Go with at least 2 passport photos, international passport, appointment confirmation printout, DS-160 printout, GTBank Payment Receipt, Birth Certificate, Police Clearance Certificate, Medical Report (sealed), filled Affidavit of Support form along with its supporting documents (fiance's birth certificate, international passport, tax returns, bank statement, employment letter, etc), copy of documents your fiance submitted to USCIS when she petitioned for you (i129F along with supporting documents), proof of relationship (WhatsApp Chats, Call Logs, Pictures of you both together, copy of Flight Boarding Pass used to visit fiance, money transfers, etc) and other documents that supports what you filled in the DS-160 thats not listed here.

@Simcha I recommend you go to the visit visa thread (https://www.nairaland.com/5101710). Read through it and perhaps ask some questions. They are in a better position to help. Although I must add that a Visit Visa is not the route to use if you have immigration intent.

This thread is for those who already have a US Citizen fiancee and want to commence the K1 Visa Process.

I was denied.
Had my interview yesterday but it was denied.
I have been married before at d Local Govt Registry but I did not get a Divorce Decree from high court. I only presented a divorce document from the local govt. I didn't know I had to go to the high court to get a divorce decree. Apart from that, all my documents were complete. If I had said I did traditional marriage, I would have scale through. Knowledge is power.
No question is too small to ask. Always ask question for clarity sake.
The CO said my only option is to get married here after getting d necessary document. And then file for a CR1.
My Fiancée is going to talk to a lawyer about it.
I'm really devastated right now.

I want to specifically thank legitbachelor for all your spontaneous responses and everyone here on this platform for all your support advice and feedbacks.

I seem to be d old one. I take a brown. Love you all

Sorry about the denial.

The same would have happened even if you told them what you had was a traditional marriage. They see traditional marriage or introduction as being too married for a K1 visa.

Like the VO mentioned, best is to do a spousal visa.....and you need to get a proper divorce from a court along with the divorce decree from the court.

It's just a delay..... not the end of the road.

She said she was divorced but didn’t have the high court divorce papers. They could have asked for additional papers tho.

What I dont understand however is why the consular officer said your only option is through Spousal Visa. Based on what you just said, you can still apply using either Fiancee or Spousal Visa after obtaining the divorce document from the court. After all, you are not yet married to your man. But if you guys are married OR plan to marry outside the United States (bride price payment and/or traditional wedding), then your only option is Spousal Visa.

However the final decision is yours and your fiancee to make. Both Spousal and Fiancee visa has its pros and cons.

I wish you the very best. This is not a denial but a delay. Gods Grace.

She can actually go through the Fiance Visa route again....but one major advantage of the Spousal Visa over the K1 is the ability to appeal in case of the unexpected.

I'm sure the CO did and she told the CO that she don't have it. Even if she now go and get the divorce papers, it will not be accepted as the date on the divorce paper will be that of today and not the day before her fiancee filed for her. One of the eligibility requirement for K1 Visa is that both intending couple must not be married as at the time of filing the i129F petition. And since she didnt get the divorce document when her fiancee was filing for her, it means technically she was still married at the time.

That being said, I believe the CO was being too thorough. Some COs might not have noticed the error and would have approved her visa. Even me myself didn't know that a divorce document from the place where wedding was conducted is not enough unless a document from a competent High Court is gotten. But its well, God knows the reason for this delay. She will eventually be with her Love at God's own time which will be soon enough.

Its not compulsory but highly recommended. Getting a K1 visa with only one visit is very difficult as the Consular Office will need lots of substantial evidence to prove you guys truly love each other.....and that evidence is hard to get.

Many people have been denied K1 Visa because the CO wasn't convinced but several have also been approved with only one visit. The choice is yours.

I met my fiancee twice within 2 years. She filed for me after my first trip but we met again before my interview date. It cost me close to a 1000 dollars for the second trip. But I had to do it to prevent the possibility of being denied....which will lead to wasted time and money.

Questions Asked:-

Answered Yes,
Why did you divorce him!
What kind of marriage did you do!
Me, local govt registry
CO,: sorry you are not eligible to remarry because you did not divorce property. You cannot use a customary court divorce document to annul a Local Govt marriage. According to Nigerian Law, you can only divorce a court registry through a marriage decree from the High Court. I'm sorry but I have to deny you. Returned my passport.
Me: I get you but can you please permit me to get the document asap and send it to your office.
CO: No
Me: Stood there for like a minute thinking she will change her mind. After realising she has made up her mind said thank you and about walking away.
CO: OK, the only thing I can do for you is to continue the interview so that in case your Fiancée decides to come n marry you here in Nigeria, it will fastrack your approval. Tell him to file a CR1.
And then she continued the interview:
CO. Remind me how met, how did it happen
How many times have you met in person
Tell me about his life over there
How did he proposed
Show me pictures
When and where was this
How do you communicate
OK. That's all I can do for you.

I am so sorry about this. She could have asked for proper divorce papers! Anyway God knows best. Please tell your man not to waste any money on any lawyer. Let him send an email to uscis about the petition being denied and then file CR1. Stay strong dear. All the best.

You'll be denied if you mention it during your interview. You can't be married and yet seek to get fiance visa at the same time, they will deny you and advice you go the spousal visa route.
