.I know much about their tricks.

I don't know where ppl learn all these silly manners.

No matter what, if you're tired of your job, terminate the contract normally. Send appreciation letter to the firm even when you have no reason to thank them.
Submit every of their property to then and collect all your entitlements and leave, especially if you are still at employable age or you have interest in politics.

Another one is, don't leave any bank account you no longer wish to operate without officially closing it.
Two things can happen. Fraudsters can hijack it. You'll be responsible to explain to police what happened if anything goes wrong.

Secondly, the bank may still be debiting you those small small SMS charge and maintenance fees. This may accumulate to a huge debt. If you apply for a loan in any bank and they use your BVN to verify you, they may notice that your indebtedness in that you inactive bank account and reject to grant your loan believing that you're already owing a bank.

Be careful with some little things that matter.

I'm actually surprised that your pension managers accepted your forms devoid of a letter accepting your resignation from the company. You should have humbly resigned properly. Right now, my guess is, you're at the mercy of your former company...you know how we Nigerians love one another. I told an OP here months back to always leave the proper way, one fellow came up yabbing me, saying that op should walk out on the job, do this and that. You never know when you will need references from where you previously worked.

When a person parts from a company they know not to take office property.

Soldiers and policemen show you why gpvernment is unlawful, for these are people's consent (allegiance) is to the King (Ruler/Government) AND NOT TO LAW. So, they belong to king and follow the king, even if the king has no lawful right to rule like the leader of bandits and his men.

So, they cannot leave without the king's permission and they almost do not have any right in Law because they gave their lives to the king, so all their rights come from the king. That is why you would always hear them say "government (king) said/by the authority of king so so so, ...

In Law, Consent is everything and The Law does never forces a person to do what they do not want to do especially when it is reasonable for them to refuse to act.

If only Nigerians knew their rights!

If you were given offer letter, you should resign properly

But if you were not given any letter you don't need to resign, just leave the way you come.

Same thing i told my former company when they call me to bring my resignation letter, there was no offer letter from the company, they got an intervention contract and needed personnel to execute the job. They were lucky after expiration of the contract, the contract was renewed with better package, some of us that shows resilience were retain without offer letter no other incentive for the personnel executing the job.
My salary was increased from 30k to 45k. I asked for 250k in 2014 but they said they can only pay 75k. I worked for 1 month i was surprised they pay me 100k, still not enough to annulled my constraints. That is how i left the way i joined.
My brother i understand your case, just go to your pension office engage a lady there she will help you.
My colleague did the same thing when his former company hell bent to do the needful after disengaged.
He got his 25% after so much drama back and forth

That is the very definition of duress and slavery. For consent is one of the ingredients that makes a contract valid and binding. And duress, slavery and violation of a person's personal right will always vitiate a contract.

But Nigerians refuse to.know their rights and have even given it up to their kings to treat them like animals even in their fake courts using their fake and unlawful command called "Legal".

Whether they acknowledge or not after 7 days of no response the pension fund administrator would go ahead and pay you your 25%.
in my own case, it took my former employer nearly 2 months to respond to my PFA. Every time I reach out to my PFA on the reason for delay, the reply I got is that my former employer hasn't responded.
