It is the day i was physically in the uk that matters then..

I will input the BRP date (because this is the same date i used in my spousal visa FLR M extension application) when asked for and look at the results in the ILR calculator... thanks

I need to be consistent with the dates so i'm not putting different dates in the application from what i put earlier..

I'm asking because i need to know what date to put in the "When was the start date of your first relevant visa that goes toward the continuous period for this ILR application?" in the ILR calculator so it can determine what day i can apply from
I have never used the ILR calculator before. But I am sure the question on the ILR application is something like this - When did you arrive in the UK?

I would think it's the first day on your 1st BRP.
As mentioned earlier, I have never used this 3rd party ILR calculator - if I remember clearly, never been asked the highlighted question in both my applications.

In my opinion, I think you are placing more emphasis on the calculator than required. As far as I am aware, it's there to help you estimate when you can apply so if you use the BRP date for the calculator, whatever date it gives you will work as it is the latest date out of all 3 dates (date on your visa, date you arrived and date on your BRP) you are considering.

I can understand that you want to be consistent with your application and the dates you have provided previously. For consistency on your actual forms, you can use the date on your BRP like you have used before then in the notes or other information section of the application form, you can say that the date you used is based on your BRP but that you arrived the UK on xyz.

When I came here in 2015, BRP wasn't a thing. It was when I renewed that I got my first BRP. The question on the actual immigration forms have always been along the lines of 'date you arrived the UK' or something similar and that is the date I used on all my forms.

My case with timeline is somewhat interesting

BRP date: Sept 2019

Arrival in UK: Oct 2019

FLR M Spousal visa renewal online application: June 2022

Successful email confirmation from Home Office for the FLR M Spousal visa renewal online application: March 2023 (There was a major delay with the whole backlog and it took almost 9months to get a response from Home Office)

Granted permission to stay in the UK by Home Office until: Sept 2025 (which is 30months from March 2023)

This means I would have been 5years 11months ish by Sept 2025 with about 80 days out of the UK

All BRPs are phased out by 31st Dec 2024 and everyone will use the online share code feature

So do i wait till 28days from Sept 2025 for ILR?

Or i can apply earlier once I have 5years (and maybe 3 months extra due to 80days out of the UK)?

With the latest information you have provided, it is easier to wade in.

Firstly, your 80 days absence, is that in total since you moved here or for the period of the current visa. Actually, it doesn't matter either way, the absence rule is calculated as 180 days of absence in a 12 month period so your 80 days is nothing. Also, interestingly, that absence rule does not apply to spouse visa for ILR, it comes in when you apply for citizenship but not ILR (see the link on page 1 of this thread) but even at that your 80 days is well within the limit.

No, you do not need to wait till 28 days before September 2025. Use Oct 2019 which is when you arrived here. So by Oct 2024, you would have been here for 5 years. Ideally 28 days before that date is fine but I'd say give it a further 30 days and apply. So apply from end of Nov and you should be fine.

Life in the UK test, once you've passed it does not expire so I'd say try and get that sorted soon.

1. Can i apply for ILR with the UK Naric certificates I used for the 2 previous spousal applications for this ILR?

English Language Proficiency Statement: The NARIC certificates confirmed the Level of English Language for my uni and master degrees is confirmed to meet requirements of CEFR Level C1.

Academic Qualification Level Statement: UK NARIC also evaluated my uni and master degrees.

Can i still use them and not need to write any B1 English proficiency exams?





2. Mortgage Statement: Exactly how and where do i get this from? Do i request from my mortgage provider 28days before online application or is this a statement that was given when I got a mortgage?



3. Regarding FLR(M) and SET(M),

From page 1, it says SET - Settlement then (M) is a category of Settlement visa used by immediate relatives of a settled person in the UK.

It seems a lot of comments and experiences here were SET(M) but i'm on FLR(M) as my wife is British.

Should I be concerned that there are few FLR(M) comments here or it is almost the same?

I'm a bit confused



4. Is it true I have to include a letter from my employer(s) to confirm the days I was out of the UK during the 5years was during my annual leave period?

Usually the statement given at the start of your mortgage - Just to satisfy accommodation requirements.

Your letter from employer is to verify you are employed i.e your contract details, your position, how long you've been with them and the verification of the 6 or 12 months payslips you are submitting.

