ValCon888:Below is Mike Ozekhome ,SAN. Argument Supporting the suspension of Justice Ayo Salami President of the court of Appeal by Jonathan over allegations of corruption without any evidence or case against him in any court. Pls read.5 *”According to Section 11 of the Interpretation Act, Cap 123, Vol. 8, LFN, 2004, the President can suspend indefinitely but not remove without senate. And the President just exercised this”* This was the law that Mike Ozekhome ,SAN deployed in his argument supporting Jonathan but today the clown is calling for breakdown of law & order. |

[quote author=Steinmann post=75142573]If you are a lawyer you should have known the following. 1. Such rulings should not be by ex parte motion but by motion on notice.Based on fair hearing. 2 If it were not on instigation of the presidency,it reserves the right to challenge any unconstitutional order made on it. 3 The CJN as far as the law is concerned as at now is an INNOCENT man and has not been proved guilty of any offence. 4 You cannot just remove an innocent number 4 citizen that has done no wrong except in zoogeria where the mad people have taken over the asylum.[/quote I know even think sey u dey current at all. Was he suspended for nothing..... Didn't he admit that he forgot to declare his assets. Abeg keep shut if you don't know anything.... |

Wallade:Mr man.. U can not change english language... There is difference between a suspension and removal... I am sure u saw the order by the CCT....if not, google u will find it. Suspension is not removal...in Law, nothing like assumption or nothing like suspension is tantamount to removal. That is how people win cases or get cases thrown out based on technicalities. Like i said, blame the constitution not the executive. |

Absolute balderdash. Nothing can justify this act of tyranny perpetrated by the sick one who currently occupies Aso Rock. The law is clear on this. It is unambiguous. The NJC is the body that should investigate him. And he can't be removed or suspended by the President without 2/3 majority of the Senaate voting against him. Buhari has once again demonstrated and exhibited his disdain for democracy. |

ValCon888:Well written. If only NBA and the whole Judiciary can stand up against this, their case will be like that of NLC. How can power be domiciled on the hands of politicians instead of the people. Our democracy is peculiar and everyday we rubbish every characteristic of that system of government. May God help us. |

eyeview:Do u know that the Vatican under Pope Pius XII employ illegality too to save more than 800,000 jews by issuing them false baptismal cards and ordination certificates to pass as catholics/priests? Dietrich Bon Hoèffer said concerning the failed coup against Hitler he partook in: " We must become monsters to destroy monsters." If the constitution aid and abete criminals, then we can circumvent the constitution which is a clog in the wheel of justice to get justice done. Nigeria is hemorrhaging under compromised judges no thanks to the cash and carry PDP institutionalised in our pysch and since the rule of law protects rich Crooks and jungle justice for poor phone thief, then we need a benevolent dictator to tackle this hydra monster. will u call for d rule of law if an armed criminal invade ur house and u hv the opportunity to kill him? Many of u make reference to western countries as if The U.S. and Uk didnt flout the order of the U.N. not to invade Iraq or Libya cos for them it was to protect themselves from terrorism. where was the rule of law? |

ValCon888:Did you read it at all, read it again, they said suspend, not remove, it's only in Nigeria civil servant will be investigated and remain in office, most developed countries, they resign on go on compulsory leave. What exactly are you saying, he is the Head of the entire arm of government, are you drunk? He is the Head of all legislation arm, and at such, no court order is capable of suspending him except the president steps in. |
