I don't really understand they way some people reason to certain issues. All the while NK has always been seen going about and having series of meetings with his people until the military action on his residence which took so many lives. Is it not understandable that he is the major reason why the military stormed his residence and don't we still understand that he could have been captured or killed since I can't really tell what else that could have brought the military to his residence if not him. Pls let us think straight and analysis issues adequately. There are questions that has not yet been answered in this issue!!!!!

These points are the most likely path FG's lawyer should be threading and they should also help NK's lawyer to think ahead.

Order to produce is a civil issue which requires preponderance of evidence as against a criminal matter which requires proof beyond reasonable doubt.The question should be whether they have right of entry to that place ie ingress and egress at that particular point in time.The power of arrest and prosecution belongs to the police and not army in whatever guise .read F.R.N v Osahon's case

In all fairness, one or two witnesses can support the argument that Kanu was in the house prior to and during the invasion.
The military went into the house for one purpose- fish out Kanu which their intelligence gave them that Kanu was in there
The military cannot deny entry into Kanu's house neither can they justify that invasion outside their determination to fish out or hurt down Kanu
If Kanu is not seen anywhere else, circumstantial evidence are strong enough here to indict the military on his where about.

Imagine a different scenario.
Some armed hoodlums invade your private home
two persons end up dead by bullet wound and one or two others missing

Would the court require the video evidence of the bullet leaving a particular gun that is operated by a particular member of the gang to prove he (or they) are responsible for the family member that died from bullet wound?

Would the court required a video evidence of that actual carrying away of the missing family member to prove that the group kidnapped the missing family member?

The only challenge here may be the weak and corrupt judicial system that may easily be arm-twisted. But I see this case heading as far as the supreme court and at the end, the army will have to give account.

What he does think through with this plan is this, if he successfully deceive the Court that Nnamdi Kanu has been killed, arrested or hidden by Nigeria Army so as to avoid an arrest warrant being issued against Nnamdi Kanu, it ll be on record that Nnamdi Kanu is a dead man which means Nnamdi Kanu ll never ever appear in Nigeria again for life cos the Court now recognises Nnamdi Kanu as a dead man.

When a person is missing and there appears to be no record or trace of his whereabouts, it is not immediately assumed that he is dead. A minimum of 7 years must go past to be sure there are no other options than to consider such a person dead. The record of the court on the strength of this case will not be enough to declare and recognise him as dead.
