This is an interesting time in Nigeria's democracy. What becomes of Nigeria, is solely dependent on the actions and in-actions of Nigeria's modern day Dictator, who I believed has fueled the amber of discord against the Legislative Arm of Government within his core Northern caucus aka cabal and the goings-on in their nocturnal meetings.

Is there any Nigerian by virtue of his position relative to his appointment by any of our Presidents, who has the effrontery to call The Senate, Childish and other derogatory names ?

I do not bother about the characters in the Senate, what bothers me is that each of those Senators, no matter how questionable their elections were, represent a people of each Constituency in this country. When one has so much confidence and power, because they 'know' this Buhari of a guy, and gather so much confidence to defy the orders of the Senate and even castigate that Upper Chamber, it makes me ponder if we are truly a democracy.

I think, we all need to put our bias aside and view this on a national periscope devoid of coloration of ethnicity, party-lines and religion.

We are bleeped, if we dont fix this growing impasse. Truth is, APC is gradually destroying our democratic institutions. No country has ever fought corruption successfully by personalizing democratic institutions.

We must learn to respect the Senate President and other Senators, not because of their personalities, but because of the Position they occupy.

We all know that Dino is more educated than Buhari, we also know that Bukola is more educated than Buhari, so there is a limit to what Buhari can achieve with his personal aggrandizement. Buhari has to be taught, to call his caucus to order. If their intention is to build Nigeria, then all Nigerians, including their personal enemies must be involved in nation building.

If this does not happen, I will personal step into the turf come 2019, and life will never be the same again.

See this mugu o. U want ppl to respect the position of the senate president but u re quick to disrespect that of the president of the country....u ve succeeded in writing absolute trash...

The constitution empowers the Senate to summon anyone in Nigeria and give a warrant of arrest. including the president. Sagay did not know the section he quoted.

That slowpoke only quoted section 89. Study section 88 with 89

88. (1) Subject to the provisions of this Constitution, each House of the National Assembly shall have power by resolution published in its journal or in the Official Gazette of the Government of the Federation to direct or cause to be directed investigation into -

(a) any matter or thing with respect to which it has power to make laws, and

(b) the conduct of affairs of any person, authority, ministry or government department charged, or intended to be charged, with the duty of or responsibility for -

(i) executing or administering laws enacted by National Assembly, and

(ii) disbursing or administering moneys appropriated or to be appropriated by the National Assembly.

(2) The powers conferred on the National Assembly under the provisions of this section are exercisable only for the purpose of enabling it to -

(a) make laws with respect to any matter within its legislative competence and correct any defects in existing laws; and

(b) expose corruption, inefficiency or waste in the execution or administration of laws within its legislative competence and in the disbursement or administration of funds appropriated by it.

89. (1) For the purposes of any investigation under section 88 of this Constitutional and subject to the provisions thereof, the Senate or the House of Representatives or a committee appointed in accordance with section 62 of this Constitution shall have power to -

(a) procure all such evidence, written or oral, direct or circumstantial, as it may think necessary or desirable, and examine all persons as witnesses whose evidence may be material or relevant to the subject matter;

(b) require such evidence to be given on oath;

(c) summon any person in Nigeria to give evidence at any place or produce any document or other thing in his possession or under his control, and examine him as a witness and require him to produce any document or other thing in his possession or under his control, subject to all just exceptions; and

(d) issue a warrant to compel the attendance of any person who, after having been summoned to attend, fails, refuses or neglects to do so and does not excuse such failure, refusal or neglect to the satisfaction of the House or the committee in question, and order him to pay all costs which may have been occasioned in compelling his attendance or by reason of his failure, refusal or neglect to obey the summons, and also to impose such fine as may be prescribed for any such failure, refused or neglect; and any fine so imposed shall be recoverable in the same manner as a fine imposed by a court of law.

(2) A summons or warrant issued under this section may be served or executed by any member of the Nigeria Police Force or by any person authorised in that behalf by the President of the Senate or the Speaker of the House of Representatives, as the case may require.

The Senate has the power to summon every citizen of Nigeria. They also have the right and authority to order the arrest of any citizen of the citizen based on information in their disposal to do so
Their reasons for any summon must be constitutional, but in this case i don't think it is. That's why he(Sagay) directed them(Senators) to the constitution

GEJ served as Deputy Gov, Governor, VP, President for 6 years but Otueke people didn't have water or good roads simply because he followed sycophants like the original poster I quoted.

