@Nkiruka1986

I read this over and over again.

I think you should put in an appeal and see if the decision would be over turned at the review stage.

Do a timeline of your relationship on your cover letter.

Ensure you address each and every point raised by the ECO in the refusal. Be honest.

And supply every evidence you can find. New evidences can be supplied as long as its not dated after the refusal.

Use the 1st refusal to your advantage because it is proof that you two did try to be together.
It might seem worrying that you got married the 1st time you met physically but its not their job to Judge how you choose to operate in your relationship.

If you can use your own call history. Your hubby isnt the 1st person to change phone numbers.
State it if you can in your cover letter that he changed his number on xx/xx/201x

State in your letter why you only have chat records for the period you do. Not everyone jumps on the smartphone wagon early.

List every money transfer sent to your hubby through his family in your cover letter. They are his family. State his relationship to the recipient in the letter.

Do this and if the ECM sticks to their initial decision afterwards then apply again.

Nothing can change in the history of your relationship. It is what it is.

And for the record you did appeal clearly addressing everything the ECO used against ur application.
With that and more evidence you are able to gather over time your reapplication should be successful.

You have a right to be with your husband.

@Lexusg430 how you see am

Abbylove, thank you so much for the advice. I was thinking to do the same thing... in the meantime we will try to get a visa for Greece where he can stay with my family so at least the communication will be easier and I will be able to visit regularly. Thank you for not forgetting about me smiley

There is still hope if you want to reapply. Though he lost the number you used to call but you can still use the call history from your own end.

Evidence of gifts, money sent, Flight ticket when you visited Nigeria, pics, wedding cards all form part of communication and shows evidence of committed relationship.

Give it a thought

Thank you justwise for the advice, you are all so helpful! smiley

Good morning all.

@abakilikiboy my advise to is to be prayerful because your application MAY not be an easy one. My former flatmate very similar issue as you. He impregnated his current wife while in marriage with his ex. his divorced. when he got his papers, he filed for his baby and baby mum and their application was refused. Why? He filed for divorce after obtaining his papers. the reason for divorce with his ex as stated on the extract of divorce was as a result of infidelity from his ex. HO further stated on the refusal that his child with his current wife was born while in marriage with his ex. to cut the long story short, they concluded that the infidelity was on his part. They further classified his marriage with his ex as bogus marriage all with the intention playing on the immigration rule. As at the last time i communicated with him in June this year, it was still a negative news.
However, do not be discouraged by my friend's experience. My candid advise is do not rush into marriage yet for the purpose of bring your baby mother over to the uk. Get your red passport first before entering marriage with her, and use this time to gather lots of info, documents, and establish subsisting relationship, communications, pictures and holiday trips with your baby mum so as to boost your application. Good luck!

The postroom does not send emails confirming any documents received.
You would surely receive an acknowledgement email, once it hits the appropriate desk (I bet it would be under a pile of many).
Did you pay for priority application?
Re: UK Spouse Visa/Appeal Process-part2 by Benz101: 2:36pm On Nov 04, 2016
@Lexusgs430 thanks for your response. I did not pay for priority, considering the fact that my wife has been denied UK and US visas four times each, and I am currently in Nigeria, I did not bother paying for priority. We don't mind the wait game provided HO give us what we want.

@ Lexusgs430, I pray it will not hunt us. The thing is my wife is not really keen on relocating from Nigeria to UK 1. because of her job, and 2. She sees UK as too boring and prefers U.S. The thing is no one knows tomorrow and what it will bring.. I'm just doing what I have to do as a husband and for my kids when they arrive into the world.

Fantastic Father + Husband. It's what we have we can be proud of. UK & USA (my perception not any different). The Hustle is the same >>>>>>>

Good day everyone,
I am new to this forum and I have got few questions to ask the Gurus in da house.

My Fiance is currently in one of the Schengen country and I am in the UK.
We plan on getting married in Nigeria obviously soon but my questions are:

1) He got his Schengen visa less than 2 years ago to study but his visa had ran out and he has seeked for an asylum in the country. He has not been called for an interview yet. So the question is I advice him to withdraw his application for asylum and go back to Nigeria where we can have our wedding and then he can apply for a settlement visa afterwards.

2) My fear is that what he is refuse the settlement visa because of the asylum thingy? Or should we not declare that he has been to a Schengen country before? I dont know if their database are linked to one another.

Thanks as I await your responses.

What makes the USA interesting and the UK boring and Nigeria stale ?

All developed countries share immigration database (amongst other things).
You already know the answer to the questions you asked. Be open and honest. The spousal visa you sign is a legal document and if any lies are sniffed out, INSTANT REFUSAL ........

I can tell you, the chances of him been granted asylum is below 5%. Is Nigeria presently a war torn area or what is/are his reasons for fleeing persecution?
Not unless you have only told us less than 1% of the story ........................

We actually divorced before getting my permanent residence. This is the breakdown :
-We divorced in September 2015.
- I applied for my permanent residence October 2015
-Granted in April 2016.
Am not going to do their application until after my British citizenship which is due in April 2017.
The earliest I can do their application is around July or August 2017.
I just want to cease the opportunity in January 2017 to do my registry since I will be in Nigeria for holiday and to start putting the all necessary documents together before then.

I understand your plans. My main concern is about your baby whom was born while in previous marriage. HO may see it as infidelity to your ex just as my friend's case was. We can only proffer a reasonable cover between now and the time you make their application. It's better to cover every loopholes with truth. We can only do our best and believe in God to perfect his plans for us. Keep your communications with your baby mum from the date you started your communication after your divorce to the day you will file for them. Good luck!

Well from experience, Lufthansa is the best in Europe expensive tho. Arik is better than Air Marco with that you can get what am trying to say. If you can afford Lufthansa go for it.

This forum is so nice to me. I come here to draw comfort after reading the posts of everyone who are almost in the shoe with me. Five months have passed by after submission but I'm still waiting patiently. Although I need to change oil. It's full now. Wife is alone in the UK this winter. But there is God ! cheesy

What prices are you getting for Medview or Arik? Medview lands at LGW, but train services or cab services are plentiful.
Or get Madam drive the Bugatti to pick you up.
NB: I personally would not fly Air Maroc (medview or Arik are much better alternatives and they fly direct)......
