On a final note let's talk about LAWS AND RULES. THERE IS A NIGERIAN LAW THAT SAYS EVERY CHURCH AS LONG AS IT IS DOING BUSINESS MUST DECLARE THEIR BOOKS AND THEIR CHIEF EXECUTIVES MUST RESIGN AFTER TEN YEARS. This rule is an internationally applied rule.
MOST OF YOU GUYS SHOUTING RULES AND LAW NOW PROTESTED AGAINST IMPLIMENTING THIS LAW SAYING CHURCHES MUST BE EXEMPTED FROM THAT LAW. So much for people defending archaic rule.

The same constitution that guarantees the rights of Muslims to express their religious beliefs, is the same constitutions that guarantees the rights of Christians to express theirs, it's also the same constitution that guarantees the rights the rights of those who are religiously neutral.

It is the constitutional right of the Law school to have religiously neutral rules. I will say it again, the constitution doesn't give one person the right to usurp other people's rights.

Hi caseless, I have followed your arguments on this matter and I dont agree with you. The constitution doesn't guarantee rights that contravene other people's rights. And other people in this case might be organisations or workplaces. If the girl has a constitutional right to express her religious beliefs, I as an organisation also have a constitutional right to be religiously neutral. Let me put it this way, this is the basis of the separation of church and state, or in this case religion and state and that is why Nigeria is a secular state having banned a state religion in its constitution. This matter was debated at the level of the European Court of Justice fairly recently and it was determined that those actions do not constitute a direct discrimination if an organisation decides to be religiously neutral. The only caveat is that the rule must be applied across board affecting all religious and political affiliations.

If my religious right required I scream while praying in public places, I'm infringing on the right of others. If it allows me to walk naked, it's affecting the right of others. If it allows me to sing praise and preach in buses , my right is infringing on that of "others". If my right sourced from my religion and laws allow me to smoke and I do this in public, I'm infringing on the right of others.

Secularity does not mean a state is religion-less , it means the state grant freedom to all religion.
Section 45 of the constitution says why and when I can lose my right. Not the rule of a certain workplace or organization taking that right away from me.

Again, are you saying the judgement by an European court should be held sacrosanct in this jurisdiction? Isn't our law superior to any external judgement?

The same law must have ruled in favor of same sex marriage, and why is that still a crime here? It tells you we have our laws.

If you say the caveat is that the regulation must be across board, you can hardly find any other religion that teaches its adherents how to dress, only Islam does that. So bringing such rules will give a pointer that a certain religion is being targeted and could lead to protest.

Really, we owe our other Faiths brothers and sisters in this country because we failed to enlite them on what Islam is all about...The awareness is too poor, for instance, search your TV channels on Jummuat day if you can see any Islamic teaching program for 2hours on any national channels, likewise to our national radio station.

Supreme Court can't rule against the constitution just to serve narrow mindedness of few in NBA who drafted the rules. The rules will be put to test, time has come. I'm loving this.

How does a small girl turkin in a hijab inside her graduation gown infringes on say a Christian right or a pagan right or a school right? That's what the judges would look at. The girl does not in anyway infringe on anyone's right apart from breaking a school tradition. Finally even as you claim read section 1(3) and you would know which one superseded the other in terms of the girl fundamental human right and what u now term as school right

Please can you clearly state where hijab is indicated on the verse you recommended up there.

What you don't know is that Islamic scholars all agreed that there is no where in the Quran that wearing of hijab was ever instructed.

And please don't misunderstood me for some religious hater or something, as I said earlier I am irreligious. I just intend to clear a notion that is widely accepted by many Muslims without proper research.

Nigeria constitution doesn't give anyone or organisation the right to determine what religious inclinations of their members should be. The NBA itself is not a human being but members made up of it. Let the court decide.

The Ummah needs to reform itself from within otherwise the bigots will never take us serious. How can we be fighting for the recognition of the hijaab as part of Muslim women's dressing when wives and daughters of political elites, academics, Imaams as well as Professors and PhD holders in Islamic studies and Arabic are neither niqobites nor khimaarites but "iborites", "iborunites" and "gelerites"?

Brother relax cheesy, I realize this is a discussion that elicits passions on both sides of the argument but let's keep a cool head.
Look at this thing logically. Everybody's religious rights are guaranteed under the constitution including atheist and agnostics. Infact Nigeria is a multi religious state and that's why the glue of secularism is the only thing that can hold it together( Secularism means your religion is private, separate it from your public life).This is simple because in your public life you interact with everybody. The reason why it seems to affect islam is because the concept is unheard off in Islam. Islam covers everything and that's why you have what they called political Islam but I digress.

Now on the merits of the discussion.. The workplace or organisation is also a person like you. Let that sink in. The same way you have constitutional rights to express religious beliefs is the same way the organisation has it's own rights to determine it's religious inclinations. That right is also guaranteed by the same constitution that guarantees yours. So you can't usurp the other person's rights because you say you must express yours. So it all boils down to jurisdictions, and that's where wisdom and tolerance comes in.

I mentioned the judgement of the European court because that's applicable here. it was a hijab issue and the lady was claiming she had to wear it mandatory because of her religious views blah blah blah. It's very relevant because our constitution is a common law modeled according to the British and american values. it's not an Islamic cannon, neither is the country an Islamic country. we don't have sharia Law here. You can't wear hijab in my company if I want my company to be religiously or politically neutral. It's that simple. If you are not comfortable, then leave and by the way this also applies to catholic nuns, jewish priests, sihks folks and whatever guys that wear any type of religious signs including crosses and signs of the cross. it cuts across board. No christian, muslim, buddist, chinese, orthodox...whatever all are banned if i choose to be religiously neutral and it's my own fundamental human right.

I hope you get the point now.