Or is it a statement i can request from the lender just the way we request for bank statement?

Seems like Super priority service is not available for ILR Set(M)? I have been refreshing since amd nothing. Even at midnight.
Please is there any other way? Because I don't understand. Should it be only on weekdays? As I have been trying it on a Sunday night, also Monday 12am, still nothing

Please help to advise.
I hereby reach out to enquire on the immigration status of our 3 kids who are presently in the United Kingdom.
The history goes as thus:

Child 1 was born outside UK in 2009 when I (their father) regularised my immigration status with 2 years visa, while the mother had no uk immigration status and both child and mother resident in Nigeria then.

Child 2 was born outside UK in 2011 when I (their father) was on Indefinite Leave to Remain (ILR) status while the mother had no uk immigration status and both child and mother resident in Nigeria then.

Child 3 was born outside UK in 2014 when I (their father) was on Indefinite Leave to Remain (ILR) status while the mother had no uk immigration status and child and mother were resident in Nigeria then.

I (their father) became a British Citizen in 2021 and recently brought them to United Kingdom with, D-Child App FM (standard) visa from 5 April 2023 until 5 January 2026 for the 3 kids, while their mother came in as PARTNER (standard) from 5 April 2023 until 5 January 2026. All are currently settled in UK.

The enquiry is if our 3 kids are eligible for Indefinite Leave to Remain (ILR) or to apply to become a British Citizen after the expiration of their current visa by 28 January 2026, or apply for their naturalization after 2 years of residing in UK ?

Perhaps, kindly advise on what each child is eligible for after the expiration of their current visa by 28 January 2026 as we are yet to know.

Hiya. I am not too sure about your first question, I didn't go down that route myself.

For your second question. Yes, you need to pay the health aurcharge to extend your visa.

If you have used the same test result for the first application then you can use it again for extension, no need for another test.

Or you can submit and then book the Super Priority later?

Never paid for one, and I intend to use Super Priority service for this ILR application soon

My wife's employer has refused to add this "period this gross annual salary" in the letter, as they just confirmed her gross annual salary, and her job title and that her role is permanent.

What do i do? Does this affect anything?

She is the British citizen and i have always used her documents when applying for the initial spousal visa and the FLR M spousal visa extension ..

Her employer also refused to verify her payslips but this isn't on the official documents requests from UK Home Office.. i'm just focused on her employer adding the "period this gross annual salary" began

The most important thing in that employment letter is to confirm if your wife is a full time employee, when she started working with the company till current date and her annual salary, that is all.

For my applications, my husband's employers used to confirm that he was a permanent staff, how long he had worked there and how much he earned, they never confirmed how long he had earned that particular amount for and I had no issues. To be fair, they used to also sign the payslips, not sure why her employers are being difficult about signing payslips.

Home office can view salary consistency from the payslips. Is there a difference in her salary evident in the payslips i.e has her salary increased or decreased in the 6 months payslips you have?

The screenshot in my original post has the period the gross salary was earned, and it is gotten from ILR application.. that's why i'm worried

Also, she had a payslip verification letter in the FLR M application we did last time, and so thought we should get it again to confirm the payslips are genuine

Home office can view salary consistency from the payslips. Is there a difference in her salary evident in the payslips i.e has her salary increased or decreased in the 6 months payslips you have?

The screenshot in my original post has the period the gross salary was earned, and it is gotten from ILR application.. that's why i'm worried

Also, she had a payslip verification letter in the FLR M application we did last time, and so thought we should get it again to confirm the payslips are genuine
Recently i made ILR application for a family member and the letter from the employer was as i described in my last post and the payslip was submitted just like that without any verification, HO can do the verification if there is a doubt.

Is this thing about not using bank statement from your bank app/online banking for any UK Home Office application like ILR real?

Must it be the official bank statements ordered by post that usually takes 5-7 work days?

The 28day rule for official documents will run quite close if i wait 5-7 work days before applying (this is due to the period of bank statements which runs to 1st of every month, so i have to wait till 2nd November 2024 before ordering)

If you add 5-7 work days.. then i'm close to the 28day rule for mandatory documents

Has anyone applied for ILR with just downloaded bank statements (bank doesn't stamp)?
