If you are a lawyer you should have known the following.
1. Such rulings should not be by ex parte motion but by motion on notice.Based on fair hearing.
2 If it were not on instigation of the presidency,it reserves the right to challenge any unconstitutional order made on it.
3 The CJN as far as the law is concerned as at now is an INNOCENT man and has not been proved guilty of any offence.
4 You cannot just remove an innocent number 4 citizen that has done no wrong except in zoogeria where the mad people have taken over the asylum.

When you say innocent what do you mean? He has already admitted with an excuse that he forgot.

There are three arms of government in Nigeria's democratic system of government: Executive, Judiciary and Legislative arm of government. The CJN is the head of the Judiciary hence an independent arm of government. The president has no business or power to suspend a CJN especially considering the dictates of the Constitution of Nigeria.

The president desecrated the constitution that he swore to protect with that action; the president went overboard in exercise of his powers.

There is still a general head...the president.
The president has the powers to remove as stated in the constitution via some procedures...however the constitution didnt lay down procedures for suspension.
These are 2 different things. Blame the 1999 constitution not the president. Besides a court of competent jurisdiction gave the order....
Same way the constitution did not stipulate hpw.long the EFCC chairman can act, same way the constitution dod not stipulate if the CBN governor can be removed.
All this a technicalities issues with the constitution...
Until it is amended...we are just making noise

"Given the supersonic speed at which the CCB & CCT are moving and the uncharacteristic enthusiasm of the FG to comply with judicial orders, I am suspicious of the motive behind the prosecution of the CJN.

I am also concerned with the time of the whole thing. But this is just a marginal note; a statement by the way side. I will keep it for another day.

Now, turning to the topic at hand, I do not see anything wrong or illegal with the suspension of the CJN and swearing-in yesterday of Hon. Justice Ibrahim Tanko. The action of PMB is constitutional. Nay, he had a duty to act in the way he did. Here are my seven reasons:

1. PMB did not act on his own motion. He acted on an Order of the CCT.

2. The CCT has an inherent power under Section 6 of the Constitution to issue any order that will promote the Rule of Law and ensure the smooth conduct of its proceedings. I believe this order does both. See point 7 below.

3. Some lawyers have argued that CCT’s Order is illegal or even unconstitutional. But this is not PMB’s business. He can’t question the legality of a judicial decision as doing so will tantamount to the president sitting on appeal on the Judgement of a Court.

4. Under our constitutional system, PMB has no option than to obey the said Order. That is why we have been urging him to obey the Orders on Dasuki and Zakzaky. I repeat the same call here toady;

5. The provisions of Section 292 cited by the NBA and others do not apply to this matter as the CJN was not “removed”. He was “suspended” pursuant to a valid and subsisting Order. The removal envisaged by and under Section 292 of the Constitution means “the dismissal of someone from a job” while suspension as in the present case means “[to] temporarily prevent from continuing or being in force or effect.”

6. The CJN is the head of the all Nigerian courts and Judiciary as well as the Chairman of the National Judicial Council which, under his Chairmanship, exercises supervisory and disciplinary role on all judges and judicial officer in Nigeria. This means any decision reached by CCT may likely go on appeal up to the Supreme Court where the CJN is at the helm of affairs.

7. It is against the rule of Natural Justice for Justice Onneghen to remain the CJN and Chairman NJC while facing trial under the same judges whose promotions, disciplinary and other related matters are under him;

8. I believe this action will facilitate quick dispensation of justice in this matter. Before the Order, the “generous SANs” representing the “poor” CJN had started taking steps that are clearly intended to frustrate his trial. They had started raising frivolous issues and making empty applications because they knew that their client had an upper hand. Now that he has been suspended, the defense counsel will be serious to prosecute the matter to its conclusion so that their client might be reinstated as quickly as possible if he is not found guilty.

9. Assuming, without conceding, that there are any anomalies in the procedure adopted. I would rather forgo any such anomalies for the crushingly disappointing alleged acts of the person who is suppose to hold those who violate our laws to account. I feel we must get the bottom of the allegations against the CJN whatever and punish him if he is guilty."

In 2007, Justice Oncogene played a huge rile in 2007 election which saw the Late Umaru Yar’adua as President of the federal republic of Nigeria. He had a dissenting judgment that indeed annulled the presidential election. His position was however a minority judgment.

I noticed how you subtly downplayed the fact that the same Buhari who has refused to heed the court orders to release both Dansuki ans Zakszaky is now suddenly eager to suspend the CJN because of CCT orders.

I was at a vigil till this morning and was telling a friend who was threatening thunder and brimstone that if Onnoghen and Buhari's children were to be awake at that point in time, it will most likely be at a place catching their fun or clubbing away and not praying their necks to fall of.

Bottom line; Let the elite and the political class settle themselves.
Develop a good self esteem & the sky will be your limit! Do have a wonderful evening....

Whoever wrote this is an idiot.
The Constitution is above all positions and authorities. Above the President, the Senate President and the Chief Justice of the Supreme Court. Therefore, no one, whether the persons occupying these three positions or any other person has the power or prerogative to invent any new ideology or promote their idiosyncrasies outside the circuits of the Constitution.
The Constitution of The Federal Republic of Nigeria only provides for the REMOVAL of the CJN and not his/her SUSPENSION. The contrived action of Mr President is an illegality as it is not enshrined in the Constitution.
The President cannot be SUSPENDED. He can only be REMOVED from office. The Senate President cannot be SUSPENDED but is REMOVED if found wanting. The Chief Justice as the head of the judiciary which is one of the three arms of government CANNOT be SUSPENDED but be REMOVED if found wanting ONLY by the provisions of the Constitution.
Even an order from a court to an ignorant President which flouts the laws of the nation according to the Constitution is NULL and VOID. A court order must be in line with the Constitution and not contrary or subversive.

Did Mr President follow the procedures of the constitution concerning removal of the CJN? No!

When did this court of competent juridiction serve the purported verdict? Courts don't give verdict in abscence of the prosecution and defendant attorneys. They were all represented in the last court session and there was no such verdict.

I see you are trying to distinguish between suspension and removal. As long as the CJN can not perform his duties in your case of suspension, it is tantamount to removal and there is no valid excuse for the president to inflict such dangerous blow on another arm of government that the president should not control.

Who declared them saints?

Based on the above In this matter only the constitution can be trusted not Buharis body language or an illegal court presided by a judge also having corruption charges against him.

An accused is innocent until proven guilty by a court of competent jurisdiction. Even if he admitted to have forgotten to enter the accounts on the previous declaration form, he filled another declaration form, some years later, that indicated those accounts.

Mind you, he is not in your court hence you can't judge his case and conduct a kangaroo suspension/removal of the CJN without reckoning with the process stipulated in the constitution. You have to ultimately try him in court and he can only be removed from office upon the recommendation of the NJC.
