You don't touch people without their consent.
You need to see how careful people here are, to make sure they do not touch you even when having friendly conversation with you.
Maybe the only place permitted touch is in church where pastor will direct every member of his congregation to touch their neighbor and say it is well

You come to his defence and you're likely to be labelled a wapist.

Truth is, his orientation/culture failed him.

Unfortunately, that's not a legal excuse when you are not wealthy and from.an African nation.

The law should consider if someone is truly a menace to society when such cases are judged.

There were indeed mitigating circumstances, but Shugbon, nobody wants to heat that.
The culture of impunity widespread in Nigeria failed him in the UK. In the good olden days , women are protected and wars can even break out because of the honour of women. But today men don’t care and won’t mind sleeping and impregnating a married woman, talk less of a drunken single one. We should reorientate our men and boys.

I agree that this is still the law now. Fine. And any man who does it in this situation, na him sabi...e don enter am.

Now, lets talk real. Are you people for real really? A responsible lady got drunk to the extent of not making a decision for herself. Should she get to that state? And do you all think everyone of these ladies dont pretend? To me, she deserves a resounding slap...andnif she tries to say 'pee', make dem land am another one. Afternthey can focus on the guy. And as soon as the guy is giving his punishment, they should land the useless girl another dirty slap. It must be knocked into her indomie brain 🧠 to be responsible.

The thing is that this life and law are flexible. It used to be a man's world in these nations just as it is still in Naija, but one day, it flipped. It will flip again because these ladies will soon over do it. And na slap dem go dey use reset the brain of ladies like that.

Even sef, a responsible lady should not even defend them. Sorry...I have not said you are irresponsible ooo. I see it that you are just explaining the law. But i would be careful not to even explain the law cos it is so irritating. I would rather be silent in this situation because you cannot be in this situation. No matter what? Or can you get your yourself drunk to the state you are vulnerable to sexual abuse? Lets think deep na.
This mindset is what has made a dog’s life more valuable in the UK than human life in Africa. Most africans no longer care about the weak and vulnerable in their midst. For Nigerians especially, it’s loot , grab and run with it if you can. It’s all about “it go favour me and my family “, the rest of the people can starve and die. That results in a politician or traditional ruler looting palliatives meant for the poor without remorse.

Would a crime be written off because the criminal was drunk? And therefore "incapable" of making coherent choices?

I get your point though. The law never makes sense oftentimes...

Good kweshun. The other interesting kweshun that springs to my mind is what if the intoxicated person shows no signs whatsoever of being intoxicated?

I didn’t care to read about the other guy’s case. Nairaland is deleting comments and banning people in that thread. Make I dey my dey.

In your instance, na so oyibos be. It took me three of such instances to understand that the average Brit is timid in nature. Their real selves come out when drunk. Their women are a case study. One will hit you up on Facebook, collect your number then tell you to come over and service her. Halfway into your journey, she’ll call to cancel the invite, claiming that she helped herself with toys.

The woman remembered everything that took place. Her plan was to punish the person who fell for the trap. That way, she’d get the enjoyment of a BBC and the ego boost of destroying his future afterward. When next her thing tingles, she’ll do it all again to another unsuspecting victim.
Then she will claim mental health issues and depression from the incident. Before you know it the Government will start paying her bills because she can no longer work or engage with the public again due to PTSD and trauma from the event.
They have a wrapped system that support this kind of behaviour. That's why black men need to be careful around these white women because they see black guys as easy Target.
Black men too need to learn that No means No....not try harder.

Backing away from sexual temptation is not easy but is the best way to go. In my own case , the Polish girl was legit drunk and I knew it, everyone knew.
Her countryman implored to please take her home and that she will give me money for fuel as man broke that point in time or that he will give me. He could have taken her but said he had an emergency and the girl was so incoherent that taxis refused. He even told me the girl go do me as she say she likes black man and had mentioned me casually before. Moreso, she dey do hookup by the side.
Na so my mind dey do gbim gbam when driving her home, not after seeing fresh swollen lips down there. This yeye girl legit touch my blockos wan dey stroke am before I tell am say she go distract my driving.
As I reach , she say make I com up,I say No, go bring the money. She staggered comot kiss me for cheeks, my head turn. We enter lobby, Pakistani security guard looks me shake head. I look am say this guy noor want make I spank that red butt cheeks. As I reach elevator, I see bright light from camera dey shine me, I just dump her shoes for am pick race.
Since that day, your eye must clear before I even siddon talk to you

Once a western woman is drunk, please do not even think about it, nothing good will come out of it.

I believe there is slightly more to this story than detailed but he can't defend himself as he knew the lady was drunk.

Drunk western ladies have no filter and do have a way of saying the most flirty, erotic things. You just, as a black man, have to know you are dealing with "bad market".

Shut up. You don't dislike the way your fellow Nigerian men are being arrested for rape in workìng countries? you ignored the topic to start wailing because your problem is never the crime but how to defend your frail masculinity that doesn't withstand global scrutiny. Not even in SA an African country. You will be granted visas to go abroad and show that your masculinity. Say Amen and quit crying.

avoiding one night stand would save you from any future wahala. if you want to knack either enter into a relationship or pay an escort. if you must have sex ensure she has had no drink and their is explicit consent either written or on record to avoid stories that touch. alot of people don't remember what they do when they are drunk and if they find you on thier bed when they wake especially when they don't find you attrcative OYO
You better not rely on written consent because even with that, she can say stop at any time and doesn't have to write it.

