id911: You guys just bandy words around without examining the REAL MEANING! "Incontrovertible evidence" means evidence that cannot be DENIED or CONFRONTED in any way! The basis of Atiku's legal challenge is FAULTY , NUL and VOID. It is trite in law that 'You cant BUILD SOMETHING on NOTHING". Any legal challenge to Buhari's victory based on ELECTRONIC TRANSMISSION oF RESULTS, is ILLEGAL (Section 10 of the Electoral Act 2010), UNCONSTITUTIONAL AND THEREFORE NULL AND VOID. It is as simple as that. Its a "technicality". Recall: the INEC CHAIRMAN said the Results WOULD NOT be TRANSMITTED ELECTRONICALLY, even before the election was consducted! Also, INEC Server was Shut down and OFFLINE throughtout the elections. The reason the INEC Server was put OFFLINE and switched-off was because the Electoral Act 2010 forbade INEC from transmitting ANY RESULT electronically! Any INEC staff that does so, will even be committing an "electoral Act offense" because the Electoral Act 2010 (as amended) forbid it. I actually played a very crucial role on behalf of INEC, in the past election....and that is why l can confidently tell you, from the "Position of Law", why no attempt can be successfully made, to validate this Presidential election, based on card reader transmission of results. Everything YOU are saying, is just chatter, from the camp of an Atiku who is desperate to become President of cameroun before you argue further, go and read the 2010 Electoral Act that guided the just concluded election and specifically focus on what it say about use of card reader, vis-a-vis transmission of results. A thousand IBM, Microsoft, Apple and facebook + Twitter all roled into one, cannot change the Electoral Act 2010, which forbade the TRANSMISSION of RESULTS BY ELECTRONIC MEANS and any claim based on such ILLEGALITY, will remain illegal, null and void. Hmmm..... Technically speaking, the electoral act doesn't permit transmitting result electrically/electronically via card reader, so it is easy for atiku to lose on a technicality............ But, Commissioners presented in evidence that they transmitted results electronically after collation............ And on the strength of what is collated, atiku's argument/case now rests....... The real question now is this, does the illegality or otherwise of the process of electrical/electronic transmission, ortomatically (all pun intended ) nullify the results sent to the server, even though the results announced, at the polling unit is what was allegedly sent to the server by INEC commissioners (as a guideline and not a legal requirement) ......... Does INEC now lack the power to issue guidelines to ensure smooth operations of it agency, even though the guidelines are not extensively and explicitly spelt out by the electoral act......... vacanci: This is one out of so many evidences....PDP did monitor the elections very well using technology at it's best... Did you notice what happened in Kenya? That will also happen in Nigeria soon. The truth must prevail... Enough is enough! Atiku actually won the election. PDP knew that APC would rig the election so they had to take all precautionary measures to counter it... So what technical grounds will APC/Inec use in defending the enormous evidences with PDP? Except the Judiciary has been compromised by APC which I believe will be too glaring if the judiciary allows itself to be compromised. Once that happens in the face of all these evidences, then Nigeria is finished under this regime! So all eyes are on the judiciary to follow the part of truth and objectivity no matter what the cost may be. I believe in the truth! Can a Judge give you a Positive verdict, for an Act that is ILLEGAL under the Law or an Act that is UNCONSTITUTIONAL? 2.) Which Law guided the 2019 Presidential Elections? 3.) Does the Law (Electoral Act) which operated the 2019 Presidential elections, ALLOW for the Transmission of Election Results, ELECTRONICALLY? 4.) If 'Election Results' where transmitted electronically, as Atiku is relying on, can such result be VALID and relied upon, to give him a mandate? GreyLaw: The law does not allow indiscriminate modification of petition. Whatever comes out after the petition have been served cannot be used in the case. The major impediment to Atiku's petition and evidence is that the law does not recognize electronic transmission of results. |

discusant: The "Defense" of the INEC Chairman is that: 1.) the Law does not allow him to transmit election result Electronically. 2.) It came to his knowledge that PDP has employed seasoned HACKERS to tamper with and corrupt the election result, while in ELECTRONIC TRANSIT TO INEC SERVERS and for that reason, to ensure the integrity of the electiosn and to obey the law (Electoral Act 2010), the Servers were Shutdown and Put OFFLINE throughout the elections. Case Closed and Dismissed accordingly. |

In an election were carder reader was not 100% used across polling units ... how can inec servers present reliable & authentic results. In areas where corpers/ad hoc could not even operate the device to authenticate voters and manual accreditation was opt for ... how will inec server account for those votes, how did atiku get a complete statement of results , can we dwell on a server results that disenfranchises manual accredited voters regardless of the fact it has no electoral act backing |
