Why it matters: This would be the most dramatic move yet in Trump's hardline immigration campaign, this time targeting "anchor babies" and "chain migration." And it will set off another stand-off with the courts, as Trump’s power to do this through executive action is debatable to say the least.

Trump told "Axios on HBO" that he has run the idea of ending birthright citizenship by his counsel and plans to proceed with the highly controversial move, which certainly will face legal challenges.

"It was always told to me that you needed a constitutional amendment. Guess what? You don't," Trump said, declaring he can do it by executive order.

When told that's very much in dispute, Trump replied: "You can definitely do it with an Act of Congress. But now they're saying I can do it just with an executive order."

"We're the only country in the world where a person comes in and has a baby, and the baby is essentially a citizen of the United States ... with all of those benefits," Trump continued. "It's ridiculous. It's ridiculous. And it has to end." "It's in the process. It'll happen ... with an executive order."

The president expressed surprise that "Axios on HBO" knew about his secret plan: "I didn't think anybody knew that but me. I thought I was the only one. "

Behind the scenes: "Axios on HBO" had been working for weeks on a story on Trump’s plans for birthright citizenship, based on conversations with several sources, including one close to the White House Counsel’s office.

The legal challenges would force the courts to decide on a constitutional debate over the 14th Amendment, which says:

"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

Be smart: Few immigration and constitutional scholars believe it is within the president's power to change birthright citizenship, former U.S. Citizenship and Immigration Services chief counsel Lynden Melmed tells Axios.

But some conservatives have argued that the 14th Amendment was only intended to provide citizenship to children born in the U.S. to lawful permanent residents — not to unauthorized immigrants or those on temporary visas. John Eastman, a constitutional scholar and director of Chapman University's Center for Constitutional Jurisprudence, told "Axios on HBO" that the Constitution has been misapplied over the past 40 or so years. 

He says the line "subject to the jurisdiction thereof" originally referred to people with full, political allegiance to the U.S. — green card holders and citizens.

Michael Anton, a former national security official in the Trump administration, recently took up this argument in the Washington Post.

Anton said that Trump could, via executive order, "specify to federal agencies that the children of noncitizens are not citizens" simply because they were born on U.S. soil. (It’s not yet clear whether Trump will take this maximalist argument, though his previous rhetoric suggests there’s a good chance.)

But others — such as Judge James C. Ho, who was appointed by Trump to Fifth Circuit Court of Appeals, in New Orleans — say the line in the amendment refers to the legal obligation to follow U.S. laws, which applies to all foreign visitors (except diplomats) and immigrants.

If I read well, his aim is to stop visitors and illegal immigrants from giving birth to citizens. Legal immigrants will still give birth to US citizens .

I think this is good move for Nigeria. It is because of this cheap access to the US citizenship that our healthcare is in a mess. If the likes of Buhari and other politicians including celebs and rich Nigerians do not have access to developed countries to take advantage of, by now they would have fixed Nigeria healthcare and other sectors

What have you done for the country, what have you contributed to the country? But people just want to go and give birth there so their kids will benefit from being called a citizen of other country.

Truly his decision is in order, you have to earn it as a person before you can have a child to become citizen. And not just flying to another man's country for the sole purpose of putting to bed. Trump's action is equal to putting the country's interest first at heart.

I really support Trump on this one. It's a big cheat how people come to America give birth and get automatic citizenship. This is America for Christ sake. Come here and see how Mexicans who are unauthorized just wall and come here to have babies. I have argued with some people here that how does immigration make those kids citizens and their parents are illegal. But I still don't believe my friends. If you want my citizenship, earn it the right way by marriage or investment. Those come hard but try to earn it.

I believe if he doesn't know, his handlers must have told him. He may be an idiot but many of his handlers are quite bright.

1) So first point of action I think he will do is to set the ball rolling by executive order.
2) All hell breaks loose and many go to court.
3) Courts can't decide so they throw it back to legislative
4) Gbam, 14 th amendment becomes shaky. Cos repubs have majority, it's changed.
5) Executive order becomes an act of legislature and law.

NB: It will take them minimum 18 months to accomplish. It's probably what they have wanted all along cos am sure they know they won't be voted back.

With a willing congress (Republicans are the majority in both Senate and House, and might continue to be after the November elections), this can come to pass.
This is also a "call to vote" among his base, who want to see this happen.

The irony is that the vast majority of economic development in the USA - then and now - have come from immigrants, or from children of immigrants. The people that tend to have their children there spend a lot more money in the USA - only wealthy people from other countries can afford to fly, rent a place, and pay full hospital bills without subsidy/insurance/wellfare. The children of these people also tend to pay a lot for their education, and as citizens - are obligated to pay taxes on income earned anywhere. The US gov't actually benefits tremendously from these policies, though most citizens don't realize it.

This is yet another step in the direction that sees the erosion of USA clout in this century.

In the case of those parents who just visit and give birth, the child is raised in their parents' country, so the USA doesn't spend a dime on their education or health, nor does it even subsidize their birth costs. Furthermore, they tend to return to USA for college (which is not free). When they grow up, they typically work in highly-skilled positions, start innovative companies, use their connections to home country to the ultimate benefit of the US, and end up adding so much more value to the US economy. They provide employment, and pay more than their fare share of taxes per capita. No matter where they earn their income, they are obligated to remit up to 30% of that income as tax.

The US gov't knows very well the benefits of these policies, so it's not a one-way relationship that only benefits the parents.

You missed the point. Buhari in my opinion is rather like trump in patriotism. I feel Nigerian politicians are more of the problem coloring every good intention as bad. Check the policy of non Nigerians working in Nigeria to be paid in Naira and in Nigerian bank as against the previous practice of paying expatriates in USD and crediting their off shore accounts. Politicians say the govt is discouraging foreign investment. Check Mtn repatriation saga, government is said to be discouraging investors.
There are fundamental rules to abide which enable a nation benefits from the presence of foreign businesses and individuals.
Any attempt to correct the subsisting anomalies is politicized.

I don't like all about Trump but his policies on immigration is spot on. No country in the world, I repeat no country will allowed illegal immigrants to come into their countries and enjoy full benefits of citizenship. Even, our Nigerian nationals are also found of this attitude, if your wife is pregnant the next thing is organise visiting visa to have baby in USA just to claim citizenship. It is not fair and not just. It's like allowing NIgeriens and Malians come to Nigeria to have babies and claim citizenship. What's the difference between Citizenship by birth and marriage? Have you not seen Nigerian guys that marry old white women just to get papers?

What's the difference between that and getting a visitor's visa to giving birth in the US?


Most people here don't realize that unless that child stays in the US, the citizenship is a burden. I know folks who came back to Nigeria to work and are required by law to pay taxes in Nigeria and the US. After a while, they return because they end up owing so much in US taxes.
