Hi

yes in the letter he explained that the lawyer advised to put a line through the incorrect email on the online application form submitted in Lagos VI and that tlscontact had the correct email as we received an email from them saying his visa is being sent for processing etc.

I was advised today however, that it maybe quicker for me to try submitting a fresh application until a charge comes up then I can just pay it.
I tried the other day and it said 0.00USD to pay the ukvi agent i called today advised me to keep trying and make sure I am filling out the correct details.
I was wondering if it didnt charge because i put I am filling the form on behalf of someone?!

I have been following this forum for long and God bless the people responding to all questions. I plan to apply for my UK settlement visa in January. My wife meets all the requirements.

My question is for the supporting documents to Sheffield. Some of the documents like house agreement, wife pay slips are with my wife in the UK. While I have our pictures, phone logs and chats.

Do I send my own supporting docs to Sheffield and she sends her original docs too? Or do I request her to send it to me via email and I send as one to Sheffield? What's the best advice?

The easiest way is to send all the documents you have to your wife, then she will send everything together.

For the definition of a subsisting marriage as in BK turkey, I have tried to copy the link but couldn't, search upper tribunal decisions on Google and in the search box of gov.uk search Bk and others, the definition is the first paragraph.

Let me give you this outline so you can understand what I meant by evidence of contacts eg

I communicate with my wife/Sponsor via emails WhatsApp, viber, Skype etc. See evidence of emails chat and call logs from... date to date so and so

I sent gifts, money transfer to my wife so and so date

We spent time together during visit to me from so and so date....see dated photos and passport entry and exit stamps and flights e tickets as evidence

We have both shown genuine intention to live together permanently in the UK by submitting a spouse application.

My marriage to my wife is genuine as I submitted a valid marriage certificate. As in the case of Bk and others it was accepted that........ Marriage is....add the definition

The case of post decision evidence will be good as reference, if both of you had met after the refusal notice.

This is all that your lawyer needed to draft for you if he know his onions.
Do you have children together?

Hello nairalanders in this section.

Few weeks ago, a friend told me about this section on nairaland (after I've been a member on Nairaland for years and over 4 months after I submitted my settlement visa to return to the UK). Better late than never as they say.

I have actually been following the topics, questions and answers on this section since i was told about it and I really am impressed about how people help each other out here with correct and accurate information (I just wish I had known about this prior to submitting my application). Special kudos to Lexus, Just wise, the Portsmouth lady and others that I can't remember their names. God bless you all.

My question now,
Guys please advice me on what to do, I have submitted my application for more than 4 months like I said earlier (precisely on the 23rd of June) and I've had a few email correspondence from UKVI. Sometimes in September, I received an email from them saying that the processing of my application is not straightforward but I shouldn't worry because they are doing all they can to sort it out. Last month (Oct) they called my wife (sponsor) in the UK to ask questions about her second job as we combined two jobs for her in order to meet the financial requirements.... They also contacted only the second employer. After the last call to my wife, they told her they will make a decision on my application as soon as possible.... About a month after the calls, I still haven't heard anything from them neither has my wife heard from them.

Please guys, what should I do as I am really getting frustrated and tired of waiting (on the gov.uk website, I actually saw that processing time for Nigeria is a maximum of 3months) ... And my wife also is frustrated and tired. Should I contact them (UKVI) or still wait to hear from them?

If I'm to contact them, does anyone have their contact (contact for people from Nigeria)

No reason stated. However, below is the paragraph where it's stated in the email I received from them.

"Unfortunately, the processing of your application has not been straightforward and we will be unable to decide your application within our customer service targets. We are continuing to work on your application and aim to make a decision as soon as possible".

Do you have an idea of what that means?

Do you have an idea of what that means?

What it simply means is, more verifications are required. Did your wives documentation 'meet the financial requirements' & in date? Is she still employed by her employers? Was she previously married? Have you visited the uk previously?
Such questions might point you in a direction or two

Hi All,

This is the first time I am ever posting on a forum so not sure exactly how this works... If I break any rules rest assured that it will be unintentionally so please let me know.

