. Yes the children can file for their mother once they turn 21. My guardian, when I first came to the US became legal through her US citizen child filing for her after the child turn 21.

Illegal immigration is very very big problem in the U.S . Being illegal here means you are not settled which is why the op created the post. In the article you posted , the lady mentioned how opportunities were limited because she did not have work authroization. Most jobs today that are under the the table are low paying and they work you like a slave. I think the op should google dreamers and see the plight that her children may face in the future. The daca program which is a temporary programs is being fought in the courts right now the administration wants it ended. Although some daca people have gotten married , a good portion have not married .

I lived in Nigeria after being born abroad and lived abroad from some years and I came out just fine . In fact it helped shaped me for the better. I like America but in my opinion it’s not worth it to live here illegally.

I’m not being insentive, I’m being real. If people want to move to another country legally by all means they should go ahead .It’s obvious that things are not going to well for the op and she has concerns about her/children future, that’s why created the post. They are not legal here and wasting time here and waiting for the unknown it not worth it. I live here and see the stressors that both U.S citizens , legal immigrants and illegal immigrants go through . In my opinion , the op should go another country. Her and her children are still young and can start life afresh somewhere else where they can maximize their potential,it’s does not have to be Nigeria.

Yes , the children might be able to file for their mother if they eventually become US citizens and after the age of 21 years of age however, the mother will not be able to adjust her status to greencard while remaining illegal in the US.

The mother will have to go back to Nigeria and obtain the legal immigrant visa which will qualify her to obtain the green card when she gets into the US Legally.

The problem is that the mother after living illegally in the US over a number of years she has triggered the ban of 10 years from entering the US.

For out of status parents , they could file an i 601 waiver, which certain foreign citizens who are ineligible to immigrate to the United States because they are “inadmissible” can request a waiver (forgiveness) of inadmissibility. It’s usyally common among US born children and illegal immigrant parents.

my bad, your right a illegal parent does not qualify. Us immigration has a hierarchy when it come to family sponsorship.

Thanks guys. I think I'll just try and save up as much as I can for now. If within those periods I'm able to do my papers, fine and good. If not, I'll just move back to Nigeria.

Moving to another country is not even in my dictionary cheesy should I move back to Nigeria, I'm done with relocation for good...lol

LOL, my sister one thing I learned about life is that you have to be flexible and keep your options open. If you want to go back to Nigeria thats fine, but just in case that it does not work, you should have the option to move somewhere else. If you move back home, your biggest concern is going to be source of income. Have you researched what options you have back home to earn a living?

hahaha coming from a guy living in the UK..quantinue..lol..let me give you small example..presently the weather in nigeria is very hot and no light even when you pay for bills,i pity those guys staying in face me i blow you with kids..why do you think nigerians are always frustrated..weather hot and light no day.theres mad suffering in nigeria,things are expensive..1kilo of chicken is 1000 or 1200 and where i reside you can get chicken for 500 full chicken..how can one raise a family in nigeria..no light,light is gold to me..i cant wait to run away again..nigeria is worse..i dont want all the riches in the world..i need stable nepa..i mean is that too much to ask for in nigeria..we suffer and smile too much...

This a civil thread, if you can not behave yourself, then move along. We are having an open discussion, this thread can also help other people who are in the op situation as well and can serve as a caution to people who want to come here and overstay their visa.

exactly..leave all people that never hustled a day in their life to keep yapping....they type from amelika and talk about nigeria...look if you are not in nigeria now you wont understand the reality on ground..but the OP made up her mind already thats my own point..

too much suffering and smiling in naija...today in paris people are protesting about rising cost of things over there..even close to the presidential palace..how do people live in naija..i mean suffer too much

The reason why I mentioned after is because people said the children would be able to survive after living here. I take care people who are in her shoes regularly , they go through much worse because now they're sick and don't have papers.

Single mother with 2 kids and 3k USD under her name. She wouldn't qualify under any program to move to another develop country, talk less have the funds. Furthermore, these countries share information and her over-stay in the U.S would definitely be known. If she leaves America, she'll most likely never step foot in another developed nation again.

At this point, this is probably the most reasonable path forward. Save as much as possible while you're still here, hope for the best but plan for the worst case scenario. Against my better judgement, and fighting every fiber of my being, I will reiterate that it's still possible for you to adjust your status and that of your kids without leaving the country through marriage to a U.S. citizen, provided you were duly inspected by CBP at point of entry...probably a moot point because I'm almost positive you were. Your kids can also adjust status through the same process when they become of age but that means long years of hiding from the law for y'all.

At the risk of being accused of aiding and abetting, here are some actionable points you can start with to improve your chances:
1) Make sure to keep your travel documents safe, especially your proof of inspection at border of entry. I believe you can still print a copy of your I94 online... or just make sure the stamp in the passport does not get missing.
2) Where is the father of your kids? Were you or are you married to him? Did he give consent for them to travel here and stay? Sort this out asap. It will come back to haunt you if you don't. Get divorce papers and parental consent. He may also need to give the kids up to be adopted by future spouse.
2) In what state or city do you currently reside? Your chances may improve if you are in NY, Chicago, Houston ........ you get my point here?