Mike Tyson went to jail effectively because he refused to escort the daughter of Eve downstairs to see her off. Is it us mister nobodies that would not be swiftly put on the Sex Register.

Some of these women wake up the next morning ashamed of what the've done and the only way to redeem themselves is to cry nonconsent. You and your life are certainly very dispensible.

Don't pull down those boxers around a drunk woman, nothing good will come out of it for you, even the sex will not be worth it.

When you have no morals you will see anything as an opportunity. A responsible adult will protect a person who is intoxicated.

An animal will take advantage of the situation.

You want to be an animal, stay in Nigeria
. It is that simple.

She was intoxicated, therefore incapable of giving consent. It doesn't matter if she offered herself to you. Once she is not of clear and sound mind at the time when she made offer, she is incapable of giving consent and having intercourse with her in that state is taking advantage of her.

You should count yourselves lucky that none of you allowed lust blind your common sense, else you would have made the news for the wrong reasons.
What stupid "consent" are we even talking about? Why should anyone have to sleep with a colleague?
If you need sex, you go to the brothel and transact a sex business there.
Or you get a girl friend with mutual understanding.

His culture didn't fail him. He failed himself. With all the things he has been hearing about the blacks or Africans getting jailed for rape or attempted rape, he still let his guard down? How didn't he know that the UK/US are places you have to face your front and walk away like a dummy? He landed himself in the trouble and I'm surprised he did.

At one point, she sat in front of me and kept flirting with a married colleague. I even saw her hand on a grey area on his trousers while they were whispering. But even he couldn’t go further.

Eventually, she got frustrated, made some calls, and left
The first bold is harassment from her but nobody talks about that because it's done by a female and the second bold shows clearly she knew exactly what she was doing. The laws over there are rigged in their favor so save yourself the trouble and avoid them as best as you can, intoxicated or not.

She’s drunk and sexually harassing and molesting people, at a time she even had her hand on the wrong side of a man trouser, flip the gender

Imagine it’s a drunken guy doing all that to women then claiming he’s drunk and can’t remember anything

Anyone who touched her should be sentenced to jail, but she also is guilty of sexual stalking and harassment and should be severely punished

I kinda smiled at your comment to my post. And I assume that the 'mindset' you talk about is that of mine about the issue. If this is so, and you felt I was wrong, here is my response to you.

Define the weak. So, the weak is an adult above 18 years who should have a driver's license meaning can make sound and effective decision, but intentionally choose to make a wrong decision that will impact her sense of judgement by taking an ontoxicating substance in the public. To you, she is weak. Right?

If I am right about your mindset, you put a person who isnt a minor who deliberately altered her own sense of judgement in the same category with total helpless minors and adults. The Nigerians you mentioned, are they in this spot with their own deliberately actions? Did they deliberately cloud their sense of judgement with a substance that couldn't make them make decisions?

Yeah. At the onset, the law is to protect such kind of women at a time no one would even imagine such. But right now, an adult who is supposed to hold a drivers license deliberately gets drunk to the extent of losing herself in the public when she knows what's up. And you are telling me that she is a weak person. Lol. Then, you need to check your mind set. A weak person or a stupid fellow? Or a pretender? Or an opportunist? Or a manipulator of the law?

Maybe, we need to start investing if truly she is weak. Of course the man who did it is already in for it with a bigger punishment. But that person, called a lady in that situation must prove she did not deliberately stupid to be weak. With the info out there now, and yoy want to tell me most of these ladies are still naive? Lol. Your "mindset" is funny. Lol.

Listen....it will still continue, but I am telling you that the law is flexible. They will amend it soon. And they will have to stop ladies who think they can give innocent but stupid boys wahala.

That same law that says a lady who decides to not use her head will soon put many of the boys as weak. Thats the law for you. Then, the boys too will start hitting you hard with bad words when you come out as a lady that you got drunk and molested. And the boys too will start using it to deliberatly harm girls. So, its why the law cannot be fixed. It must be changing to balance the equation. Human being is so crafty. This is the nature of humans.

My main point is this. At this point, be responsible and use your head as an adult at all times, and it will be well. And like I said, if a man too is so wise to fall into that trap at this stage, na him wahala.

I am just a neutral person in this case, and I will always tell you the truth. People need to be responsible for their actions. Get drunk in your house where you wont be touched. It doesnt mean that if you touch her outside, you will go scot free. Of course not. But I would descend on you that claim you were the victim too. This way, everyone will grow up.

Weak ladies indeed. Many who have mastered the act of using it to blackmail "dundee" boys. Lol. Anyway, the "dundee" boys too arent decent enough too.

You all will learn. Do not worry. Even your mindset, you go jam am soon. And if you are a man, dont fix your girls well and wait for the law to protect them. Protect yourself first before calling on any law. Thats the wise thing to do.

So, again. If I was allowed to handle this law. I would punish the man, but that lady who deliberately didnt use her head will face it too. Period!

Lastly, well done for your mindset that says a lady who is able to make a good decision but clouded it with a substance is in the same category with helpless minors and adults. Good way of thought. Clap for yourself. Lol!

Exactly.

The narrative would be different if we switched genders.

Plus, the hell, why should whoever gives in and touch her be penalized? This should be thrown out of any court.

Both were adults and should bear whatever resentment they later have for the action. Not something the lawmakers should be discussing.

If I were presiding over such a case, I would throw all of them out my courtroom.
