You are wrong. Proper documentation absolves the doctor from blame. A patient folder/case file in the hospital is a legal document presentable and admissible in a court of competent jurisdiction. That is another reason why he needs to ensure he obtains a written and signed consent from the kady authorising full disclosure of her health status if she so desires and to whatever individual or group she names. If the attending physician takes proper history and examination and have such documented, he is covered as long as the first procedure was not carried out in that hospital.

Because in the first place, a qualified doctor is not supposed to carry out abortion without someone else signing for the patient.