I am a British/Greek citizen (dual nationality) who recently got married to a Nigerian. I have been living in the UK for the past 11 years and my husband lives in Nigeria. We have been friends for a few years now and officially became a couple 2 years ago, on my birthday smiley
A few months after we got married we applied for a spouse visa and were refused.
The reason for refusal is that they don't believe that our relationship is genuine and to be honest, looking at it from their point of view I can see why...
Following bad advice from my solicitor I only provided evidence of our relationship from our wedding onwards but nothing before that. Things are actually made even worse by the fact that we got married on the first day we physically met. When I arrived in Nigeria we already knew we wanted to get married so we went to the registry office to find out what we needed to do where we were told that for an extra fee we could get married on that same day! We decided to go ahead and do it thinking that the sooner we did it the sooner we would be together...
The truth is that the evidence of communication we have before that is very limited as my husband did not have a passport so any money I sent was to his parents and as he didn't have a smartphone or computer until my visit we don't have emails or messages before our wedding. Due to the high cost of calls our communication was not very frequent and as he had a different number then (which he no longer has) there is an itemised bill of calls to a number that can no longer be verified along with calls to other members of his family (when the call to his number could not go through or when his phone had no battery).
The only other evidence I have is the receipt for a watch I bought him as a gift for our first Christmas as a couple (back in 2014) which has a picture of the watch on it and he can be seen wearing on our wedding day.
I also have the itemised bill I mentioned above which unfortunately only goes back to September 2015 as Lycamobile only keep records for 1 year, a log of western union money transfers going back to 2013, an undated letter that I wrote him where I do not refer to him by name, cards from friends about our wedding (undated and not stamped), and some undated Christmas cards I sent him with the watch...
Is it worth me lodging an appeal in your opinion? Any chance that the decision may be overturned by the ECM on this new evidence? If I reapply I understand that we may get turned down based on the fact that we have already been turned down before.
My biggest fear is that we will never be able to get a uk visa as the reason they are refusing is not something we can fix... unless someone knows to collect evidence from the beginning then there is no second chance... can this be fixed? If we apply again in a year's time with evidence that we are still together (communication, visits to Nigeria) do you think that they will still turn us down based on the fact that we have no evidence from before the wedding?

The decision was made on 29th September 2016 but we were only informed of the decision on 27th October 2016. My husband collected the decision from the VAC. I thought that by going to a lawyer I would avoid any mistakes but it is clear to me now that this forum might have been a much better option...(and I could have used the lawyer's fee to visit my husband instead...)

I could not put your observations any better....... You have 28 days from the date of rejection, to put an appeal in. Today been the 2nd of November 2016, I think you have already missed the appeal window.

It states 28 days from the date you received the decision. But an appeal could last you over a year, before you even get a date for appeal.
Reapplication is the best approach, unfortunately.....

I was under the impression that it was 28 days from the day we were informed of the decision, not from the day the decision was made. Is this not correct?

My advice, simply go on reverse application resubmittion.
Set a feasible timeline, gather all required and relevant documentations, ensure all the prerequisites are meet and submit a priority application.
I know it's already cost you lots of £'s and would cost you more (hubby as loads of overtime to do, from the moment he arrives)..........

Yes, it says 28 days from the day you receive decision. It takes almost a year to receive an appeal hearing date.
Its best to simply reapply. Organize all and use priority application............

Set a timeline for the important documents accumulation and proof your union is subsisting..........

May I ask, why do you say that the rejection will give us more leverage? Is it because only a real couple would persevere...? To be honest this experience has been so draining that I would not choose to go through it again for any person that I don't expect to spend the rest of my life with...

Simply because, you would learn from your initial application and make a better job of it, the second time around.........
Second chances are not given to make things right. But are given to prove that we could be better after an initial fall and emotional torture....

I can imagine. I usually advise using the waiting period to learn a quick handy trade (like hair plaiting, makeup etc etc). This skills do come in very handy for that extra pocket money and earn extra GBP........................
