Good evening all
Gurus in the house, please I need your advice on this issue. I intend to apply for settlement visa to join my fiancé in November and we intend to have our registry marriage in October.
However, my fiance has dual citizenship; British and Nigerian, We intended he went through the registry marriage as a British citizen but we're being asked for security clearance from the DSS or a fee of N100,000 to wave that requirement.

1. My question is, would my fiance going through the registry marriage as a Nigerian hamper my settlement visa application?
2. Having the marriage in October and applying for the visa in November won't pose any issues for us in the visa application, would it?

He has the green and the burgundy, meaning he is Nigerian and British.......... The British constitution also recognises dual nationality.......
He should select Nigerian, not unless you want to pay DSS's tithe......

If you have all the documentations by November, don't see why any other factors should pose any problems.....

I am thinking why dont you do the court wedding in Nigeria and just apply for spousal settlement rather than applying for fiancé visa which seems like a longer process to be settled in the Uk...#justmythoughtsthough

Its possible you didn't understand my post. The court wedding would of course be in Nigeria, and the visa application would be for spousal visa.

Hello.I thought the same as you (justwise), Lexusgs430 and Oxygyne did, but after receiving that which i sent to you guys from International casework and quality assurance team i received a letter from Immigration and tribunal saying thus:

The respondent has copied the tribunal into a letter they have sent to the appellant.
The letter is ambiguous and does not meet requirements of the rule 17(2) of the 2014 Procedure Rules. The letter asks for the appeal to be withdrawn. Rule 17(2) requires the respondent to confirm that the decision subject to appeal has been withdrawn. As the letter does not withdraw the decision subject to the appeal, the hearing will remain as listed.
The appeal will proceed to be determined on the papers on the first available date after 19th September 2018. Should the respondent make a renewed application to withdraw, it should explicitly state that the decision subject to appeal has been withdrawn.
These directions are made by a Tribunal Caseworker Mr X in exercise of specified powers granted by the Senior President of Tribunals under rules 3(1) and (2) of the Tribunal Procedure (First-tier Tribunal) Immigration and Asylum Chamber) Rules 2014. Either party may within 14 days of issue apply in writing to the tribunal for the direction to be considered by a judge under rule 3(4). If you do not seek reconsideration by a judge then the Tribunals Caseworker's direction will stand.

If you make reference to my earlier position on this matter, I clearly told you two applicantions of the same dispensation cannot run concurrently......

And that is what this is clearly stating. They requested you withdrew your appeal, but you either did not or withdrew it too late.....

You should have contacted immediately you received that letter to correct the mistake. There is no point asking what that means really because its clear that proper procedures were not followed and need to be ratified.

Forward this letter to them today and follow it up with calls and emails

First of all, I have to say sorry and appeal to you to calm down because I am sure you are just as confused as I am and possibly worried. These emails come worded in strange ways, they can be interpreted in various ways which make it hard to understand what the way forward is.

To be sincere, I do not know the best way to proceed but just like @justwise suggested the proper thing to do now is to email and call UKBA relaying the information in the 2 emails you have received and let them interpret and tell you what do to next.

From my understanding, I think the original refusal has been overturned but there is a conflict because of the 2 separate cases of an ongoing appeal and a new application. Best guess, it seems your new application must have provided new evidence to grant you the visa and an email was sent to the tribunal to withdraw your appeal on the old application but the tribunal is saying the appeal should have been withdrawn before the new application was made. However, we can't be sure until you make that call.

Just remain calm and make the call. It will end well, we are here for you.

Read this section of the first email they sent carefully and do exactly that, this is like asking for a case to settled out of court but refused to withdraw the case.

Yes this can be confusing and tiring but you need read email carefully and put a call to them for more details.

This is not bad news, they only want to follow the proper procedures.

Beht Oga, counting 28 days is a little pointless nah..... The visa would never be issued in 28 days.....

So best applicant is prepared for the long haul (3/4 months).......

So sorry for the late response.
Yes we did the court wedding in Nigeria in ikoyi registry Lagos.
They made a little issue about him coming from ‘the abroad’ and having to pay more money for the court wedding, but they didnt care about his status in the Uk or if he was british( we used his Nigerian passport though).
You inform them about the wedding with ur intended date, and they post it on their notice board for 3 weeks or so before the wedding. During this time u fill out some forms and u do an affidavit that u and hubby are single. They will need passport photgraphs of you and hubby.
Don’t know if I have missed anything, but it was pretty straight forward.

I'm currently about to have mine in Abuja, so had to go make enquiries. The process is quite different from what I read about the ikoyi registry.

For the special marriage license, you need the Intl data page of your intended spouse who stays abroad, visa page ( if applicable), his / her passport photograph, his /her birth certificate or declaration of age cert, your passport photograph, your birth cert, your local govt ID, affidavit of being single from high court for you both ( they talk you into getting that done for you @N2000 each), marriage cost is N62050 (because you can have everything done same day without the 21 or 7 days notice), a sum if N100000 for security clearance (DSS) waiver.

Wedding days are Tue, Thur, and Sat.

Nice but here is my worry. All over the world, it is customary, mandatory and even maybe legal to have the 21 - 28 days notice of the intended marriage after which the ceremony can be carried out. This notice period is to allow for any objections from the public or couple's family and also for investigation of the intended couple to be carried out to prevent fraud or forced marriage etc.

So when you say you have been told to pay a certain amount to by-pass this stage, are you not worried or concerned. Do you then not think countries like the UK are then right not to recognize marriage certificates from these registries in Nigeria??

Why not just follow the full and proper process to ensure that you and your spouse a married the right/correct way to prevent unforeseen issues in the future. This is just my 2 cents.