Goodluck's greatest ruin wasn't the fact that he lost an election, it is the fact that he lost the goodwill of the people who loved him most.

Go figure.

Well, he built Almajiri schools up North, universities all over the place, repaired roads like Benin-Lagos Road that OBJ could not, brought railway back and many other projects. Not in his village except Otuoke FG university. Yet people especially SW & the core North called him militant.

What if he had concentrated all the projects in Bayelsa or Otuoke?

GEJ had a more national outlook in terms of projects. Which of course is an anomaly in Nigeria where nepotism is the rule these days.

I think some people are crying more than the bereaved concerning GEJ being voted out.

Remember he did not even go to court to contest the results despite obvious election rigging in the North. Bubu who got considerably lower vote in previous three elections went to court each time. He even incited his Northerners to cause mayhem killing people.
Whereas GEJ made it clear that his political ambition isn't worth the blood of any Nigeria....Word on marble there.

If our generation steeped in anomaly, tribalism/nepotism & propaganda fails to see it, perhaps future generations will appreciate him.

I think GEJ is democratically more advanced than the usual Nigerian do-or-die attitude to politics. Hence many see losing an election as Armageddon.

1. Mr Sagay is not a member of the senate like Ndume and so can never be touched or punished by the Nigeria senate like they did to Ndume

2. Mr Sagay functions under the executive arm of government and not the legislature. Only the executive can punish people hired by the executive so your going by your comment, you don't know anything about the Nigerian constitution and the 3 arms of government and separation of powers.

Nigeria's problems goes beyond ignorant and illiterate senators because the poor, ill informed and ignorant population spells doom for Nigeria.

Do they still teach social studies and civic education in Nigeria.

I wish I could see this face of the person laying this argument, it would have helped to put a lot things in perspective, but leave that.

Ministers who have been summoned to explain things to the Senate, under which arm of government do they function? The legislature ba?

There are extant powers as states by the constitution and there's good old fashioned influence. So if President Buhari asks Sagay to appear before the house and apologise he will not go?

The impasse at the NASS is now a matter of international debate, especially when clear attempts to blackmail the Senate has been established......

At this rate, the Senate could ask for their 3 djinee wishes and Buhari will supply it. The only reason the man is still president is because the house has chosen to stand by him, come what may till 2019.

The President - with the help of some of its support staff - has committed clear impeachable offences, if at this stage they want to unite against him, it will be too bad.

Dont be surprised, after you talk finish, you hear for news say Sagay showed up.

Shebi they summoned Babchir, he dey form say "I no dey come". The same Babachir has now written back to ask for a new appearance date. Is he a legislator or a member of the National assembly?

Your flawed rant is a reflection of your poor understanding of the Nigerian constitution, separation of powers and legislative conduct, obligations, and scope of duties.

1. Senate is allowed oversight functions per government operations, policies, and programs, but never oversight on comments and opinions by any Nigerian.

Read the Nigerian constitution per freedom of expression.

2. You are free to show us where in the constitution stating that the Nigerian senate has oversight functions on speech, opinions and protected utterances under the freedom of speech and opinion act within the Nigerian constitution. I know you can not show us anything because there is nothing like oversight functions on speech and opinion.

3. If you are going to site examples, try come up with sensible, logical and rational argument and examples.

David Babachir Lawal's issue with the senate has to do with government operations and functions especially per issues surrounding contracts which the senate is allowed to oversight and not common protected speech and opinion made by Mr Sagay.

4. Lastly, ministers are summoned based on the operations and policies of their ministries and not based on constitutionally protected speech and opinion.

Mr Sagay is not a minister and his opinion or speech wasn't a government program, function or policy subject to senate oversight so stop confusing yourself or trying to sound smart when in fact you are exposing your ignorance and shallow understanding of the topic of discussion.

I think Sagay was right, according to Section 88(2). Section 89, which confers the Senate with power to summon anyone, cannot be read in isolation. It has to tango with Section 88, especially subsection 2.

Section 88(2) The powers conferred on the National Assembly under the provisions of this section are exercisable only for the purpose of enabling it to –

(a) make laws with respect to any matter within its legislative competence and correct any defects in existing laws; and

(b) expose corruption, inefficiency or waste in the execution or administration of laws within its legislative competence and in the disbursement or administration of funds appropriated by it.
